COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.                  Authorize the City to enter into a Front-Ending Agreement with Mattamy (Poole Creek) Ltd. for the design and construction of Huntmar Road from Hazeldean Road to Maple Grove Road, based on the principles set forth in Document 1, and the Council approved Front-Ending Policy in Document 2 with the final form and content of the Front-Ending Agreement being to the satisfaction of the Deputy City Manager, Planning and Growth Management and the City Solicitor.

 

2.                  Approve the payback of $6,000,000 in 2009 for the design and construction cost of Huntmar Road subject to the execution of the Front-Ending Agreement.

 

3.                  Subject to the execution of a Front-Ending Agreement in accordance with the Council–approved Front-Ending Policy, precommit $6,000,000 in the 2009 Capital Budget for Huntmar Road.

 

4.                  Approve that the City will not enter into the said Front-Ending Agreement and/or issue a Commence Work Order for the Huntmar Road construction until such time as all applicable Environmental Assessment Processes are complete.

BACKGROUND

 

In October 2000, the Region of Ottawa-Carleton adopted Regional Official Plan Amendment 9 (ROPA 9), which expanded the urban boundary by including an additional 724 hectares of land within the urban boundary, situated immediately west of Kanata. Subsequent to ROPA 9 being adopted, the City and the proponents undertook the preparation of the Kanata West Concept Plan (KWCP). In September 2002, Council approved the KWCP, including the passing of several resolutions, which established the framework for financial, environmental, land use, servicing and transportation strategies.

 

One of the key transportation links required for the successful implementation of the KWCP is the extension of Huntmar Road from Maple Grove Road and Hazeldean Road. As such, in 2004, the Huntmar Road extension was included as a project in the Development Charges By-law. This report addresses the financial strategies associated with Front Ending the Huntmar Road extension between Maple Grove Road and Hazeldean Road.

 

 

DISCUSSION

 

Within the KWCP lands, the owners of the lands established the Kanata West Owners Group (KWOG). On April 12, 2006, Council adopted Official Plan Amendment 39, which authenticated the KWOG as a landowners group in accordance with the provisions of the Official Plan. The City and the KWOG, as co-proponents, completed Phases 1 to 4 of the Municipal Class Environmental Assessment process, which included the completion of a Kanata West Transportation Master Plan. On May 24, 2006, Council authorized staff to proceed with the finalization of the Master Plan Environmental Assessment Report and Environmental Screening Report and approved the recommended projects as identified in the Kanata West Transportation Master Plan. The construction of Huntmar Road from Hazeldean Road to Maple Grove Road is one of the projects identified in the Master Plan.

 

In March 2006, Mattamy (Poole Creek) Ltd. received Draft Plan Approval and Zoning approval for a proposed 41.18 ha subdivision consisting of a mix of approximately 850 single detached and town home units, situated in the southeast and southwest quadrants of the KWCP.  One of the conditions of Draft Plan Approval required that Huntmar Road from Maple Grove Road to Hazeldean Road be constructed prior to the issuance of Building Permits. 

 

In order to facilitate the detailed design of the Huntmar Road extension, and in accordance with the Municipal Class Environmental Assessment process, as well as the KWCP, it was necessary to undertake a Schedule C Environmental Assessment Study Report. As such, the Kanata West Owners Group commissioned the preparation of an Environmental Study Report. At the time of the preparation of this report, the Notice of Completion was planned to be advertised for public review and input in accordance with the Class EA process on June 16, 2006. The final Environmental Study Report will also be available to the public at this time. Provided that there are no requests for Bump Ups to the Notice of Completion, Mattamy (Poole Creek) Ltd. intends to finalize the design of the Huntmar Road extension and proceed to construction in summer or early fall of 2006.

 

The Huntmar Road is a Development Charges funded project and is currently shown with funding being made available in 2009. As such, there is a need for Mattamy (Poole Creek) Ltd. to enter into a Front Ending Agreement with the City, in accordance with Council’s Front Ending Policy, subject to receiving Council approval and satisfactory completion of the Huntmar Road Extension Schedule C Municipal Class Environmental Assessment.

 

 

CONSULTATION

 

Mattamy (Poole Creek) Ltd. have agreed to participate as the Front-Ender in accordance with the principles set forth in Document 1 and Document 2.

 

 


FINANCIAL IMPLICATIONS

 

The estimated cost for the design and construction of the required Huntmar Road extension from Hazeldean Road to Maple Grove Road is $6,000,000. This is consistent with the Development Charges By-law estimate and will be funded 100% from Development Charges and Benefit to Existing dollars. Subject to Council approval, the Front-Enders would be paid back pursuant to the principles set out in Document 1 and the Council approved Front-Ending Policy as noted in Document 2.

 

The total estimated cost to be reimbursed to the Front-Ender in 2009 and the total estimated operational impact to the City is summarized in the following tables.

The Long Range Financial Plan forecasted the design and construction in 2009 of Huntmar Road from Hazeldean Road to Maple Grove Road with an estimated operational impact of $26,880/year beginning in 2010. The Operational Impact table summarizes the updated operational impact to the section of Huntmar Road from Hazeldean Road to Maple Grove to the City will be an additional $16,800/per year starting in 2007, for an overall potential tax increase of 0.002%

 

It should be noted that if approved by Corporate Services and Economic Development Committee and Council, this project would become a pre-commitment for 2009 as per Recommendation 3.

FRONT ENDING AGREEMENT PRINCIPLES                                                 DOCUMENT 1

 

 

1.      The Front-Ender shall be required to post a letter of credit or cash deposit equal to the estimated value of the Huntmar Road construction project to the satisfaction of the Deputy City Manager, Planning and Growth Management, and the City Solicitor.

 

2.      The contract for the design and construction shall be administered by the Front-Ender and shall be subject to approval by the City. The Front-Ender shall demonstrate to the satisfaction of the City that a minimum of three bids was obtained or that the Developer tendered the project. Provided that if the Front-Ender wishes to have a person or Corporation related to the Front-Ender considered for the contract to construct the works then the contract must be tendered by the Front-Ender. For the purpose of this principle “related person” shall have the meaning set out in Section 251 of the Income Tax Act and “ affiliated person” have the meaning set out in Section 251.1 of the Income Tax Act.

 

3.      The total City reimbursement cost of the Huntmar Road project is set at an upset limit of $6,000,000 plus indexing as listed in the City of Ottawa’s 2004 Development Charge Background Study, dated August 25, 2005. Should the cost exceed the upset limit, the additional cost shall be borne by the Front-Ender, and the City shall not be obligated to compensate the Front-Ender for additional cost.

 

4.      The repayment of the project costs for the Huntmar Road construction shall be pursuant to the Council approved Front-Ending Policy as referenced in Document 2.

 

5.      The Front-Enders will be entitled to receive indexing pursuant to conditions noted in Document 2.

 


POLICY FOR FRONT-ENDING AGREEMENTS

Front-ending agreements are requested by developers who wish to have specific growth-related capital works in place in advance of the City’s capital project plans for emplacement of these same works:  developers agree to finance the works at the “front end” and recover their costs from the City at a later date.  The following conditions must be met in order for the City to enter into a front-ending agreement:

 

  1. All front-ending agreements with the City will be for growth-related capital works that have been included in a development charge study. 

 

  1. Stormwater ponds and related sewer works that are 100% development charge funded in the recommended by-laws will be paid back to the developer based on revenues as they are collected from the designated area.  This means that at no time are the repayments to exceed the revenues received.  Each front-ending agreement will define the geographic area involved and a separate and specific deferred revenue account may be set up to keep track of the revenues collected and payments made.  Crediting will also be allowed for the front-ending agreements related to stormwater ponds. 

 

  1. For all other capital projects – A lump sum payment (both the development charge portion and the City portion) will be made to the developer in the year the project is identified in the City’s ten year capital plan at the time the front-ending agreement is approved.  Should growth occur earlier than forecasted, then repayment would be accelerated to reflect the revised timing the City would have budgeted for the project.  If growth occurs more slowly than forecasted, then the City will have an additional three years (three years from the year the project was identified in the ten year plan) to make repayments.  Only in this latter case will the City’s portion of the payment be indexed beginning with the year the project was identified in the ten-year plan. 

 

  1. The development charge portion that will be reimbursed will be indexed yearly in accordance with the rate of indexation pursuant to the development charge by-laws.  (City Council approved February 7, 2005)

 

  1. Given that the City will be assuming operating costs earlier than anticipated through the front-ending agreement process, the City is not to pay any carrying costs to the developer.

 

  1. All development charges payable by developers must be paid up front in accordance with the City’s by-law.  With the exception of the stormwater ponds and related sewer works, there will not be any crediting allowed as a result of entering into a front-ending agreement.  (On December 8, 2004, City Council approved, “That staff be directed to work with the industry to develop the details of a credit policy to be incorporated into the front-ending policy”.)

 

  1. In the case where a developer(s) has front-ended a project that at the discretion of the City benefits other developers, those developers who were not part of the front-ending agreement shall pay all of their development charges owed either at the time of registration of a plan of subdivision or upon the issuance of the first conditional building permit, whichever comes first.  (City Council approved July 14, 2004 Motion 16/5)

 

  1. A report to Council is required to authorize staff to enter into a front-ending agreement.  The recommendation will include the financial commitment of the City, specify the funding source(s), the project timeline and where necessary, request that a specific deferred revenue account be established.  The financial comment in the report will specify the timelines for the repayment, an operating budget impact and an estimate of the year in which the operating budget impact will begin.  It should also indicate the year in which the project was originally identified in the City’s ten-year capital plan.  A capital project will be established upon Council approval to enter into a front-ending agreement. The status of these projects will be provided to Council on a yearly basis.
