Committee recommendation

 

That Council approve an amendment to the former Township of Osgoode Zoning By-law to change the zoning of part of 2844 Yorks Corners Road to be known as 2818 and 2832 Yorks Corners Road from RU (Rural) to CE (Country Estate) and RU [xx] (Rural-Exception) as shown in Document 1 and detailed in Document 2.

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-Law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

Councillor A. Cullen dissented on the report recommendation.

BACKGROUND

 

The site subject to this application is part of the property at 2844 Yorks Corners Road.  The site is located on the west side of Yorks Corners Road, north of the Village of Kenmore and the Middle Castor River, and south of Victoria Street.  The subject site is 18 hectares in area and is currently vacant rural land, although an existing one-storey detached dwelling exists on the portion of 2844 Yorks Corners Road to the south that is not subject to this application.  The site is surrounded by predominantly low-intensity agricultural uses and undeveloped rural lands. 

 

Two parcels are proposed to be severed from the property at 2844 Yorks Corners Road, the severances having been conditionally approved by the Committee of Adjustment in August 2005. The purpose of this application is to permit one single-detached dwelling on each of two new parcels to be known as 2818 and 2832 Yorks Corners Road.  The parcel at 2832 Yorks Corners Road will be 17 hectares with 80m of frontage, while the parcel at 2818 Yorks Corners Road will be 1 hectare with 100 metres of frontage.  The retained land will be 48 hectares with 320 metres of frontage.  This application proposes to change the zoning on the parcel at 2818 Yorks Corners Road from RU (Rural) to CE (Country Estate) and change the zoning on the parcel at 2832 Yorks Corners Road from RU (Rural) to RU [xx] (Rural--Exception).  The existing RU (Rural) zone will remain on the retained lot. 

 

 

DISCUSSION

 

The site is designated as "General Rural" in the City Council Approved Official Plan and the former Regional Official Plan.  This designation permits uses that are appropriate for the rural area, including rural housing.  It permits limited residential provided it does not conflict with agricultural uses.  The surrounding low-intensity agriculture uses and undeveloped rural lands do not conflict with the proposed residential uses.  Furthermore, the large size of the proposed lots reduces the impact on the adjacent uses.  The proposed rezoning is compatible with the surrounding area, and conforms to the policies set forth in the City Council Approved and former Regional Official Plans regarding the General Rural Area. 

 

The western one-third of the proposed 17 hectare lot is designated as "Rural Natural Features" in the City Council Approved Official Plan.  This designation is intended to protect locally significant natural areas and tree cover.  This portion of the site will not be impacted by the proposed zoning and severance as the proposed single-detached dwellings will be adjacent to Yorks Corners Road on the eastern portion of the site. 

 

The site is designated "Marginal Resource" in the former Township of Osgoode Official Plan.  This designation delineates lands with low agricultural potential.  It permits a broad range of uses that are appropriate for the rural setting, including residential uses.  New uses will be carefully controlled to protect the rural character of the area.  The proposed rezoning to permit two detached dwellings is in character with the surrounding area, and is thus consistent with the policies in the former Township of Osgoode Official Plan.

 

The site is currently zoned as RU (Rural) in the former Township of Osgoode Zoning By-law.  This zone permits single detached dwellings on lots with a minimum lot area of 10 hectares and a minimum lot frontage of 182.8 metres.  There are two zones proposed for the site:  The CE (Country Estate) zone is proposed for the parcel at 2818 Yorks Corners Road that has a lot area of 1 hectare, while the RU [xx] (Rural--Exception) zone will be applied to the parcel at 2832 Yorks Corner Road.  The exception is required because this parcel has a proposed frontage of 80 metres, which is less than the conventional RU (Rural) zone requirements.  The proposed zones do not conflict with the surrounding zones in the area. 

 

The proposed use is in conformity with the policies in the Official Plans, in that it is in keeping with the general character of the surrounding rural area.  Staff support this Zoning By-law amendment because the proposed use conforms to the policies outlined within the relevant Official Plans.  

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
