That the Agriculture and Rural Affairs Committee recommend that Council accept the petition and proceed with the drainage works by appointing Robinson Consultants Inc. as the Engineer of Record under Section 4 of the Drainage Act.

BACKGROUND

 

The City of Ottawa is in receipt of a petition for drainage works under Section 4 of the Drainage Act from a group of landowners in Goulbourn Ward who wish to change the status of the existing Arbuckle Award Ditch to that of a Municipal Drain.  The area requiring drainage is in the southwest quadrant of Perth Street and Fortune Street in the Village of Richmond, Lots 22 and 23, Concession 3, Goulbourn Ward.  Under Section 5(1) of the Drainage Act, Council must consider the petition and choose from one of three options:

 

1.         Accept the petition and proceed with the drainage works by appointing an Engineer under    Section 4 of the Drainage Act, to prepare a report; or,

 

2.         Appoint an Engineer to prepare a preliminary report in accordance with Section 10 of the Drainage Act; or,

 

3.         Reject the petition and not proceed with the drainage works.

 

It is the responsibility of the appointed Drainage Engineer to ultimately determine the area requiring drainage, and the validity of the petition.  However, in the opinion of the City Drainage Superintendent, the petition contains the necessary signatures to proceed with an Engineer's Report.  In addition, the watercourse is already an existing award ditch known as the Arbuckle Award Ditch.  In any case, written notice of Council's decision must be provided to each petitioner and the local conservation authority, who may appeal the decision of Council to the Ontario Drainage Tribunal, which may direct the municipality in such respects as the Tribunal considers proper.

 

ENVIRONMENTAL IMPLICATIONS

 

The Rideau Valley Conservation Authority has been notified in accordance with Section 5(1) of the Drainage Act.

 

RURAL IMPLICATIONS

 

The purpose of this undertaking is to address drainage concerns of rural landowners and to provide legal and sufficient outlet for their surface waters.

 

CONSULTATION

 

The Rideau Valley Conservation Authority has been notified in accordance with Section 5(1) of the Drainage Act.

 

FINANCIAL IMPLICATIONS

 

The cost of the Engineer's Report is to be paid initially by the City and then recovered in its entirety upon completion of the work from the benefiting landowners within the watershed of the drain according to the schedule of assessment prepared by the Drainage Engineer and contained in the Engineer's Report.  Funds have been approved in the 2005 Capital Budget and are available in Internal Order 902960.

DISPOSITION

 

The City Drainage Superintendent will notify the petitioners and the local conservation authority of the decision of Council as required under the Drainage Act.
