comme il est indiqué dans le document 1.
BACKGROUND
The Line Fences Act, R.S.O. 1990, c.L.17, provides a mechanism whereby a landowner who wishes to have a fence constructed to mark the boundary between his/her land and that of an adjoining owner or, where a fence already exists, to have it repaired or reconstructed, and who has not entered into a written cost sharing agreement with the adjoining owner, may arrange with the municipality to have fence-viewers view and arbitrate as to what portion of the fence each owner shall construct, reconstruct or repair and maintain. The Act also provides that the council of every local municipality shall, by by-law, appoint such number of fence-viewers as are required to carry out the provisions of the Act.
In order to give effect to the foregoing, Ottawa City Council enacted By-law 2004-293, which serves primarily to appoint fence-viewers and to facilitate the service to rural residents set out by the Line Fences Act. The provisions of the by-law apply to areas of the City zoned agricultural, general rural, rural-agricultural or marginal resource in the applicable zoning by-law.
Under By-law 2004-293 currently, three individuals are appointed as fence-viewers in accordance with the powers and procedures of the Line Fences Act: the Director of By-law Services; the Director of Building Services; and the Manager of Enforcement in By-law Services. In that a minimum of three fence-viewers are required to conduct an arbitration under the Act and, given that the availability of the aforementioned individuals is such that it can be difficult to accommodate requests for fence-viewing arbitrations, it is appropriate and necessary to appoint additional fence-viewers. It is therefore recommended that five (5) additional fence-viewers, as outlined in Document 1, are appointed under By-law 2004-293. The additional individuals have undergone the requisite training or have previous experience conducting the fence-viewing process.
RURAL IMPLICATIONS
The appointment of additional fence-viewers will facilitate the process and improve service to rural residents who are the main benefactors of the fence-viewer mechanism.
CONSULTATION
Given the administrative nature of the recommendation, no public consultation was undertaken.

There are no direct financial implications associated with the recommendation.

BY-LAW NO. 2006-
A by-law of the City of Ottawa to amend By-law No. 2004-293 to appoint additional fence-viewers.
The Council of the City of Ottawa enacts as follows:
1. Section 2(1) of By-law No. 2004-293 entitled “A by-law of the City of Ottawa respecting the appointment of fence-viewers” is amended by adding the following clauses:
(d) Todd Allinotte, By-law Services Coordinator;
(e) Patsy Curran, By-law Enforcement Officer, Level 3;
(f) Cathy McEwen, By-law Services Coordinator;
(g) Wayne McWilliams, By-law Enforcement Officer, Level 2;
(h) Lori Reith, By-law Enforcement Officer, Level 3.
