OF THE AUDITOR GENERAL - 2005 ANNUAL REPORT AND 2005 DETAILED AUDIT REPORTS

That
Council approve the 2005 Annual Report and 2005 Detailed Audits Reports of the
Office of the Auditor General as amended by the following:
1. That
a special committee be established which would include 4 Members of
Council and Senior Management Team to ensure implementation of Council
approved recommendations and that Councillors Glenn Brooks, Gord Hunter,
Jacques Legendre and Rick Chiarelli be appointed to that “special
committee.”
2. That
the City Solicitor and the City Clerk, in collaboration with the Auditor
General, bring forward to Council a report detailing options and/or
recommendations to clarify the reporting process for future years, and that
this report is presented to Council no later than December 31, 2006.
3. That
Recommendation 3 of the Auditor General’s Annual Report 2005, that “Supply
Management should ensure the total value of amendments to the scope of work of
any contact should not exceed 50% of the original contracted amount without the
approval of the Deputy City Managers” be accepted and implemented and
that an information report be forwarded to the appropriate Standing Committee;
and that staff reports to Council on the implementation of this recommendation
no later than September 2006.
4. That Recommendation 5 of the Auditor General’s Annual Report 2005, that “Supply Management ensure the pricing component in Requests for Proposals of professional services is immediately standardized at a minimum of 20%” be accepted and implemented, and that staff reports to Council on the implementation of this recommendation no later than September 2006.
5. That Recommendation 6 of the Auditor General’s Annual Report 2005,
that “Supply Management should ensure that a reasonable number of firms are
eventually awarded Standing Offers, using price as a significant component (a
minimum of 20%) in the evaluation process” be accepted and implemented,
and that staff reports to Council on the implementation of this recommendation
no later than September 2006.
6. That
Recommendation 17 of the Auditor General’s Annual Report 2005, that “Supply
Management should ensure that all purchasing activity (by type, more than
$25,000) is included in an annual report to Council, regardless of
the source of the information or the means of acquisition and be presented in a
clear and easily understood format” be accepted and implemented;
7. That Recommendation 19 of the Auditor General’s Annual Report 2005, that “Supply Management should ensure Payments without Reference to a Purchase Order (by type, more than $25,000) are adequately monitored and included in an annual report, in order to identify and include cases of non-compliance in regular reports to Council, and the City Manager, in order to minimize their occurrence” be accepted and implemented, and that staff reports to Council on the implementation of this recommendation no later than September 2006.
8. That the report on the comprehensive overtime review include complete information on overtime budgets and actual spending, including any adjustments that are recommended as a result of Council's direction, and that for the remainder of 2006, the Operating Status and Forecast Report provide City Council with a detailed accounting of compensation, including actual allocations for overtime, salary and benefits.
FOR THE INFORMATION OF
COUNCIL
The following Motions were referred as follows:
1. That
the following Motion be referred to the process outlined in Motion 2:
WHEREAS
the provisions of Subsection 11(1) of the by-law to establish the position and
duties of the Auditor General of the City of Ottawa state that the auditor
shall report to Council;
AND
WHEREAS following Subsection 11(1) of the by-law to establish the position and
duties of the Auditor General of the City of Ottawa and having the Auditor General’s
report submitted directly to Council would reassure residents that councillors
take addressing issues around waste is a top priority;
THEREFORE
BE IT RESOLVED THAT:
1. In
future years the Auditor General’s report be submitted to Council rather than
an individual committee of Council; and
2. That
the discussion of how to respond to the Auditor General’s report take place at
Council, through Committee of the Whole to enable the participation of public
delegations.
2. That
the following Motion 4 be referred to the “special committee” for further
deliberations with respect to the prioritization of the recommendations and how
they would be implemented and acted upon:
WHEREAS the Council of the City of Ottawa is morally obligated to
demonstrate transparency and accountability in all of its operations;
AND WHEREAS the Auditor General has delivered his first Annual
Report detailing recommendations to improve management practices and ensure tax
payers receive value for money;
AND WHEREAS the Auditor General recommends that
“That the Chief Corporate Planning and Performance Reporting Officer introduce
integrated risk management within the City, as part of the planning and
performance management cycle. This
would include such activities as:
development of an integrated risk
management policy;
development of tools and approaches for
risk management; and
provision of risk management training”;
AND WHEREAS this recommendation will significantly improve the
current procurement process and the accountability within the process;
THEREFORE BE IT RESOLVED that Recommendation 4 of the Auditor
General’s Annual Report 2005, “That the Chief Corporate Planning and
Performance Reporting Officer introduce integrated risk management within the
City, as part of the planning and performance management cycle. This would include such activities as:
development of an integrated risk
management policy;
development of tools and approaches for
risk management; and
provision of risk management training”
be
accepted and implemented;
AND BE IT FURTHER RESOLVED that staff reports to Council on the
implementation of this recommendation no later than September 2006.
3. That the
following portion of Motion 9 be referred to the “special committee”:

vérificateur général avec les modifications suivantes :
1. Qu’un comité spécial soit créé et qu’il
comprendrait quatre membres du Conseil et de l’Équipe de direction afin
de s’assurer de la mise en œuvre des recommandations
approuvées par le Conseil, et que les conseillers Glenn Brooks, Gord
Hunter, Jacques Legendre, et Rick
Chiarelli soient nommés pour faire partie de ce « comité
spécial ».
2. Que le chef du contentieux et le
greffier municipal, en collaboration avec la vérificateur général, soumettent
au Conseil un rapport qui expose en détail les options et/ou les
recommandations afin de préciser la procédure de présentation des rapports pour
les prochaines années; et que ce rapport soit présenté au Conseil le 31
décembre 2006 au plus tard.
3. Que
la Recommandation 3 du Rapport annuel 2005 du vérificateur général selon
laquelle « la gestion des approvisionnements doit s’assurer que la valeur
totale des modifications de la portée du travail d’un contrat n’excède pas la
moitié du montant initial de ce contrat sans l’autorisation d’un directeur
municipal adjoint » soit acceptée et mise en œuvre, et qu'un rapport
d'information soit présenté au comité permanent report compétent et que le
personnel soumette un rapport au Conseil relativement à la mise en œuvre de
cette recommandation au mois de septembre 2006 au plus tard.
4. Que
la recommandation 5 du Rapport annuel 2005 du vérificateur général selon
laquelle « la gestion des approvisionnements s’assure que la composante
prix dans les demandes de proposition des services professionnels est
immédiatement normalisée à un taux minimal de 20% » soit acceptée
et mise en œuvre, et que le personnel soumette un rapport au Conseil
relativement à la mise en œuvre de cette recommandation au mois de septembre
2006 au plus tard.
5. Que
la recommandation 6 du Rapport annuel 2005 du vérificateur général selon
laquelle « la gestion des approvisionnements doit veiller à ce qu’un
nombre raisonnable d’entreprises obtiennent des offres à commande et utiliser le
prix comme composante importante (un minimum de 20%) de la procédure
d’évaluation » soit acceptée et mise en œuvre, et que le personnel
soumette un rapport au Conseil relativement à la mise en œuvre de cette
recommandation au mois de septembre 2006 au plus tard.
6. Que
la recommandation 17 du rapport annuel de 2005 de le vérificateur général selon
laquelle « la gestion des approvisionnements doive veiller à inclure
toutes les activités d’achat (par type, de plus de 25 000 $)
dans un rapport annuel au Conseil, sans égard à la source de
renseignements ou à la méthode d’acquisition, et les présenter d’une manière
claire et simple à comprendre » soit acceptée et mise en œuvre, et que le
personnel soumette un rapport au Conseil relativement à la mise en œuvre de
cette recommandation au mois de septembre 2006 au plus tard.
8. Que le rapport portant sur l’étude
détaillée des heures supplémentaires comprenne l’information complète sur les
budgets des heures supplémentaires et les dépenses réelles, y compris tout
rajustement recommandé à la suite des directives du Conseil, et que pour le
reste de 2006, le Rapport d’étape et de prévision des dépenses de
fonctionnement fournisse au Conseil municipal une reddition de compte détaillée
de la rémunération, y compris la répartition réelle pour les heures
supplémentaires, le salaire et les avantages sociaux.
POUR LA GOUVERNE DU CONSEIL
Les motions suivantes ont fait
l'objet du renvoi indiquée :
1.
Que
la motion suivante soit renvoyée au le processus décrit dans la motion 2:
ATTENDU QUE le
paragraphe 11(1) du Règlement municipal créant le poste de vérificateur général de
la Ville d'Ottawa et définissant ses fonctions dispose que le vérificateur
général fait rapport au Conseil;
ATTENDU QUE la
présentation du rapport du vérificateur général directement au Conseil, conformément à l'esprit du paragraphe 11(1)
du Règlement municipal créant le poste de vérificateur général de la Ville
d'Ottawa et définissant ses fonctions, rassurerait les résidents quant à la
haute priorité que les conseillers accordent aux questions entourant le
gaspillage;
IL
EST PAR CONSÉQUENT RÉSOLU QUE :
1.
à
l'avenir, le rapport du vérificateur général sera présenté au Conseil plutôt
qu'à l'un des comités du Conseil;
2.
la
discussion sur la réponse à donner au rapport du vérificateur général aura lieu
au sein du Conseil réuni en comité plénier afin de permettre les interventions
des délégations du public.
2. Que la motion 4 ci-après soit
renvoyée au « comité spécial » pour discussion sur l'ordre de
priorité à accorder aux recommandations et sur la suite à leur donner :
ATTENDU
que le Conseil municipal d’Ottawa est moralement obligé de faire preuve de
transparence et de responsabilité dans toutes ses activités;
ET ATTENDU
que le vérificateur général a déposé son premier rapport annuel exposant en
détail les recommandations visant à améliorer les pratiques de gestion et à
s’assurer que les contribuables y trouvent leur compte;
ET ATTENDU que le vérificateur général recommande que « le chef de
la planification municipale et de la préparation des rapports de rendement
mette en place une gestion intégrée des risques dans la Ville, dans le cadre du
cycle de gestion du rendement et de la planification. Cette étape comprendrait
notamment les activités
suivantes :

l’élaboration d’une politique sur la gestion
intégrée des risques;
·
l’élaboration d’outils et démarches pour la gestion
des risques;
·
et l’offre d’une formation en gestion des
risques »;
ET ATTENDU
que cette recommandation améliorera considérablement le processus actuel des
approvisionnements et la responsabilité au sein du processus;
PAR CONSÉQUENT, IL A ÉTÉ RÉSOLU que la recommandation 4 du Rapport annuel
2005 du vérificateur général selon laquelle « le chef de la planification
municipale et de préparation des rapports de rendement mette en place une
gestion intégrée des risques dans la Ville, dans le cadre du cycle de gestion du rendement et de planification.
Cette étape comprendrait notamment les activités suivantes :

l’élaboration d’une politique sur la gestion
intégrée des risques;
·
l’élaboration d’outils et démarches pour la gestion
des risques;
·
et l’offre d’une formation en gestion des
risques »;
·
soit acceptée et mise en œuvre;
ET IL A
ÉTÉ RÉSOLU EN OUTRE que le personnel soumette un rapport au Conseil
relativement à la mise en œuvre de cette recommandation au mois de septembre
2006 au plus tard.
3. Que
la partie suivante de la motion 9 soit renvoyée au « comité
spécial » :
PAR CONSÉQUENT, IL A ÉTÉ RÉSOLU que
le Conseil demande au personnel de la Ville de produire une étude semestrielle
plus détaillée des budgets des immobilisations et de fonctionnement dès 2007

REPORT RECOMMENDATION
That the
Corporate Services and Economic Development Committee receive and refer to City
Council for consideration on May 10, 2006, the 2005 Annual Report and 2005 Detailed Audit Reports of the Office of
the Auditor General.
Que le Comité des services organisationnels et du développement
économique reçoit et réfère au Conseil municipal pour considération le 10 mai,
2006, le Rapport annuel 2005 et les Rapports de vérification détaillés 2005 du
Bureau du vérificateur général.
BACKGROUND
On December 15, 2004, Council approved The Office of the Auditor General – Statute and Mandate, By-Law and 2005-2007 Audit Plan report which outlined the audits to be conducted during 2005. All of these audits, as well as a number of additional projects, have been successfully completed. The attached reports present the results of all work undertaken during 2005.
DISCUSSION
In accordance with the By-Law governing the Office of Auditor General, these reports are to be provided to Council via the Corporate Services and Economic Development Commmittee. As such, the reports are being tabled today for transmittal by Committee to Council for its meeting of May 10, 2006.
The first Annual Report of the Office of the Auditor General (OAG)
of the City of Ottawa summarizes the activities of the OAG since its creation
in late 2004. Included is a summary of
the results of all audits completed during 2005 along with the management
responses to all recommendations. Also
included is the first Annual Report on the Fraud and Waste Hotline implemented
in November of last year.
A second document contains the full detailed reports for all audits
completed in 2005.
Part of the on-going work plan of the OAG will include a follow-up on audits conducted in the previous year. Follow-ups will be conducted in all areas where management has indicated its intention to implement recommended changes. In areas where management is in disagreement with the recommendations, the OAG will follow up on only those areas where Council has directed management to implement recommended changes. Follow-up on 2005 audits will be conducted after the first year of implementation of recommendations. It is intended that a separate report on these follow-ups will be provided to Council in 2007.
CONSULTATION
Consultation with management occurred throughout all audits, particularly in developing management responses to all recommendations.
FINANCIAL IMPLICATIONS
Any financial implications of the OAG’s recommendations are outlined in the management responses to specific recommendations.

DISPOSITION
The 2005 Annual Report and 2005 Detailed Audit
Reports of the Office of the Auditor General will be referred to Council for
consideration at the Council meeting of May 10, 2006.
The Office of the Auditor General will undertake to follow up on all
2005 recommendations where management has indicated its intention to implement
recommended changes or where Council directs management to implement
recommended changes.
