That
Council approve:
WHEREAS the Municipal Act, 2001
prior to January 1, 2007 provided that a licensing by-law of a municipality
expired five years after it came into force;
AND WHEREAS Section 11 of Ontario
Regulation 540/00 made pursuant to the City of Ottawa Act, 1999
extended the expiration date of licensing by-laws of the former municipalities
in the amalgamated City of Ottawa until the later of five years after the
by-law came into force or January 1, 2008 to assist the City to complete the
by-law harmonization process;
AND WHEREAS the amendments to the Municipal
Act, 2001 that came into effect on January 1, 2007 through Bill 130 have
removed the five-year expiration provision from the general licensing
provisions applicable to all municipalities;
AND WHEREAS it is considered
necessary to have Section 11 of Ontario Regulation 540/00 repealed to avoid any
ambiguity with respect to the status of any of the former municipalities’
licensing by-laws should they not be harmonized by January 1, 2008;
THEREFORE
BE IT RESOLVED THAT the City Solicitor be authorized to contact officials in
the Ministry of Municipal Affairs to request that Section 11 of Ontario
Regulation 540/00 be repealed.

ATTENDU QUE la Loi de 2001 sur les
municipalités stipulait, avant le 1er janvier 2007, que le
règlement sur les permis d'une municipalité devait expirer cinq ans après son
entrée en vigueur;
ATTENDU QUE l’article 11 du Règlement de l’Ontario 540/00, rédigé
conformément à la Loi de 1999 sur la ville d’Ottawa, prolonge la date
d’expiration des règlements sur les permis des anciennes municipalités ayant
formé la Ville d’Ottawa fusionnée jusqu’à la fin de la période de cinq ans
suivant l’entrée en vigueur du règlement ou jusqu’au 1er janvier
2008, la plus tardive des dates prévalant, afin d’aider la Ville à terminer le
processus d’harmonisation des règlements municipaux;
ATTENDU QUE les modifications apportées à la Loi de 2001 sur les
municipalités et entrées en vigueur le 1er janvier 2007 dans le
cadre du projet de loi 130 ont permis de supprimer la disposition sur
l’expiration après cinq ans des dispositions générales sur les permis
applicables à toutes les municipalités;
ATTENDU QU’il est jugé nécessaire de faire abroger l’article 11 du
Règlement de l’Ontario 540/00 pour éviter toute ambiguïté quant au statut des
règlements sur les permis des anciennes municipalités dans le cas où ils ne
seraient pas harmonisés d’ici au 1er janvier 2008;
IL EST RÉSOLU QUE le Conseil
autorise le chef du contentieux à communiquer avec les agents du ministère des
Affaires municipales pour demander l’abrogation de l’article 11 du Règlement de
l’Ontario 540/00.

Protective Services Committee recommend to Council the following :
