That Council approve an amendment to the former Zoning By-law of the City of Kanata (Kanata South Business Park 135-93) to change the zoning of 80 Terence Matthews Crescent from an Industrial Zone (M1A) to an Industrial Exception Zone (M1A-xx) to permit an additional use as shown in Document 1 and detailed in Document 2.

BACKGROUND

 

The subject site is located at 80 Terence Matthews Crescent, on the northwest corner of Terence Matthews Crescent and Denzil Doyle Court.  An existing two storey building with both ground floor and second floor office components is situated on site.  A former restaurant use occupied a portion of the ground floor, which is now the subject of a conversion to a daycare facility.  Furthermore, a transmission tower is located in the northwest corner of the site. 

 

The existing parking area for the building can accommodate approximately 60 vehicles and is accessed by two driveways, one located off of Terence Matthews Crescent and the other from Denzil Doyle Court.

 

Adjacent land uses include various light industrial uses, including general office and wholesale establishments. 

 

 

DISCUSSION

 

The subject lands are designated "Enterprise Area" within the City Council Approved Official Plan.  This designation identifies areas where commercial, office and industry are the primary land uses.  However, the Enterprise Area also serves a number of other functions including complementary non-industrial uses in order to meet the daily needs of employees and clients and to reduce their need to travel outside the area. 

 

The former Regional Official Plan designates the subject property as "Business Park".  This designation includes industrial and business parks, research parks, warehousing and manufacturing areas, and other related non-residential uses.  The Business Park designation permits a mix of land uses that provides basic goods and services to employees of the park. 

 

The former City of Kanata Official Plan designates the subject property as "Restricted Industrial", which is intended to serve as the major employment area of the City, and permits a range of light industrial uses.

 

The Zoning By-Law of the former City of Kanata, Kanata South Business Park (135-93), zones this parcel of land 'Industrial' (M1A).  The M1A zone permits such uses as, but not exclusive to, light industrial, light assembly, light manufacturing, general offices, wholesale establishments and restaurant uses.  The applicant wishes to rezone the property to add a day nursery to the M1A zone, while maintaining the current permissible uses. 

 

The proposed zoning is appropriate because the additional use (day nursery) conforms to both the policies of the Enterprise Area designation within the City Council Approved Official Plan, and the Business Park designation within the former Regional Official Plan.  These policies permit complementary uses intended to meet the daily needs of employees and clients within employment lands.  A day nursery within the Kanata South Business Park will be compatible with adjacent commercial, office and light industrial uses, considering the opportunity for employees to work close to their children at a nearby day nursery. 

 

A demonstration plan has been submitted to illustrate how the site can accommodate an outdoor play area as required by the Day Nursery Act.  Furthermore the parking requirements for a day nursery can be accommodated on site (four parking spaces for each classroom), where eight spaces are required.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
