That Council:

 

1.      Declare a vacant parcel of land shown on Annex “A” attached, containing approximately 667.4 m2, being part of Lot 1, Concession 4, R.F., geographic Township of Gloucester, in the City of Ottawa and described as part 14 on Plan 5R-11934, as surplus to the City’s needs;

 

2.      Approve the sale of the land detailed in Recommendation 1, to Loblaws Properties Limited, for the amount of $125,000 plus GST, pursuant to an Agreement of Purchase and Sale that has been received.

BACKGROUND

 

The subject property is a narrow strip of land with approximately 7 m of frontage on St. Laurent Boulevard and a depth of 91.71 m, for a total area of 667.4 m2.  The City property is situated centrally in the assembled property owned by the purchaser.  It is legally described as Part of Lot 1, Concession 4, Rideau Front, geographic Township of Gloucester, being all of PIN #04741-0054. 

 

To accommodate its development, Loblaws Properties Limited approached staff in 2003 with a view to purchasing this property from the City.  The parcel in question is shown on the attached Annex “A” sketch.  As a result of rezoning and official plan amendment issues related to the property owned by Loblaws, a report dealing with the sale of the City’s property was not brought before Council at that time for approval of the sale.

 

The issues relating to re-zoning and the official plan amendment have been resolved.  City Council, at its meeting of 10 May 2006, passed a motion directing staff to commence the necessary process to have the 7 m strip declared surplus and sold to Loblaws at fair market value in accordance with an appraisal, with the report to be before Corporate Services and Economic Development Committee and Council at their July 2006 meeting.

 

 

DISCUSSION

 

An agreement has been reached with Loblaws Properties Limited to purchase the subject City property.

 

The zoning of the City property is IP F (1.0) – Industrial Park, however on 12 April 2006, the Ontario Municipal Board (OMB) approved rezoning to allow for the proposed development by the purchaser.  The intended use of the subject property is to consolidate it with abutting lands owned by the purchaser.  The purchaser proposes to develop its site with a grocery store and other retail uses.  The use is consistent with the zoning as approved by the OMB and further rezoning is not contemplated.

 

The recommended sale price of $125,000 is supported by an appraisal.  The offer is considered fair and reasonable and is recommended for acceptance.

 

 

ENVIRONMENTAL IMPLICATIONS

 

The narrow parcel of land at 2502 St. Laurent Boulevard proposed for disposal, consists of an area designated as Employment Area within the City's Official Plan.  This site does not involve any identified ecological features nor is it part of the Greenspace Network identified within the City's draft Greenspace Master Plan. 

 

 

CONSULTATION

 

In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning and Growth Management Services, to determine if the parcel should be retained for a City mandated program.  The Environmental Management Group of the Planning and Growth Management Services Department was consulted with respect to the Greenspace Master Plan and their comments are indicated under the Environmental Implications section of this report.  Neither the Housing Branch nor any other City Department expressed interest in retaining the property.

 

The utility companies were also circulated and no requirements were indicated.

 

The following Advisory Committees have been circulated:

Environmental Advisory Committee (EAC)

Parks and Recreation Advisory Committee (PRAC)

No concerns were expressed with respect to the sale of the subject property to the abutting owner.

 

The ward councillor is aware of the intent to sell the property to Loblaws and supports the staff recommendation.

 

 

HOUSING FIRST POLICY

 

The Official Plan policy directs that the City make land available for affordable housing and give priority for the sale or lease of surplus City-owned property for this purpose. 

 

The Housing First Policy approved by Council on 13 July 2005, establishes priority consideration to the Housing Branch in the identification of potentially surplus City-owned property, to be used in achieving the City’s affordable housing program targets.  The policy also requires that the Official Plan target of 25% affordable housing, be met on any City-owned property sold for residential development.  Where viable residential properties are disposed of without a condition requiring an affordable housing component, 25% of the proceeds from the sale are to be credited to a housing fund, to be used for the development of affordable housing elsewhere in the City.

 

The subject property is a non-viable property zoned IP F (1.0) Industrial.  The property therefore does not meet the affordable housing criteria outlined in the Housing First Policy.

 

 

FINANCIAL IMPLICATIONS

 

This transaction represents revenue of $125,000 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.

Following Council’s approval, Real Property Asset Management and Legal Services Branches will finalize the transaction.
