12. REIMBURSEMENT
OF DEVELOPMENT FEES AND CHARGES – PERLEY AND RIDEAU VETERANS’ HEALTH CENTRE -

That Council approve the following:
1. Exempt
the Perley and Rideau Veterans’ Health Centre from development charges as a
non-profit corporation under Section 7 (s) of Development Charges By-law
2004-298 for the construction of a 12-bedroom respite bungalow, known as the
‘Guest House’, for individuals affected by a dementia;
2. Reimburse the Perley and Rideau Veteran’s
Health Centre the paid planning application fees and building permit fees
amounting to $28,534.10 and reimburse the Centre an additional $58,948.40
should the development charges be paid prior to July 12, 2006 or exempt these
development charges should the permit not be ready for issuance prior to July
12, 2006.

montant additionnel de 58 948,40 $ si les redevances d'aménagement sont payées
avant le 12 juillet 2006, ou qu'il soit exonéré desdites redevances si le
permis n'est pas prêt à être délivré avant le 12 juillet 2006.

REPORT RECOMMENDATIONS
That the Corporate Services and
Economic Development Committee recommend that Council approve the following:
1. Exempt the Perley and Rideau Veterans’ Health Centre from development charges as a non-profit corporation under Section 7 (s) of Development Charges By-law 2004-298 for the construction of a 12-bedroom respite bungalow, known as the ‘Guest House’, for individuals affected by a dementia;
2. Reimburse the Perley and Rideau Veterans’ Health Centre the paid development charges, planning application fees, and building permit fees totalling $87,482.50 as set out in Document 2.

BACKGROUND
Under
Section 7 of the EXEMPTIONS of the Development Charges By-law 2004-298, adopted
by Council July 14, 2004, a non-profit corporation may be exempted from
development charges by specific resolution of Council.
The
Perley and Rideau Veterans’ Health Centre is a non-profit charitable
corporation first incorporated as the Perley Hospital in 1897. Currently incorporated as the Perley and
Rideau Veterans’ Health Centre (since 1999) it is a provider of long-term care
services to the community. It
accommodates 450 residents, with 250 designated beds for veterans.
The
Guest House is a project of the Perley and Rideau Veterans’ Health Centre, the
Victorian Order of Nurses Ottawa-Renfrew County Branch and the Alzheimer
Society of Ottawa and will provide short-stay respite care for those with a
dementia. The Guest House will provide
planned and emergency, short and longer term respite care for individuals
suffering with a dementia. The break
from caregiving responsibilities will enable caregivers to continue their
caregiving longer, delaying and/or avoiding more costly levels of care for
their loved one.
The
Ministry of Health and Long-Term Care approved the project for operational
funding in August 2005.
Staff
have reviewed the request and are satisfied it conforms to the eligibility
criteria for granting an exemption under the Development Charges By-law.
With
regards to the reimbursement of the planning application fees and the building
permit fees, Council may consider approval of the relief, on a case by case
basis, as it has done for the Ottawa hospitals since 2002.
CONSULTATION
The Perley and Rideau Veterans’ Health Centre has been consulted and a copy of this report has been forwarded to the Centre for review and information.
FINANCIAL IMPLICATIONS
The
$58,948.40 in development charges paid to the City will be reimbursed to the
Perley and Rideau Veterans’ Health Centre if this application is exempted from
the fee.
With
regards to the reimbursement of the planning application fees and building
permit fees, there is no current budget identified to fund the
reimbursements.
For
the planning application fees, the reimbursement of $8600.00 will result in the
reduction of total revenues which may impact on the 2006 year end
position.
For
the reimbursement of building permit fees amounting to $19,934.10, the Planning
and Growth Management, Building Services revenue account, Building Permit
Revenues can no longer be used to offset reimbursements as a result of the
enactment of the Building Code Statute Law Amendment Act, 2002 and Ontario
Regulation 305/03 July 1, 2005. The new
legislation requires that building permit fees be collected to only cost
recover the costs of servicing building permits and enforce the Building Code
Act and Code and be revenue neutral.
Thus, fees cannot be waived or reimbursed without creating a budget
pressure.
Subject to Council approval, a one time contribution in the amount of $19,934.10 is available from the City-Wide Capital Reserve Fund.

Councillor Hume noted he
was moving the following technical amendment with respect to Recommendation
2. He explained the report was written
on the assumption the building permit had already been obtained. The amending motion sets out that if the
Health Centre picks up the permit and pays the charges prior to Council
consideration on 12 July, the City would reimburse them these charges. If the permit is not ready by July 12, 2006,
the Centre would be exempted from paying the development charges.
In response to questions
from Mayor Chiarelli, Arlene Gregoire, Director, Building Services and Chief
Building Officer, explained the new Development Charges By-law provides for an
exemption (with Council approval), for hospitals and health care facilities.
Moved by Councillor P. Hume
WHEREAS
the Perley and Rideau Veteran’s Health Centre has applied for an exemption and
reimbursement of development related charges and had anticipated that the
permit would have been issued prior to the July 4, 2006 meeting of the
Corporate Services and Economic Development Committee:
AND
WHEREAS the Centre is required to pay $58,948.40 in development charges at the
time the building permit is issued but that as of this date, the building
permit has not been issued and thus the report Recommendation 2 may require an
amendment at the time of Council decision on July 12, 2006;
AND
WHEREAS the Centre is finalizing the submissions for the building permit and is
striving to obtain a permit prior to July 12, 2006;
THEREFORE
BE IT RESOLVED THAT Council approve an amendment to Recommendation 2, as
follows:
“Reimburse
the Perley and Rideau Veteran’s Health Centre the paid planning application
fees and building permit fees amounting to $28,534.10 and reimburse the Centre
an additional $58,948.40 should the development charges be paid prior to July
12, 2006 or exempt these development charges should the permit not be ready for
issuance prior to July 12, 2006.”
