Committee recommendation
That Council approve an
amendment to the former Cumberland Zoning By-Law to change the zoning of a
portion of 5936 Rockdale Road from Agriculture (AGR) to Residential
Serviced-Three (RS3), as shown in Document 1.

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-Law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

zonage d’une partie du 5936, chemin Rockdale de zone agricole (AGR) à zone
résidentielle assortie d’une exception 3 (RS-3), comme il est indiqué dans le
document 1.
BACKGROUND
The subject lands are located on the south side of Devine Road in the Village of Vars. The land in question forms part of a larger property known as 5936 Rockdale Road. This larger property consists of lands within the village limits that are zoned RS3 as well as lands outside of the village that are zoned AGR. Through this Zoning By-law Amendment, a 367 m2 triangle of vacant land will be rezoned from AGR to RS3 and be brought within the village limit.
This Zoning By-law amendment has been initiated to realign the village residential zone boundary so that it coincides with the Official Plan’s Village designation boundary detailed in Volume 2C. The subject lands will be combined with lands already zoned RS3, so that two residential lots may be created on the south side of Devine Road.
DISCUSSION
City Council Approved Official Plan
According to the City Council Approved Official
Plan, the land being considered for rezoning is designated “Village”. It is the City’s intent to focus rural
growth within the Village boundaries to provide residents with better access to
community facilities and services. Another
intent is to centralize growth so as to maintain the open space character of
the rural area and minimize conflicts between residential uses and rural
businesses. Any land that falls under
the Village designation permits a wide range of housing types to meet the needs
of the Village’s population. The form
and scale of development will be limited by the available servicing methods.
Former Regional Official Plan Designation / Policies
According to the former Regional Official Plan the
subject land is designated “Village”.
This designation allows villages to be the focus of commercial,
residential and community activity.
Furthermore, the portion of land that is being considered for rezoning
supports the following Regional objectives for promoting healthy
communities: to permit development that
will be consistent with maintaining the rural character; to focus rural
development in the Village; to provide a choice of rural residential housing
types; and, to plan for development primarily on the basis of private,
individual services while allowing for municipal water services.
Cumberland Rural Official
Plan
According to the Cumberland Rural Official Plan, the subject land is
designated “Village Residential”. This
designation allows for single detached dwellings, low density multiples, open
space and conservation lands. In
addition the following complementary uses will also be permitted: schools,
churches and cemeteries, day nurseries and seniors and nursing homes.
Details of Proposed Zoning
The site is presently zoned "Agriculture"
(AGR). This type of zoning requires a
minimum lot area of 38 hectares for agricultural uses and a minimum of 2000 m2
for other uses such as residential.
Other uses, such as residential, must also have a minimum lot frontage
of 30.0 metres.
The
proposed zoning for this land is "Residential Serviced-Three" (RS3).
This zone permits single detached dwellings on lots with a minimum area of 2700
m2 and a minimum frontage of 33 metres.
Single detached dwellings in this zone are to be serviced by municipal
water and a private septic system.
This proposed zoning is appropriate for the subject
land. According to the City Council
Approved Official Plan, the former Regional Official Plan, and the Rural
Official Plan, the village limit follows a jog in Devine Road. A zone amendment will allow the zone
boundary to conform to the Official Plan by following the jog in Devine
Road. Staff
have determined that there is sufficient water capacity available to service an
addition of two RS3 zoned lots on the southwest edge of the Village of
Vars.
This rezoning will allow development to primarily concentrate within the Village boundary and will not disturb the rural character and fabric.
CONSULTATION
Notice of this application was carried out in
accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this
application and the staff recommendation.
The City did not receive any negative comments or opposition to this
application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-Law Amendment
applications.
