BACKGROUND

 

At the 31 March 2008 meeting, the Agriculture and Rural Affairs Committee (ARAC) endorsed the following motion related to boundary roads:

 

WHEREAS, the conditions of our boundary roads have been identified from residents of the east, west and south on numerous occasions through public delegations at ARAC and RIAC as well as through written correspondence, and;

 

WHEREAS, the ongoing operations and maintenance of these boundary roads is shared with our neighbouring municipalities;

 

THEREFORE BE IT RESOLVED THAT staff in Public Works and Services be directed to review the condition of our boundary roads and ditches, and report back to ARAC;

 

THEREFORE BE IT FURTHER RESOLVED THAT staff work with the Public Works Departments of our neighbouring municipalities to develop a strategy to ensure that these roads and ditches are maintained within the parameters of City standards.

 

Since the approval of this motion, staff has been working with the City’s neighbouring municipalities.  The purpose of this report is to provide the outcome of those discussions. 

 

 

DISCUSSION

 

Boundary Roads Identification

 

The City of Ottawa has over 5,550 km of roads and shares 114km of boundary roads with 12 bordering municipalities.  A boundary road defines the boundary between two municipalities, and although it may not straddle the precise boundary line, its identity as a boundary road remains.

 

Based on the City of Ottawa road classification system in the Transportation Master Plan, the boundary roads are as follows:

The road surface type impacts the type of equipment and strategies selected for regular maintenance, snow removal, and other operations.  The life cycle analysis for rehabilitation strategies is also based on surface type.

 

A list of boundary roads, ward location, boundary municipality, road classification and surface type is included in Attachment 1.

 

Boundary Roads Agreements

 

In accordance with S. 29(1) of the Municipal Act, municipalities on either side of a boundary line have joint jurisdiction over boundary roads.  Both are jointly responsible for its maintenance and repair.

 

The City of Ottawa has a number of verbal agreements with boundary municipalities regarding maintenance or capital renewal.  The only formal written document covers 1.6 km of the 114 km of boundary roads.  This agreement was recorded in the minutes of a site meeting 22 October 1981 for the South Gower Boundary Road in the Township of Osgoode.

 

A summary of the maintenance agreements with boundary municipalities is provided in Attachment 2.  The following are key highlights:

 

·         City of Ottawa maintains year round and pays 100%:  20.8 km

·         Boundary Municipalities maintain year round and pay 100%:  27.5 km

·         City of Ottawa maintains year round and charges 50% of the cost to the boundary Municipality:  58.5km

·         Boundary Municipalities maintain year round and charges 50% of the cost to the City of Ottawa:  2.2 km

·         City of Ottawa maintains in the summer and adjacent Municipalities maintain in the winter and no lateral invoicing takes place:  2.7 km

·         Un-maintained (unopened) section of road:  2.2 km

 

During the exercise of searching for and reviewing boundary road agreements, 4 additional road maintenance agreements affecting non-boundary roads were identified (Attachment 2).  These are also not documented in formal agreements:

 

 

 

 

 

For capital renewal or upgrade of boundary roads, historically cost sharing has been a 50/50 split between municipalities.  Generally the City of Ottawa initiates the renewal project, informs the neighbour municipality, coordinates the project and recovers 50% from the other municipality.  Typically, renewal projects are undertaken when both municipalities have approved their respective funding.

 


Boundary Roads Maintenance and Capital Renewal

 

Whether delivered by the City or by the boundary municipality, the services provided on boundary roads are the same.  In the City, Public Works is responsible for maintenance activities and Infrastructure Services is responsible for capital renewal or upgrades of boundary roads.  The maintenance activities performed on boundary roads are consistent with those delivered on other rural roads.  These can be divided into two groups: winter and summer operations.

Winter Maintenance

 

·         Snow Clearing – Scarifying

·         Snow Clearing – Plowing

·         Snow Clearing – Winging Back

·         Application of Winter Abrasives (Grit Sand)

·         Application of Winter Chemicals - Dry Salt

 

Capital renewal includes rehabilitation or replacement of structures and culverts, resurfacing and upgrade of gravel roads that involve major road improvements and in most instances hard surfacing.  Prioritization of renewal activities for boundary roads is consistent with other city roads.  As previously noted, these activities are generally initiated by the City of Ottawa with cost recovering from neighbouring municipalities.

 

Level of Service

 

A review of the maintenance standards applied to boundary roads indicates that similar levels of service are applied, whether delivered by the City of Ottawa or by the boundary municipality.  The reason is due to the ongoing dialogue between neighbouring municipalities regarding maintenance issues and the fact that many maintenance standards stem from Provincial Standards or have evolved over many years to a level that is acceptable to both municipalities.

 

A key factor in the perceived level of service, whether delivered by the City or the boundary municipality, is related to the physical condition of the road and the adequacy of the drainage system.  Roads that are sub-standard in terms of condition or drainage are more difficult to maintain and are often the source of resident complaints.  These improvements are generally undertaken as part of capital renewal activities and in some instances may involve Municipal Drain provisions to address drainage concerns.

 

Next Steps

 

City staff will be seeking formal written agreements with all boundary municipalities pertaining to maintenance and capital renewal activities of boundary roads. These agreements will define roles, responsibilities and cost sharing arrangements. City staff have already initiated discussions with some boundary municipalities.

 

 

RURAL IMPLICATIONS

 

Boundary roads are located in the City’s rural wards, including 5, 19, 20 and 21.

Where required to clarify information, City staff consulted with boundary municipalities in the preparation of this report.
