ALLOWANCE ADJACENT TO 1776 MAPLE GROVE ROAD

That Council:
1.
Declare a vacant
parcel of land shown on Annex “A” attached, containing approximately 0.299 ha,
being part of the road allowance adjacent to 1776 Maple Grove Road and
described as part of Lot 27, Concession 12, geographic Township of Goulbourn,
in the City of Ottawa, subject to final survey and subject to the road being
stopped up and closed by by-law, as surplus to the City’s needs;
2. Waive City policy regarding the sale of property at market value, and approve the sale of the lands described in Recommendation 1 to Mattamy Development Corporation for $1.00, plus GST, subject to any easements that may be required, pursuant to an Agreement of Purchase and Sale that has been received.

recommend that Council:

Maple Grove Road is a significant east-west corridor roughly halfway between Hazeldean Road and Highway 417. Mattamy Development Corporation (Mattamy) owns a 46 ha parcel of vacant land along the southerly limit of Maple Grove Road in the vicinity of its intersection with Huntmar Road. Mattamy is proposing a mixed residential development on its site, which is municipally identified as 1776 Maple Grove Road.
To accommodate this development, Mattamy made application to close a portion of Maple Grove Road, with a view to purchasing it from the City. The parcel in question is a strip of land along the southerly limit of Maple Grove Road, adjacent to the Mattamy holding, varying in width from 2.5 m to 5.6 m as shown on the attached Annex “A” sketch.
Mattamy’s application to close the portion of the road allowance was submitted to the Planning and Growth Management Department and was conditionally approved in January 2006.
DISCUSSION
In 2003, a severance application was submitted by the owners to separate the residential lands on Maple Grove, from the commercial lands on Hazeldean Road. As a condition of the severance, the City requested sufficient land be conveyed at no cost, to bring the Maple Grove roadway to a maximum width of 37.5m.
The ultimate configuration of Maple Grove was unknown at the time and as a result, the maximum width was requested. Recent studies recommend that Maple Grove Road will be less than the previously dedicated width of 37.5 m. If the ultimate configuration had been known in 2003, the owner would not have had to convey the land that is now considered surplus to road requirements and staff is therefore recommending that policy, with respect to market value, be waived in this case.
An agreement has been reached with Mattamy to purchase the closed portion of the road. The agreement is subject to the conditions of the road closing approval and any easements that may be required.
The zoning of the Mattamy property is R1 – 18 (Residential). The intended use of the subject property is to consolidate it with abutting lands owned by the purchaser. The purchaser proposes to develop its 46 ha site, with freehold single family and town home dwellings. The use is consistent with the current zoning, which was recently amended. Rezoning is not being contemplated.
ENVIRONMENTAL IMPLICATIONS
The closed portion of Maple
Grove Road proposed for sale, comprises an area designated as General Urban in
the City's Official Plan and does not involve any identified ecological
features. As a result, no environmental
impacts are expected with this property disposal. As well, this property is not part of the Greenspace Network
identified within the City's draft Greenspace Master Plan.
CONSULTATION
In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning and Growth Management Services, to determine if the parcel should be retained for a City mandated program. The Environmental Management Group of the Planning and Growth Management Services Department was consulted with respect to the Greenspace Master Plan and their comments are indicated under the Environmental Implications section of this report. Neither the Housing Branch nor any other City Department expressed interest in retaining the property.
The utility companies were also circulated and no requirements were indicated.

No concerns were expressed with respect to the sale of the subject property to the abutting owner.
The ward Councillor has been made aware of the intent to dispose of the subject property through circulation and supports staff’s recommendation.
The Official Plan policy directs that the City make land available for affordable housing and give priority for the sale or lease of surplus City-owned property for this purpose.
The Housing First Policy approved by Council on 13 July 2005, establishes priority consideration to the Housing Branch in the identification of potentially surplus City-owned property, to be used in achieving the City’s affordable housing program targets. The policy also requires that the Official Plan target of 25% affordable housing, be met on any City-owned property sold for residential development. Where viable residential properties are disposed of without a condition requiring an affordable housing component, 25% of the proceeds from the sale are to be credited to a housing fund, to be used for the development of affordable housing elsewhere in the City.
The subject is a non-viable property zoned R1 – 18 Residential. The property therefore does not meet the affordable housing criteria outlined in the Housing First Policy.
FINANCIAL IMPLICATIONS
This transaction represents revenue of $1.00 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.
