That Council approve the acquisition in fee simple of the improved
residential lands together with a landlocked parcel of land and a limited
right-of-way along the driveway owned by Gary William Jasper and Sharon Anne
Jasper all described as Part of Lot 20, Broken Front Concession, Rideau Front,
formerly the City of Gloucester, now in the City of Ottawa. The lands to be
acquired in fee simple, including the landlocked lands, are shown as Parcel A
hatched on Annex “A” and Parcel B shows the hatched Limited Interest, all for
the consideration of $380,000.00, plus GST, made pursuant to Section 30 of the
Expropriations Act, R.S.O. 1990, cE26, as amended.

de cour appartenant à Gary William Jasper et à Sharon Anne

irrégulière, façade rivière Rideau, autrefois la ville de Gloucester,
maintenant la ville d’Ottawa. Les
terrains devant être acquis en fief simple, y compris les terrains enclavés,

REPORT RECOMMENDATION
That the Corporate

BACKGROUND
City Council, in the 2005 Capital Budget, approved funding for property acquisitions required for the construction of the North-South Corridor Light Rail Transit Project from the Rideau Centre to Woodroffe Avenue. The purpose of this report is to obtain City Council approval and authorization to purchase the lands required to facilitate this project.
The North-South Corridor Light
Rail Transit Project, including the construction of the Strandherd Bridge, will
require land from the property owned by Gary William Jasper and Sharon Ann
Jasper. Subsequent to the approval of
this project by City Council on 15 July 2005, (ACS-2005-PGM-ECO-0016) Real
Estate Services staff undertook negotiations with the property owners for the
acquisition of the property requirements.
Expropriation proceedings to acquire lands from this property commenced with Notice of Application for Approval to Expropriate Land, being served on the property owners by registered mail on 26 August 2005. The notices were published in the Ottawa Citizen and Le Droit on 26 August 2005, 2 September 2005 and 9 September 2005. The last date to request a hearing was 30 September 2005. The owners did not request a hearing.
Negotiations have resulted in an
Agreement pursuant to Section 30 of the Expropriations Act, R.S.O. 1990, cE26,
as amended, to acquire Parcel A in Fee Simple (including the landlocked lands)
containing 7510.3m2 together with the Limited Interest
(right-of-way) shown as hatched parcel B containing 677.4m2. These parcels are shown on attached Annex
“A”. These lands and a limited interest will be conveyed by the owners for the
consideration of $380,000.00 plus GST.
The market value for the land requirements together with the landlocked
lands and right-of-way were estimated by an independent appraisal consultant
commissioned by the City.
In accordance with the
Expropriations Act, this Agreement allows for arbitration to determine full and
final compensation by the Ontario Municipal Board in the event that a
negotiated settlement cannot be reached.
This approach allows the North-South Corridor Light Rail Transit Project
to proceed without delay while protecting the property owner’s rights provided
under the Expropriations Act to seek fair compensation in exchange for the
lands required.
This Offer of Compensation made
pursant to Section 30 of the Expropriations Act is recommended for approval.
CONSULTATION
Public consultation was part of the Environmental Assessment Report process and included public open houses and notices. The Ward Councillor has been made aware of this project including property acquisitions.
Environmental impacts were addressed in the Environmental Assessment undertaken for the Light Rail Transit Project as approved by City Council on 15 July 2005.
The
property acquisition approval requested through this report will help move
forward the North-South Light Rail Project to enhance the City's transit
system. This project is intended to
contribute to the City's goal of increased transit ridership of 30% modal share
by the year 2020, approved by Council in 2003.
In turn, greater transit ridership will reduce the number of single
occupancy vehicles on our roads and contribute to the City's goal, approved by
Council in 2005, to reduce community-generated greenhouse gases by 20% by the
year 2012, relative to 1990 greenhouse gas emissions.
FINANCIAL IMPLICATIONS
Failure to acquire the needed property in a timely manner will result in costs and penalties related to delays in construction.

be acquired in Fee Simple and the Limited Interests over the right-of -way to
River Road.
DISPOSITION
Following Council’s approval, Real Estate Asset Management and Legal Services Branches will finalize the documentation through outside Counsel.
