BACKGROUND
The 0.16-hectare site is located
at the northwest quadrant of the intersection of Jockvale Road, Prince of Wales
Drive and Rideau Valley Drive, to the south of the Urban Area Boundary. Surrounding uses include: Stonebridge Golf and Country Club and its
corresponding subdivision to the west, residential area to the north,
conservation area and a proposed new office building to the east, and rural
area to the south.
There is a single storey home on site. The
residential property is currently operated as a private day nursery for less
than five children.
The existing zoning for the site is RU – Rural Agricultural Zone, which permits single detached homes and rural agricultural uses.
The applicant proposes to amend the Zoning By-law to permit a day nursery accommodating 14 children.
DISCUSSION
Official Plan
The Official Plan designates the site as General Rural Area. This designation permits the development of a variety of land uses that are appropriate for a rural location where such development will not preclude continued agricultural uses and must be in keeping with the surrounding rural character and landscape. The policies in the Official Plan for building liveable communities require community-servicing uses such as day nurseries be provided in a reasonable commute distance in order to improve the liveability of communities.
The subject site is currently used for and surrounded by non-agricultural uses, hence adding a day nursery will not preclude any continued agricultural uses. The proposed development will retain the existing building and landscaping and will not alter the rural character of the site and surrounding area. Being close to the fast growing Barrhaven and Stonebridge Communities, the proposed day nursery will address the local demand for preschools and therefore contribute to the liveability of the community. The proposed development conforms to the Official Plan policies for General Rural Area and liveable communities.
Zoning By-law
The site is zoned as Rural
Agricultural in the former City of Nepean Rural Area Zoning By-law, which
permits a range of uses suitable for the rural area, such as agricultural, single detached
dwelling, home occupation and bed and breakfast establishment.
The proposed zoning will allow a day
nursery as an additional use, which will maintain the low-intensity character
of the site. Impacts on the surrounding
uses are very limited. The proposed use
is compatible with other uses permitted in the existing Rural Agricultural
Zone.
Traffic Issues
Traffic safety has been a major
concern for the proposed development.
The site is fronting onto two arterial roads, Jockvale Road and Prince
of Wales Drive. Car access to the site is provided from Jockvale Road. A Transportation Brief was required to
address the traffic concerns.
Recommendations from the study include: (1) establish a physical barrier
along Jockvale Road to permit only “right-in, right-out” car movements at the access;
(2) provide and maintain a 5.5‑metre-wide paved surface entrance; (3)
provide paved parking spaces outside of the sight line requirements; (4)
provide and maintain appropriate sight lines along the frontage by removing
existing shrubbery and signage, and re-grading the berm if necessary. Implementation of related works will be dealt
through the associated site plan control.
Conclusion
Staff recommend approval of this application to
amend the Zoning By-law as it is in conformity with the policies of the General
Rural Area. The proposed use is compatible with surrounding uses. Potential traffic safety issues will be
mitigated through the site modification requirements.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. Comments were received from the public. These comments are summarized in Document 3.
FINANCIAL IMPLICATIONS
The application was not processed by the "On
Time Decision Date" established for the processing of Zoning By-law
amendments due to the complexity of the issues associated with traffic and
access safety.

NOTIFICATION AND CONSULTATION PROCESS
Notification and public consultation
was undertaken in accordance with the Public Notification and Public
Consultation Policy approved by City Council for Zoning By-law amendments.
SUMMARY OF PUBLIC INPUT
Concerns have been received from the
public through emails and phone calls regarding the access safety of the
proposed use. Quite a few frequent
users of Jockvale Road commented that cars turning left into the site would
have to stop in the middle of the lane to allow oncoming traffic to pass before
turning into the daycare and other cars coming from behind on the slope could
face serious trouble trying to stop, especially in winters, because there is a
steep curve downhill. The public
expressed that this was a serious issue since there would be children onboard
the turning cars and it would invite accidents.
The City will require site modification works through a site plan control process in order to prevent left-turns into the site and to provide a better sight view and smooth car movement at the entrance.
