COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.         Approve the application to remove 6691 Rideau Valley Drive South, Kars Loyal Orange Lodge No. 35 and relocate it to Upper Canada Village; and

 

2.         Approve the repeal of designation By-law 50-98 of the former Corporation of the Township of Rideau.

 

(Note:  Approval of this application under the Ontario Heritage Act must not be construed to meet the requirements for the issuance of a building permit.)

That the Local Architectural Conservation Advisory Committee recommend that the Agriculture and Rural Affairs Committee recommend Council:

 

1.         Approve the application to remove 6691 Rideau Valley Drive South, Kars Loyal Orange Lodge No. 35 and relocate it to Upper Canada Village; and

 

2.         Approve the repeal of designation By-law 50-98 of the former Corporation of the Township of Rideau.

Local Architectural Conservation Advisory Committee Recommendation : 9 November 2006

 

LACAC unanimously supported the departmental recommendation.

 

BACKGROUND

 

The Masonic Association of Eastern District applied to the City of Ottawa on September 18, 2006 to remove the former Kars Loyal Orange Hall No. 35 and relocate it to Upper Canada Village. A location plan is included as Document 1. This property was designated in August 1998 under Part IV of the Ontario Heritage Act by the former Corporation of the Township of Rideau through By-law No. 50/98. The Statement of Reason for designation is included as Document 2 and a Heritage Survey Form is included as Document 3.

 

Section 4.6.1.1 of the Official Plan states that :

 

"Where a structure designated under the Ontario Heritage Act is to be altered, partially demolished, demolished or relocated, the approval of City Council, after consultation with its Local Architectural Conservation Advisory Committee (LACAC) is required. The City will require that a cultural heritage impact statement be conducted by a qualified professional with expertise in cultural heritage resources.."

 

Section 4.6.1.3 further states that :

 

"Where relocation is proposed of a structure designated under the Ontario Heritage Act, the City will require that the cultural heritage impact statement demonstrate that relocation is the only way to conserve the resource. The City may consider the option provided that :

 

a)    The building is retained on site, but moved to another part of the property for integration into the new development, or, if that is not possible ;

 

b)    The building is relocated to a site appropriate to its cultural heritage value outside the proposed development or property."

 

A cultural heritage impact statement was prepared by Fern Mackenzie who is a qualified heritage professional and was also on the Rideau LACAC at the time of the heritage designation of this building. That statement is included as Document 4.

 

DISCUSSION

 

Recommendation 1.

 

This project, if approved, would result in the removal of a designated heritage building in the Village of Kars in the City of Ottawa. This loss would be offset by the restoration of the building as part of Upper Canada Village and the commemoration of the lodge site in Kars. All costs associated with the relocation, restoration and commemoration of the building would be born by the Masonic Order of Eastern District. In consideration of this, the City would dispose of the building to the Masonic Order of Eastern District for $1.

 

Recommendation 2 :

 

Section 34.3 of the Ontario Heritage Act requires that the City pass a By-law to repeal the designation By-law following its consent to remove a building or structure.

 

CONSULTATION

 

Councillor Glenn Brooks held a public meeting on September 27, 2005 in Kars to discuss this proposal. Residents of Kars living near the Orange Hall, past members of the Rideau Township Local Architectural Conservation Advisory Committee (LACAC), a representative of Heritage Ottawa, a representative of the Heritage Canada Foundation, staff from the Planning and Growth Management Department (Heritage Section) and Corporate Services Department (Real Estate Services and Cultural Services) were in attendance. Approximately 30 people in total were in attendance. There was unanimous support from residents of the community for the relocation of the building to Upper Canada Village as a means of ensuring the long-term preservation and interpretation of the building.

 

Adjacent property owners were notified by letter of the date of the Local Architectural Conservation Advisory Committee (LACAC) and Agriculture and Rural Affairs Committee (ARAC) meetings and were invited to provide written comments to be returned to LACAC or to appear in person at the LACAC and/or ARAC meetings to comment on the proposal. This is in accordance with the City's notification policies.

 

A letter of support for the relocation from Coral Lindsay, President of the Women's Institute of Ontario, Kars Branch is included as Document 5 of this report.

 

Councillor Glenn Brooks supports the relocation of this building to Upper Canada Village.

 

FINANCIAL IMPLICATIONS

 

Costs associated with the relocation and restoration of this building will be assumed by the Masonic Association of Eastern District.

Legal Services to prepare a By-law repealing heritage designation By-law 50/98 of the former Corporation of the Township of Rideau and submit it to Council for approval.

 

Legal Services to provide a copy of the repealing By-law to the Ontario Heritage Trust and register it on title.

 

Planning and Growth Management Department to publish notice of the repealing By-law in the newspaper.
