BACKGROUND
At the Council
meeting held on 8 February 2006, a Motion (Document 1) was passed that
"the City of Ottawa Light Rapid Transit Office be directed to provide all
members of City Council with a complete inventory of all information, reports,
clarifications or documents that have not been made public to date. The Fairness Commissioner for the Project
will review such information (with subsequent disclosure of all public reports
or documents) and present to Council at its next meeting an explanation as to
why the protected information has not been released publicly." This report
responds to that Motion.
Table 1
(Document 2) is an inventory of all the information, reports, clarifications
and documents of file with the Light Rail Implementation Division office. Data therein consists of background
information of the existing conditions, structures, features, utilities,
properties, etc prior to issue of the Request for Proposals for the North-South
Light Rail Transit project, as well as the design parameters as provided by the
Environmental Assessment for the project, and, supplemental information,
reports etc., developed to further assist the proponents in their preparation
of their submissions. The final few
pages of Table 1 list all of the material that is currently available on the
City web site http://ottawa.ca/lrt
. The list includes an indication
from the Fairness Commissioner as to the appropriateness of public release of
the information. The Fairness
Commissioner will attend the Council meeting of 22 February 2006, to elaborate
on the rationale for the retention or release of information.
Most of the information designated for public release as set out in Table 1 is not in bilingual format. To expedite viewing, PDF files of the material will be created and deposited in a web site that will be administered through Marshall Macklin Monaghan, the engineering consultant firm of record assisting the City of Ottawa during the procurement phase of the North-South Light Rail Transit project. A link to the data site will be established on the City web page to facilitate access to the information. The data site should be operational by 01 March 2006.
At the Council meeting of 8 February 2006, a Notice of Motion, (Document 3), was filed for consideration at a subsequent meeting. Both the Fairness Commissioner and Legal Counsel for the project have advised that they will be prepared to report fully on the matter at the next regularly scheduled Council meeting on 8 March 2006. It is noted that this meeting falls within the timeframe during which the submissions for the project will be under review, and therefore the report will offer Council timely advice for deciding appropriate actions pursuant to the items in the Notice of Motion.

BRIEFING - PROCUREMENT MANAGEMENT PROCESS – NORTH-SOUTH LIGHT RAIL TRANSIT PROJECT

WHEREAS City Council has approved the
procurement process for the North-South Light Rail Transit, P3 project under a
design, build, maintain model;
AND WHEREAS in August 2005, a Request for Proposal was issued by the
City of Ottawa;
AND WHEREAS in November 2005, Council was advised that three consortia
were formed following the Request for Qualifications;
AND WHEREAS in order for City Councillors to be accountable to the
public and to obtain information on the project prior to the award of the
contract, they must sign a “Confidentiality Declaration” prepared by the
Fairness Commissioner that prevents the public disclosure of a broad range of
important information, without limit in time;
AND WHEREAS the “Confidentiality Declaration” prohibits Councillors,
who are elected representatives of a publicly funded corporation, from having
access to non-proprietary information on the project without first signing the
declaration;
THEREFORE BE IT RESOLVED that the City of Ottawa Light Rapid Transit
Office be directed to provide all members of City Council with a complete
inventory of all information, reports, clarifications or documents that have
not been made public to date. The

WHEREAS
City Council has approved the procurement process for the North-South Light
Rail Transit, P3 project under a design, build, maintain model;
AND
WHEREAS in August 2005, a Request for Proposal was issued by the City of
Ottawa;
AND
WHEREAS in November 2005, Council was advised that three consortia were formed
following the Request for Qualifications;
AND
WHEREAS proposals are due back to the City on February 28, 2006 and findings of
the review teams will be reported to the Selection Panel in late March or early
April;
THEREFORE
BE IT RESOLVED that upon award of the contract by the City of Ottawa and
subject to the provisions of MFIPPA all information on the selected proposal
and the decision points that were made by City staff and proponents throughout
the process be released to the public;
AND BE
IT FURTHER RESOLVED that prior to City staff’s recommendation report to
Committee and Council on the selection of the preferred partner, but before any
further discussions have taken place, City staff provide Councillors with a
full briefing.
