BACKGROUND
The building located at 368
Dalhousie Street (see Document 1) is within the boundaries of the ByWard Market
Heritage Conservation District, designated under Part V of the Ontario
Heritage Act. This Report has been
prepared because the consent of City Council is required before an alteration
to a building within a heritage conservation district can proceed.
The building located at 368 Dalhousie Street is a four-storey commercial building that was constructed in 1929 (see Document 2). It is clad in marble and has decorative metal work above the storefronts and at the roofline. The storefronts have been reworked and there are replacement windows and doors.
The applicant is proposing the construction of an addition to an existing penthouse to increase the floor area from 218 square meters to 346 square meters. The addition would be located on the north part of the property facing George Street and would project 2.69 meters above the height of the existing cornice (see Document 4).
The Official Plan, Section 4.6.1.1, requires that a Cultural Heritage Impact Statement be prepared when a proposed development is within a heritage conservation district. Please refer to Document 3 – Cultural Heritage Impact Statement, prepared by the applicant.
An application to the Committee of Adjustment for relief from the provisions of the Heritage Overlay (to allow an increase in building height of 2.12 m above the existing dwelling unit roof line) will be submitted following approval of this project under the Ontario Heritage Act.
DISCUSSION
Residential guidelines for infill development in the ByWard Market Heritage Conservation District Study recommend that, “The infill in areas zoned residential or mixed use must respect the heritage character of the area as a whole as well as the more immediate environment,” and, “The building form should respect the massing of adjacent heritage properties. Materials and detailing should reflect contemporary taste and availability, controlled only by the requirements to respect and reinforce the character of what exists.”
Commercial and Mixed Use guidelines for infill development recommend, “Infill in commercial areas must respect the scale and character of existing heritage properties and streetscapes.”
The Department supports this application because the proposed penthouse addition will not dominate the original building. The addition will be set back 1.2 meters from the outside edge of the building cornice, with a deeper setback at the northwest and north east corners, in order to respect the prominence of the original building. The penthouse will be clad in glass panels, giving it a light appearance while allowing the existing heavy cornice to remain visually prominent. The introduction of a horizontal canopy on the penthouse addition will echo the horizontality of the existing building cornice. As recommended by the guidelines, the applicant proposes the use of contemporary materials and an architectural form that respects the character of the original building.
CONSULTATION
Adjacent property owners were notified by letter of the date of the Local Architectural Conservation Advisory Committee (LACAC) and Planning and Environment Committee meetings and were provided with comment sheets to be returned to LACAC. This is in accordance with current public participation policies.
The Ward Councillor, Heritage Ottawa and the ByWard Market Business Improvement Area are aware of the application.

DISPOSITION
The Corporate Services Department, Council and Committee Services Branch, to notify the applicant (Michael Kelly, Barry Padolsky Assoc. Inc. The Committee received a letter dated March 22, 2007 from Ms. Peggy Ducharme, Executive Director, Downtown Rideau Board of Management, expressing the support of the Downtown Rideau Business Improvement Area for this project. Ms. Ducharme states that the proposed expansion is respectful of the heritage context of the neighbourhood and that of the existing building, and that the BIA is encouraged to see that a number of residential development are taking place in the downtown Rideau area. A copy of Ms. Ducharme’s letter is held on file with the City Clerk.
