COMMITTEE RECOMMENDATIONS

 

1.         That Council request that the Government of Ontario reconsider Section 2.3.4.1, Lot Creation & Lot Adjustments, of the Provincial Policy Statement 2005, which disallows and eliminates the creation of residential dwellings on any vacant remnant parcel of farmland created by the severance of a residence surplus to a farming operation as a result of farm consolidation, for bona fide farmers; and

 

2.         That this request be forwarded to the Honourable Minister of Municipal Affairs and Housing and the Honourable Minister of Agriculture and Food for the Province of Ontario as well as the Rural Ontario Municipal Association (ROMA), the Association of Municipalities of Ontario (AMO) and all Ottawa-area MPPs.

1.         Que le Conseil demande au gouvernement de l’Ontario de revoir la sous-section 2.3.4.1 – Création de lots et rajustements des lots de la Déclaration de principes provinciale de 2005, laquelle interdit l’établissement de tout nouveau logement destiné à des agriculteurs de bonne foi sur la parcelle de terre agricole vacante qui reste et résulte du morcellement d’une résidence excédentaire d’une exploitation agricole par suite du fusionnement d’exploitations agricoles; et

 

2.         Que cette demande soit transmise à l’honorable ministre des Affaires municipales et du Logement et à l’honorable ministre de l’Agriculture, de l’Alimentation et des Affaires rurales de l’Ontario ainsi qu’à la Rural Ontario Municipal Association (ROMA), à l’Association des municipalités de l’Ontario (AMO) et à tous les députés provinciaux de la région d'Ottawa.

1.         IL EST DÉCIDÉ QUE le Comité sur l'agriculture et les questions rurales recommandera au Conseil de demander au gouvernement de l’Ontario de revoir la sous-section 2.3.4.1 – Création de lots et rajustements des lots de la Déclaration de principes provinciale de 2005, laquelle interdit l’établissement de tout nouveau logement destiné à des agriculteurs de bonne foi sur la parcelle de terre agricole vacante qui reste et résulte du morcellement d’une résidence excédentaire d’une exploitation agricole par suite du fusionnement d’exploitations agricoles;

BACKGROUND

 

At its May 11, 2006 meeting, the Agriculture and Rural Affairs Committee considered and unanimously approved the above-noted motion, presented by Councillor G. Brooks.  


Provincial Policy Statement 2005:

Section 2.3.4.1 Lot Creation & Lot Adjustments

 

Moved by Councillor G. Brooks

 

That the Agriculture and Rural Affairs Committee approve the addition of this item for consideration by the Committee at today’s meeting, pursuant to Section 81(3) of the Procedure By-law (being By-law No. 2005-431).

Councillor Brooks introduced a motion to ask that the Province reconsider Section 2.3.4.1, Lot Creation & Lot Adjustments, of the Provincial Policy Statement 2005, which disallows and eliminates the creation of residential dwellings on any vacant remnant parcel of farmland created by the severance of a residence surplus to a farming operation as a result of farm consolidation, for bona fide farmers.  He indicated this matter related to an issue raised by two of his constituents at a previous ARAC meeting; Mr. G. Foster and Mr. M. Foster.  He explained that under the Provincial Policy Statement 2005, if a farmer bought another farm and there was a house on that property, he could sever off the parcel of land on which the house sat.  However, the remnant part of the land had to be rezoned so that no further dwellings could be constructed there.  He submitted that this was problematic for niche farmers such as the Fosters. 

 

Committee members expressed support for the motion and suggested that it be circulated to ROMA, AMO and all Ottawa-area MPPs.  Councillor Brooks amended the motion accordingly.

WHEREAS, the Province of Ontario legislates municipalities regarding planning and development through the issuance of Provincial Policy Statements;

 

AND WHEREAS, the rural areas, the farming community, and farmers are a critical part of the City of Ottawa’s geographical, cultural, social, and economic life;

 

AND WHEREAS, the City of Ottawa values the contribution of its rural residents and its farmers;

 

AND WHEREAS, the Province of Ontario, in 2005, issued its Provincial Policy Statement 2005, which now disallows and eliminates the creation of residential dwellings on any vacant remnant parcel of farmland created by the severance of a residence surplus to a farming operation as a result of farm consolidation;

 

AND WHEREAS, the creation of residential dwellings, for bona fide farmers, on any vacant remnant parcel of farmland created by the severance of a residence surplus to a farming operation as a result of farm consolidation are an essential component of the rural lifestyle;

 

AND WHEREAS, the City of Ottawa recognizes the importance of farming and agriculture in its 20/20 Official Plan;

 

THEREFORE, BE IT RESOLVED that the Agriculture and Rural Affairs Committee recommend Council request that the Government of Ontario reconsider Section 2.3.4.1, Lot Creation & Lot Adjustments, of the Provincial Policy Statement 2005, which disallows and eliminates the creation of residential dwellings on any vacant remnant parcel of farmland created by the severance of a residence surplus to a farming operation as a result of farm consolidation, for bona fide farmers;

 

BE IT FURTHER RESOLVED, that this request be forwarded to the Honourable Minister of Municipal Affairs and Housing and the Honourable Minister of Agriculture and Food for the Province of Ontario as well as the Rural Ontario Municipal Association (ROMA), the Association of Municipalities of Ontario (AMO) and all Ottawa-area MPPs.
