1.             allocation of cultural capital funding contribution

 

 

COMMITTEE RECOMMENDATION

 

That Council authorize that the Cultural Capital of Canada award program funding contribution of $666,000, which was not successful, be allocated back to the original capital project scope and towards four new cultural projects as described in Document 1.

3.             city of ottawa services and programs – trans fat free.

 

 

COMMITTEE RECOMMENDATION as amended

 

That Council approve:

 

1.         That the City of Ottawa require by 1 January 2008, new contract food suppliers and caterers providing services to the City of Ottawa and it’s programs be processed trans fat free;

 

2.         That Council, in its’ role as the Board of Health for the City of Ottawa, recommend to other public institutions in Ottawa (Public Works Canada, the NCC, Government Services Ontario, universities, hospitals, school boards, et cetera) to adopt processed trans fat-free policies.

 

 

CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE REPORT 11

 

 

 

1.             APPLICATION FOR A COMPLIANCE AUDIT OF ELECTION
CAMPAIGN FINANCES OF TERRY KILREA, CANDIDATE FOR MAYOR

 

 

Committee Recommendations as amended

 

That Council:

 

1.         Reject the application for a compliance audit of the election campaign finances for the 2006 municipal election campaign of Terry Kilrea, candidate for Mayor; and

 

2.         Approve that the Province be requested to amend the Municipal Elections Act to provide that the time limitation for commencing a prosecution of sections 69 to 79 shall be the later of:

 

(a)  One year after the facts upon which the offence is based came to the informant’s knowledge; and

(b)  Forty-five days after the later of;

a.   The deadline pursuant to subsection 81(3) for requiring an compliance audit in the subsequent regular election in respect of the candidate alleged to have committed the offence where a compliance audit is not directed to take place; or

b.   Where a compliance audit is directed to be performed in respect of the candidate after the subsequent regular election, forty-five days after the compliance audit is received by the Council.

6.             LAND EXCHANGE - TENTH LINE ROAD -
MINTO LAND DEVELOPMENT CORPORATION

 

 

Committee RecommendationS

 

That Council:

 

1.         Declare a parcel of vacant land, consisting of approximately 27,357m2 (6.76 ac), being part of the former Road Allowance between Lot 3 and Lot 4, Concession 10, geographic Township of Cumberland, now in the City of Ottawa, as shown hatched on Annex “A” attached, as surplus to the City's needs; and

 

2.         Approve an exchange of the City owned land described in Recommendation 1, for seven parcels of vacant land consisting of approximately 9870m2 (2.44 ac), described as being Parts of Lots 2, 3 and 4 in Concessions 10 and 11, in the geographic Township of Cumberland now in the City of Ottawa as shown on Annexes “B1,” “B2” and “B3” attached to this report required for the widening of Tenth Line Road together with the amount of $752,062 plus GST, from Minto Land Development Corporation, being the agreed compensation for the difference in the value of the lands being exchanged pursuant to a Land Exchange Agreement that has been received.

 


 

 

7.             Sale of property - 5531 Osgoode Main Street

That Council:

 

1.                  Declare the property shown hatched on Annex “A” attached, containing approximately 118.5 m2  (1,275.56 square feet), municipally known as 5531 Osgoode Main Street and described as part lot 51, lot 52, Registered Plan 393, former Township of Osgoode, now in the City of Ottawa, as surplus to the City’s needs;

 

2.         Approve the sale of the property detailed in Recommendation 1, subject to any easements that may be required to Nicole and Wayne Frazier, for the amount of $3,000 plus GST, pursuant to an Agreement of Purchase and Sale that has been received.

 

 

     

8.             motion concerning Fire Truck Donation to La cité collégiale

 

 

Committee Recommendations

 

That Council approve:

 

1.         That the City donate to La Cité Collégiale a fire truck that is no longer of use to the City ; and

           

2.         That Subsection 41(4) of By-law 50, as amended, be waived for this purpose.

 

 


PLANNING AND ENVIRONMENT COMMITTEE REPORT 12B

 

 

1.         POLICY FOR SURPLUS SCHOOLS

 

 

PLANNING AND ENVIRONMENT COMMITTEE RECOMMENDATIONS AS AMENDED

 

That Council approve the following:

 

1.                  Direct staff to undertake an evaluation and prioritisation of school sites for the purpose of identifying sites that would meet City needs should they be declared surplus;

 

2.         That these priorities be reviewed on an annual basis;

 

3.                  Direct staff to establish criteria for the evaluation of surplus schools sites for review and approval by the Agricultural and Rural Affairs Committee, Planning and Environment Committee and Council after which staff be directed to undertake an evaluation and prioritisation of school sites for the purpose of identifying sites that would meet City needs should they be declared surplus or are already surplus; and

 

4.         That a funding strategy be brought forward for the 2008 Budget in order to acquire school board property that qualifies.

 

 

AGRICULTURE AND RURAL AFFAIRS COMMITTEE RECOMMENDATIONS AS AMENDED

 

That Council approve the following:

 

1.         That, where a school board within the City of Ottawa offers a school site as surplus to its educational needs, the City of Ottawa indicate an interest in acquiring this site on a case by case basis;

2.             ZONING - 613, 5585 AND 5601 HAZELDEAN ROAD

That Council approve the following amendments:

 

1.         The land known as 613 Hazeldean Road be deleted from the former Township of Goulbourn Zoning By-law 1007-62 zoning map and the lands will no longer be subject to By-law 1007-62, and subsequently, the said land be incorporated into the former Township of Goulbourn Zoning By-law 40-99 zoning map, zoned "CLR-2" (Community Level Retail, Exception 2), "CLR-3" (Community Level Retail, Exception 3) and "CLR-3-h-f" (Community Level Retail, Exception 3, Holding, Flood Fringe), and the lands will be subject to the provisions of By-law 40-99, and

 

2.         The former Township of Goulbourn Zoning By-law 40-99 be amended to rezone the lands known as 5585 and 5601 Hazeldean Road from "A1" (Agriculture) to "I-X" (Institutional, Exception X), "NEA-1" (Natural Environment Area, Exception 1), "CLR-1" (Community Level Retail, Exception 1) and "CLR-2" (Community Level Retail, Exception 2).

 

all as shown on Document 1 and detailed in Document 3.

 

 

 

3.         OFFICIAL PLAN AND ZONING - 280 DIDSBURY ROAD

 

 

COMMITTEE RECOMMENDATIONS AS AMENDED

 

(This application is not subject to Bill 51)

 

That Council :

 

1.         Approve and adopt an amendment to the Kanata Town Centre Site-Specific Policies in Volume 2-B of the City of Ottawa Official Plan to redesignate 280 Didsbury Road from "Low Density Employment Area" to "Low Density Employment Area - Special Policy Area 1", as detailed in Document 4.

 


2.         Approve an amendment to the former City of Kanata Zoning By-law No. 142-93 to change the zoning of 280 Didsbury Road from “M1C-1(H)” (Light Industrial, Mixed, Exception 1, Holding) to “M1C–X(H)” (Light Industrial, Mixed, Exception X, Holding), as shown in Document 1 and detailed in Document 5.

 

3.         Approve the following amendments to Document 5:

 

a)                  That Subsection 2(f) of Document 5, Details of Recommended Zoning, be deleted and replaced with the following:

 

“Minimum Exterior Side Yard Width: three metres”

 

b)                  That Subsection 2(g) of Document 5, Details of Recommended Zoning, be deleted and replaced with the following:

 

“Minimum Interior Side Yard Width: two metres; except that the minimum interior side yard width shall be reduced to zero metres for a side lot line located adjacent to an existing or future rapid transit corridor.” 

 

c)         That Subsection 2(k) of Document 5, Details of Recommended Zoning, be deleted and replaced with the following:

 

“Despite the provisions of subclause 5.15(b)(ix), a landscape strip is not required between:

 

i)                    a parking area or paved area and a side lot line that is occupied by a drive aisle shared with an adjacent lot; and

ii)                  a parking area or paved area and a side lot line located adjacent to an existing or future rapid transit corridor.”

 

And that no further notice be given under Subsection 34(17) of the Planning Act.

 

 


 

 

4.             ZONING - 164 MAIN STREET

That Council approve an amendment to the former City of Ottawa Zoning By-law to change the zoning of 164 Main Street from an R3J Converted House/Townhouse Zone to a CN6 [xxx] F(3.5) H(14.0)-exception, a  Neighbourhood Linear Commercial Zone with exceptions as detailed in Document 2 and shown in Document 3.

 

 

PLANNING AND ENVIRONMENT COMMITTEE REPORT 13

 

 

1.         ZONING - PARTS OF 2367, 2551 AND 2553 TENTH LINE ROAD, PART OF 516 SOUTHFIELD WAY AND PART OF THE FORMER ROAD ALLOWANCE BETWEEN LOTS 3 AND 4, CONCESSION 10, IN THE FORMER CITY OF CUMBERLAND, BETWEEN TENTH LINE ROAD AND THE FUTURE PORTOBELLO BOULEVARD

That Council approve an amendment to the former City of Cumberland Zoning By-law to change the zoning of parts of 2367, 2551 and 2553 Tenth Line Road, part of 516 Southfield Way and part of the former road allowance between Lots 3 and 4, Concession 10, in the former City of Cumberland, between Tenth Line Road and the future Portobello Boulevard from D-R Development-Residential to R1H-XX, R3D-XX, R5A-X3, IS and OS as shown in Document 1 and as detailed in Document 2 as amended to change the Rear Yard provisions in both of the proposed R1H-XX and R3D-XX zones from 7.0 metres to 6.8 metres.

 

 


TRANSPORTATION COMMITTEE REPORT 6A

 

 

1.             WAIVER TO THE PRIVATE APPROACH BY-LAW 2003-447 FOR

                324 LAURIER AVENUE WEST

 

 

Committee recommendationS

 

That Council approve the waiver of the following two provisions of the Private Approach By-law 2003-447:

 

- provision 25(a.i) to permit a second private approach on the Gloucester Street frontage which, is less than 60 metres; and,

 

- provision 25(l) to permit two private approaches on the Gloucester Street frontage that will be located within 30 metres of one another and to permit a private approach that will be located within 60 metres of the adjacent intersecting street line.

 

 


 

2.             WAIVER TO THE PRIVATE APPROACH BY-LAW 2003-447 FOR 170 SLATER STREET

 

 

Committee recommendation

 

That Council approve the waiver of Provision 25(l)(ii) of the City of Ottawa Private Approach By-law 2003-447 for 170 Slater Street, to permit a private approach to be constructed closer than the required separation of 60 metres, from the intersection of Laurier Avenue and O'Connor Street. 

 

 


 

3.             WAIVER TO THE PRIVATE APPROACH BY-LAW 2003-447 FOR 1346 BANK STREET

 

 

Committee recommendation as amended

 

That Council approve the waiver of Provision 25(l)(i) of the City of Ottawa Private Approach By-law 2003-447 for 1346 Bank Street, to permit the construction of a new private approach within 2.6 metres of an intersection, where the by-law requires an 18-metre separation; and that if the business was to change functions requiring a drive-through that it rise to Planning and Environment Committee.
