That Planning and Environment Committee recommend Council approve the application to vary Section 103 of Sign By-law 2005-439 to permit an illuminated identification ground sign to be located with a height of 6.4 metres, instead of 4.5 metres, to be situated at 2075 Montreal Road.

éclairé ayant une hauteur de 6,4 mètres plutôt que de 4,5 mètres.
BACKGROUND
Imperial Oil (ESSO) has applied for a minor variance to permit the installation of a replacement illuminated ground-mounted sign to be located near the corner of the property (reference Document 1). The property is located on the north-east corner of Montreal Road and Ogilvie Road, within an existing commercial area along Montreal Road (reference Document 2).
The property is zoned Cn and therefore is classified as a District 3 sign under the Sign By-law. In this District, ground-mounted signs are restricted to a height of 4.5 metres. Approval of this application would permit a new ground sign with a height of 6.4 metres, which is the same height as the previous ground sign on this site.
Adjacent uses to the west and east are commercial. Businesses on the south side of Montreal Road are predominantly commercial, including a shopping mall located to the southwest of the subject site. Directly to the south, there is a vacant parcel which is commercially zoned Cc. Residential townhouse developments exist to the north and northwest of the subject site and are located at least 40 metres from the proposed sign location.
DISCUSSION
The owner wishes to install a replacement ground sign that complies with the sign standards and designs of the ESSO (Imperial Oil) company. If approved, the proposed sign would replace an existing sign with similar area and height parameters. This property is being redeveloped and is subject to a Site Plan Control application with the City. The proposed changes will significantly alter the existing gasoline service station, by including expansion of the retail use with a new building to be located on the northern portion of the site.
In this application, adjacent residential buildings are set well back from the proposed replacement sign and would be buffered by the expanded retail building. As a result, the scale and location of the proposed sign will have minimal visual impact upon adjacent uses.
The Department is satisfied the application is in keeping with the intent of the Sign By-law and approval is recommended.
CONSULTATION
In response to the standard circulation to property owners, occupants, business and community groups, and the Ward Councillor, no comments in opposition to the application were received.

City Clerk's Branch to notify the applicant, Lloyd Phillips and Associates Ltd., on behalf of Imperial Oil, Attention: Paul Robinson, 100 Palomino Drive, Kanata, ON K2M 1N3 of Council's decision.
Building Code Services will process the sign permit resulting from the Council direction in accordance with Sign By-law 2005-439.
