That Council approve that Provision 3(2) of the
Encroachment By-law 2003-446 be waived to permit the installation of a pedestal
clock, within the road allowance adjacent to 303 and 307 Richmond Road subject
to the following conditions:
1. That,
the Rotary Club agrees to retain a bonded contractor to obtain a Road Cut
Permit prior to commencing work in accordance with Section 2 of the Road
Activity By-law 2003-445.
2. That,
upon the completion of the clock installation the Rotary Club agrees to enter
into a Permanent Encroachment Agreement for the clock and to pay associated
annual fees as outlined in Schedule “A” of the Encroachment By-law 2003-446.
3. That, upon the completion of the clock
installation the Rotary Club provide as-built drawings to illustrate location,
elevations and material type of structures above and below grade.
4. That, the Rotary Club also provide the
name, emergency telephone number, fax number and e-mail address of the contact
for locate information for the electrical supply line in the event that
emergency works are required in the City’s right-of-way.

Que le Conseil approuve une dérogation à la
disposition 3(2) du règlement municipal sur l’empiétement 2003-446 afin de
permettre l’installation d’une horloge sur pied à l’intérieur de l’emprise de
route adjacente aux 303 et 307 du chemin Richmond, sous réserve des conditions
suivantes :
1. Que le Club Rotary convienne de retenir
les services d’un entrepreneur cautionné pour obtenir le permis de voirie
requis avant d’entreprendre les travaux, conformément à l’article 2 du
règlement municipal sur l’activité routière 2003-445.
2. Que, dès la fin des travaux
d’installation de l’horloge, le Club Rotary convienne de conclure une entente
permanente d’empiétement visant cette horloge et de payer les frais annuels
connexes tels que décrits dans l’annexe A du règlement municipal sur
l’empiétement 2003-446.
3. Que,
dès la fin des travaux d’installation de l’horloge, le Club Rotary fournisse
les croquis conformes à l’exécution, illustrant l’emplacement, les façades et
les structures matérielles sous terre et en surface.
4. Que
le Club Rotary fournisse aussi le nom de la personne-ressource désignée, ainsi
que son numéro de téléphone d’urgence, son numéro de télécopieur et son adresse
électronique en vue de déterminer l’emplacement de l’alimentation électrique si
la Ville doit effectuer des travaux urgents à l’intérieur de l’emprise de
route.

At its meeting of 21 June 2006, the Transportation Committee approved the following motion brought forth by Councillor El-Chantiry on behalf of Councillor Little:
WHEREAS Provision 3(2) of the
Encroachment By-law 2003-446, states that, “no person shall erect a permanent
surface encroachment”;
AND WHEREAS the Rotary Club of
West Ottawa has proposed to install a pedestal style clock to commemorate its
50th Anniversary of Community and International Service on the road
allowance adjacent to 307 and 303 Richmond Road;
AND WHEREAS the Rotary Club has
solicited and received support from the local Ward Councillor, Westboro Community
Association, the Westboro Business Improvement Area, the Administrator of the
Westboro Baptist Church located at 307 Richmond Road and the proprietors of the
Widdicombs of Westboro building located at 303 Richmond Road;
AND WHEREAS the proposed clock will allow for a minimum unencumbered sidewalk
width of 2.5 metres and will be separated by a minimum of 1.5 metres from the
nearest limit of the roadway.
BE IT THEREFORE RESOLVED that
Provision 3(2) of the Encroachment By-law 2003-446 be waived to permit the
installation of a pedestal clock, within the road allowance adjacent to 303 and
307 Richmond Road subject to the following conditions:
1. That, the Rotary Club agrees to retain a
bonded contractor to obtain a Road Cut Permit prior to commencing work in
accordance with Section 2 of the Road Activity By-law 2003-445.
2. That,
upon the completion of the clock installation the Rotary Club agrees to enter

CONSULTATION
In consultation with staff in Public Works and Services, the following comments have been provided:
Staff of the Traffic and Parking
Operations Branch, Department of Public Works and Services, have reviewed this
report and advise that they have no concerns with the installation of the
pedestal-style clock on the City right-of-way.
FINANCIAL
IMPLICATIONS
The Rotary Club will be responsible for the installation and maintenance of the clock and structure. An agreement for the permanent encroachment will be entered into by the Rotary Club with the City which will include payment of annual encroachment fees.
Upon approval of the recommendation contained in this report, staff of the Traffic and Parking Operations Branch, Department of Public Works and Services, will inform the applicant and initiate the preparation of a Permanent Encroachment Agreement.
