Committee recommendation

 

That Council approve an amendment to the former Township of Rideau Zoning By-Law to change the zoning of 6873 McCordick Road from RE-18 to a Special Estate Residential Zone (RE-XX) and 2625 Lockhead Road from RE-18 to a Special Estate Residential Zone (RE-YY) as shown in Document 1 and as detailed in Document 3.

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-Law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

BACKGROUND

 

The subject properties, 6873 McCordick Road and 2625 Lockhead Road, are located south of the Village of North Gower and east of Highway 416.

 

The site was approved for a severance by the Committee of Adjustment on May 12, 2005 to subdivide the property into two parcels. The retained parcel, located at 6873 McCordick Road, is a corner lot with an area of 1.28 hectares that contains an existing dwelling. The lot frontage is 57.45 metres along Lockhead Road. The severed parcel contains two hectares of undeveloped land and is located at 2625 Lockhead Road. The lot frontage is 83.55 metres along Lockhead Road. Both the subject properties are covered with tree and bush vegetation. The surrounding area is generally rural uses and farmland.

 

 

DISCUSSION

 

City Council Approved Official Plan

 

The City Council Approved Official Plan designates the site as Agricultural Resource Area on Schedule A, Rural Policy Plan. This designation ensures agricultural land is protected from loss to other uses and ensures uses, which would conflict with agricultural operations are not established in productive farming areas.

 

Former Regional Official Plan

 

The subject properties are designated as Agricultural Resource. The intent of this designation is to protect major areas of agricultural production and other lands suitable for agriculture from loss to other uses and ensure uses that would result in conflicts with agricultural operations are not established in productive farming areas. 

 

Former Township of Rideau Official Plan

 

The subject lands are designated as Agricultural Resource. Predominant uses of land shall be for agriculture and farm related uses. Other permitted uses include farm related residential uses, forestry, and conservation. The purpose of this designation is to preserve the agricultural resource base.

 

Proposed Zoning By-Law Amendment

 

The site is zoned as Estate Residential – Special Zone 18 (RE-18). As a condition imposed by the Committee of Adjustment, the Zoning By-law amendment proposes to remove the stable, paddock, and horse provisions for each property. For 6873 McCordick Road, the special zone would also recognize the minimum lot area of 1.28 hectares and set the minimum lot frontage to 57.45 metres. For 2625 Lockhead Road, the special zone would recognize the minimum lot area of two hectares; the property meets the minimum lot frontage provision of 60 metres for the Estate Residential Zone. The proposed rezoning would place each property in a Special Estate Residential Zone.

 

The severance application that went before the Committee of Adjustment on May 3, 2005 proposed two severances, creating three lots.  The decision of the Committee was to permit one severance and that the Zoning By-law be amended to set the minimum lot area and frontage for 6873 McCordick Road and the minimum lot area for 2625 Lockhead Road as well as removing the stable, paddock, and horse provisions on both properties that are permitted in the RE-18 zone. The stable, paddock, and horse provisions are recommended to be removed, as a hobby farm is not a permitted use in the RE-18 zone or in the RE zone. In the former Township of Rideau Official Plan, a hobby farm is permitted in lots that are minimum two hectares in area and located in Marginal Resource designations.

 

When deliberating on the application, the Committee of Adjustment took particular note of the fact that the subject properties were rezoned by the former municipality to the Estate Residential designation despite the existing Official Plan policies that applied at the time. It was of the Committee's view that the creation of two lots, which are heavily treed and contain an existing residential dwelling, will not result in the loss of agricultural lands. The Committee, therefore, imposed to rezone both lots to ensure the parameters are set on the lot size requirements.

 

The Department supports the Zoning By-law amendment as the Special Estate Residential Zones will establish the minimum lot area to the existing lot area of each property and therefore will prevent future severances. The amendment will satisfy the intent of the Official Plan policies.

 

 

RURAL IMPLICATIONS

 

The rezoning of the subject properties to the special zone designations will not negatively impact the surrounding land uses.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.

EXPLANATORY NOTE                                                                                                                

 

By-law Number 2006-XX amends Zoning By-law 2004-428 of the former Township of Rideau.  The amendment affects the property at 6873 McCordick Road and 2625 Lockhead Road, which are located on the north side of Lockhead Road and on the east side of McCordick Road, as shown on the attached Location Map.

 

The application is to rezone the 6873 McCordick Road from “RE-18” (Estate Residential – Special Zone 18) to a Special Estate Residential Zone (RE-XX) that removes the stable, paddock, and horse provisions and recognizes a minimum lot frontage of 57.45 metres and a minimum lot area of 1.28 hectares and to rezone 2625 Lockhead Road from “RE-18” (Estate Residential – Special Zone 18) to a Special Estate Residential Zone (RE-YY) that removes the stable, paddock, and horse provisions and recognizes a minimum lot area of 2 hectares. The rezoning of the subject properties to special zones will satisfy the zoning conditions subjected by the Committee of Adjustment.

                                                       i.        The minimum lot area will be 1.28 ha

                                                     ii.        The minimum lot frontage will be 57.45 m
