BACKGROUND
The subject property is a 4m wide strip of City-owned land situated adjacent to “The Shops of Main Street Ltd.” shopping plaza which is located along the easterly limit of Main Street, opposite its intersection with Carp Road in the Village of Stittsville.
The Shops of Main Street Ltd. development contains a number of retail outlets together with a stand-alone Tim Hortons restaurant with a drive-thru component. The current drive-thru queuing lane often backs up into the plaza parking lot, blocking vehicles from both entering and exiting parking spaces. In order to alleviate this problem, Tim Hortons, on behalf of the plaza owners, is proposing to realign the drive-thru by moving it to the easterly limit of the plaza, to be accessed by a private road running along the north side of the site. However, in order to reconfigure the drive-thru, it will be necessary for the plaza owners to acquire a strip of land from the adjacent property, which is owned by the City of Ottawa and is shown hatched on the attached Annex “A” sketch.
DISCUSSION
The owners of the plaza, The Shops of Main Street Ltd., appointed the TDL Group Corporation (Tim Hortons), to act on its behalf in reconfiguring the drive thru lane by securing necessary City approvals and negotiating the purchase of the subject property.
In that regard, approval was granted for the realignment of the existing drive-thru lane on 24 January 2006, as part of a Site Plan Control Application. City approvals were contingent upon the applicant acquiring the subject property and utilizing it as the new drive-thru queuing lane. In reconfiguring the queuing lane, the applicant will be required to create a landscaped buffer strip between the lane and the abutting City wetlands.
The adjacent City property is a large wetland area of significance to the community. With the exception of the subject strip of land, this wetland area will be retained by the City and will remain in its current natural state.
Pursuant to the City’s approval of the queuing lane realignment, the TDL Group made application to amend the subject’s zoning designation from Environmental Protection Area (EPA) to Environmental Protection Area Exception (EPA-1) permitting the subject property to be utilized as a drive thru queuing lane. The abutting plaza land is zoned CMU - Commercial Mixed Use Zone. Further zoning amendments are not anticipated.
The TDL Group has reached agreement with the City to purchase the subject property, and has executed an Agreement of Purchase and Sale in the amount of $15,000.00.
City policy requires the sale of property to be on the basis of market value. An independent fee appraisal confirms the recommended sale price of $15,000.00 to be consistent with current market values for comparable lands in the area.
The offer is considered fair and reasonable and is recommended for approval.
Environmental Management
does not object to the sale of this small parcel for the proposed Tim Hortons
Drive Thru. The majority of this parcel
was previously impacted by the deposition of fill, and its zoning will allow
for tight control of uses permissible within it. The approved site plan control requires a 6 m wide landscape
buffer between the queuing land and the adjacent property. The planting consists of 200 plantings of no
more then 1 m apart with four different native species.
CONSULTATION
In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning Transit and the Environment, to determine if the parcel should be retained for a City mandated program. The Environmental Management Group of the Planning and Growth Management Services Department was consulted with respect to the Greenspace Master Plan and their comments are indicated under the Environmental Implications section of this report. Neither the Housing Branch nor any other City Department expressed interest in retaining the property.
The utility companies were also circulated and no requirements were indicated.

No concerns were expressed with respect to the sale of the subject property to the abutting owner.
The ward Councillor has been
made aware of the intent to dispose of the subject property through the
circulation process and by subsequent notification.
HOUSING FIRST POLICY
The Official Plan policy directs that the City make land available for affordable housing and give priority for the sale or lease of surplus City-owned property for this purpose.
The Housing First Policy, approved by Council on 13 July 2005, establishes priority consideration to the Housing Branch in the identification of potentially surplus City-owned property, to be used in achieving the City’s affordable housing program targets. The policy also requires that the Official Plan target of 25% affordable housing, be met on any City-owned property sold for residential development. Where viable, residential properties are disposed of without a condition requiring an affordable housing component, 25% of the proceeds from the sale are to be credited to a housing fund, to be used for the development of affordable housing elsewhere in the City.
The subject is a non-viable property in a commercial zone and therefore does not meet the affordable housing criteria outlined in the Housing First Policy.
FINANCIAL IMPLICATIONS
This transaction represents revenue of $15,000.00 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.
SUPPORTING DOCUMENTATION

DISPOSITION
Following Council’s approval, Legal Services Branches will finalize the transaction.

1221 Stittsville Main Street to Tim Hortons at 1259 Stittsville Main Street
will enable the resolution of long outstanding traffic and pedestrian safety
concerns through the redesign of the site; and
AND
WHEREAS these lands were originally designated as environmental protection area
(EPA) as part of the lands adjacent to the Poole Creek corridor, but rezoned to
alleviate long-standing safety issues arising from the original site plan for
Tim Hortons; and
AND WHEREAS such a change in use is an
extraordinary but necessary measure; and
AND WHEREAS the City, Mississippi Valley
Conservation, and community volunteers have demonstrated their commitment to
the rehabilitation of Upper Poole Creek west of Stittsville Main Street through
a two-year program of riparian planting, fish habitat improvement, and
interpretive signage completed in 2006;
THEREFORE BE IT
RESOLVED that the funds generated from the sale of these lands be dedicated to
account 902203 Environmental Restoration and earmarked for restoration within
the Poole Creek sub watershed.
