COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.                  Declare the property known legally as Minion Street, Registered Plan 19, being all of PIN 04352-0529 and North Street, Registered Plan 19, being all of PIN 04352-0530, containing approximately 2,352 m2 (0.58 ac.), in the City of Ottawa and shown hatched on Annex ‘A’ attached and indicated as Parcels 1 and 2, as surplus to the City’s needs;

 

2.                  Approve the sale of the property detailed in Recommendation 1, to Jean Yves Provost, for the amount of $11,896 plus GST, pursuant to an Agreement of Purchase and Sale that has been received.

BACKGROUND

 

In 1990 the City of Gloucester approved a resolution of the Planning Advisory Committee to close the unopened road allowances known as Minion Street and North Street on Registered Plan 19 and directed staff to initiate proceedings to close the road allowances.  Although the solicitor for the abutting owner (Jean Yves Provost) was advised of Council’s decision, the road closing and conveyance was never completed.

 

Mr. Provost recently made application for a building permit to renovate the residence and was unable to obtain a permit because of the fact that the house was situated partially on lands not under his ownership.  As a result, Mr. Provost approached the City to determine if he could still purchase the road allowances.

 

Confirmation has been received from the Legal Services Branch that the previous Council approval to close the road allowance is valid and the road allowances could be conveyed to Mr. Provost, providing Council approval was obtained to declare the lands surplus.

 

 

DISCUSSION

 

An agreement has been reached with the abutting owner, Jean Yves Provost to purchase the subject road allowances.  The property being conveyed is shown on the attached Annex “A” and is legally described as Minion Street, Registered Plan 19, being all of PIN 04352-0529 and North Street, Registered Plan 19, being all of PIN 04352-0530.

 

The zoning of the City property is Hre1 (Holding Residential Estate Zone 1). These road allowances are not travelled and currently form part of the purchaser’s property and are improved.  The purchase of the road allowances will clear up title and allow the purchaser to improve an existing residence located on a portion of Minion Street.  The use is consistent with the current zoning.  Rezoning is not being contemplated.

 

The sale price of the road allowances is $8,900 and is within the market value range established by an independent appraisal report.  The recommended sale price of $11,896.00 includes $2,996 for the cost of the City’s appraisal.

 

The offer is considered fair and reasonable and is recommended for acceptance.

 

 

CONSULTATION

 

In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning and Growth Management Services, to determine if the parcel should be retained for a City mandated program.  Consultation was also undertaken with the Planning and Growth Management Services, Environmental Management Group, with respect to the Greenspace Master Plan and their comments are indicated under the Environmental Implications section of this report.  Neither the Housing Branch nor any other City Department expressed interest in retaining the property. 

 

The utility companies were also circulated and no requirements were indicated.

 

The circulation of this property predated the implementation of the new circulation practices and only the Local Architectural Conservation Advisory Committee Co-ordinator was circulated. 

 

The ward Councillor has been made aware of the intent to dispose of the subject property and supports staff’s recommendation.

 

 

ENVIRONMENTAL IMPLICATIONS

 

The proposed sale of parcels along Minion and North Streets do not include any identified ecologically significant lands.  No environmental implications are anticipated through sale of these properties.  Any future development plans for the westerly portion of the Minion Street parcel, however, will need to incorporate appropriate setbacks from Bearbrook Creek, as specified in section 4.7.3 of the City's Official Plan, to prevent soil erosion and protect the surface water within the creek.

 

 

HOUSING FIRST POLICY

 

The Official Plan policy directs that the City make land available for affordable housing and give priority for the sale or lease of surplus City-owned property for this purpose. 

 

The Housing First Policy, approved by Council on 13 July 2005, establishes priority consideration to the Housing Branch in the identification of potentially surplus City-owned property to be used in achieving the City’s affordable housing program targets.  The policy requires that the Official Plan target of 25% affordable housing be met on any City-owned property sold for residential development. 

 

Where viable residential properties are disposed of without a condition requiring an affordable housing component, 25% of the proceeds from the sale are to be credited to a housing fund to be used for the development of affordable housing elsewhere in the City.

 

The subject property is in a residential estate zone, however it is non-viable and of use only to the abutting owner.  The property therefore does not meet the affordable housing criteria outlined in the Housing First Policy.

 

 

FINANCIAL IMPLICATIONS

 

This transaction represents revenue of $11,896 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.

Following Council’s approval, Real Property Asset Management and Legal Services Branches will finalize the transation.
