That Council approve an amendment to the former City of Gloucester Zoning By-law to change the zoning of 3515 Albion Road from Commercial Highway Zone (Ch) to Commercial Highway Exception Zone (Ch-XX) as detailed in Document 2, and that no exterior storage be permitted on the site.

BACKGROUND

 

The subject property is located on the northeast corner of Bank Street and Albion Road.  The property is 1372 m2 with 28 metres of frontage on Bank Street and 45.6 metres of frontage on Albion Road. 

The site is part of a commercial strip that runs along Bank Street.  To the east is a car dealership and there is a mix of commercial activities located in plazas and free standing buildings to the south and west.  To the north is a single residential house.

 

The existing building has been used, until recently, as a gas station, garage and takeout pizza restaurant.  The gasoline pumps have been closed and the building is now used for a truck rental operation.  The restaurant is no longer open.  The applicant intends to retain the rental operation and to open part of the building as a retail butcher shop.  The Commercial Highway Zone does not permit general retail uses and therefore, the Zoning By-law amendment is required.

 

 

DISCUSSION

 

The site is designated General Urban Area and Arterial Main Street in the Official Plan as a result of Amendment 28, which was approved by City Council in July 2005.  Arterial Main Streets permit a broad range of uses including retail, which may be mixed in an individual building or occur side by side in separate buildings.  The requested Zoning By-law amendment conforms to these Official Plan policies.

 

Details of the Amendment 

 

The property is zoned Commercial Highway Zone (Ch) in former City of Gloucester By-law.  The intent of this zone is to provide services which are automotive oriented to the travelling public.  This zone does not permit retail uses.

 

The intent of the proposed Zoning By-law amendment is to create an exception zone that would permit retail on this property in order to allow for a retail butcher shop to be established.  The building has approximately 269 m2 of area and will require 14 parking spaces.  The site provides 15 parking spaces now and can be reconfigured to provide more once the pumps are removed.

 

The Owner has been made aware that removal of the gasoline pumps and tanks will require a Letter of Permanent Closure from the Technical Standards and Safety Authority to verify that all the proper procedures are followed and that the site is remediated properly.

 

Permitting retail uses on this property is consistent with the policies of the Official Plan by creating a mix of non-conflicting uses along a Main Street corridor and staff recommend approval of this application.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
