AGRICULTURE AND RURAL AFFAIRS COMMITTEE REPORT 15A

 

 

1.             HERITAGE DESIGNATION OF 1128 MILL STREET, THE AYERS BUILDING, UNDER PART IV OF THE ONTARIO HERITAGE ACT

 

 

COMMITTEE recommendation

 

That Council approve the designation of the Ayers Building at 1128 Mill Street under Part IV of the Ontario Heritage Act in accordance with the Statement of Cultural Heritage Value or Interest and Description of Heritage Attributes, attached as Document 4.

 

(Note: Approval to Alter this property under the Ontario Heritage Act must not be construed to meet the requirements for the issuance of a building permit.)

 

 

 

2.             ZONING - 1476 AND 1488 CENTURY ROAD EAST AND 5758 FIRST LINE ROAD

That Council approve an amendment to the former Township of Rideau Zoning By-law to change the zoning of 1476 and 1488 Century Road East and 5758 First Line Road as detailed in Document 2 and as shown in Document 3.

 

 

 

3.             ZONING - 3984 CARROLL SIDE ROAD

 

 

COMMITTEE recommendation

 

That Council approve an amendment to the former Township of West Carleton Zoning By-law to change the zoning of part of 3984 Carroll Side Road from Rural Zone, (Ru) to Rural Zone –Temporary Use, RU-t, to permit the existing dwelling on-site as a garden suite for a 10-year period as shown in Document 1, and as detailed in Document 2, subject to the owner entering into a modified Garden Suite agreement with the City of Ottawa as specified by Section 39(1.2) of the Planning Act , setting out that:

 

(i)         the dwelling is to be occupied exclusively by the owner and his spouse;

(ii)        the dwelling is to be removed at such time as it is no longer required by the owner and his spouse, at any time prior to expiry of the 10-year period; and

(iii)       the dwelling is to be removed at the end of the 10-year period, unless an extension has been requested and approved by City Council, prior to the expiry of the Temporary Use By-law.

 

 

 

4.             ZONING - 1507 AND 1519 MANOTICK STATION ROAD

That Council approve an amendment to the former Osgoode Zoning By-law to change the zoning of 1507 and 1519 Manotick Station Road from RU - Rural to RU('X') - Rural Exception 'X' as shown in Document 1 and as detailed in Document 2.

 

 

 

5.             ZONING - 2740 DUNROBIN ROAD

That Council approve an amendment to the former City of Kanata March Rural Zoning By-law to change the zoning of 2740 Dunrobin Road from ER-5 Special Estate Residential 5 to C-s (H) Rural Commercial Exception Holding Zone and C-t (H) Rural Commercial Exception Holding Zones as shown in Document 1 and as detailed in Document 2.

7.             REVISED DRAFT COMPREHENSIVE ZONING BY-LAW - RURAL AREA AND GREENBELT - PUBLIC MEETING and approval

 

 

COMMITTEE recommendations as amended

 

2.         That Council approve:

 

(a)                the Draft Comprehensive Zoning By-law, Volume 1 (text and schedules) and Volume 2 (zoning maps) – September 2007 as noted in Document 1;

 

(b)                the staff recommendations noted in the Staff Recommendation Column IV of Document 2 - Draft Comprehensive Zoning By-law - Rural Area and Greenbelt - Summary of Comments on the May 2006 version and Modifications; and

 

(c)                the Additional changes to the Draft Comprehensive Zoning By-law – Rural and Greenbelt Area as noted in Document 3 and Document 4.

 

3.         Upon Council approval of the new Comprehensive Zoning By-law, and in the event of appeals to the Ontario Municipal Board (OMB), the most restrictive provisions of either,

 

(a)               the existing zoning by-laws of the former municipalities, or

 

(b)        the new comprehensive zoning by-law,

 

will apply until such appeals are disposed of by the OMB.

 

4.         a.         That the requirement for a sight-obscuring buffer where adjacent to a rural zone be added to Column V of exception [294r] to reflect the provisions of the current zoning by-law as amended by By-law 2006-267.

 

b.         That the proposed zoning of the lands known municipally as 6100 and 6116 Gough Road be modified to reflect the true intent of By-law No. 2006-242 with regards to permitted uses.

 

c.         That the proposed zoning of the lands know municipally as 1201 Thomas Dolan Parkway be changed from DR1 to RU to reflect the fact that the subject lands are not located within the Dunrobin Village Boundary.

 

d.         That the proposed zoning of the lands know municipally as 5420 Richmond Road and the lands know legally as CON 5RF LOT 23 TO 24 PT PCL;1 be changed from DR1 to RU to reflect the fact that the subject lands are not located within the Fallowfield Village Boundary.

 

e.                  That the proposed zoning of the lands know legally as part of the west half of Lot 38, Concession 7 being Part 1 on Registered Plan 5R-2553 be changed from AG to DR1 to recognize the fact the subject lands are located within the Village Boundary of Vernon.

 

f.                    That the proposed zoning of the lands on part of Lot 22, Concession 2 (former City of Cumberland) at 5342 Saumure Road be changed for the north portion of the property from AG3 to RU so that the whole of the property is in the RU zone.

 

g.         That Section 69 – Setbacks from Waterways contained in the May 2006 version of the draft Comprehensive Zoning By-law be re-inserted as modified below:

 

i.          Despite provisions of the underlying zone, the following minimum setbacks must be provided to provide a margin of safety from hazards associated with flooding and unstable slopes and to help protect the environmental quality of watercourses.

ii.         Except for flood or erosion control works, or a public bridge or a marine facility, no building or structure, including any part of a sewage system, which does not require plan of subdivision or site plan control approval, shall be located closer than 30 m to the normal highwater mark of any watercourse, or 15 m to the top of the bank of any watercourse, whichever is greater.

 

NOTE: Development requiring plan of subdivision, rezoning or site plan control will be subject to the watercourse setbacks as identified in Policy 4.7.3 of the City of Ottawa Official Plan.

 

h.         That Section 69 be moved to Part 2, General Provisions and that the following modifications be made:

§                     add the words “the Rockliffe Air Base. Airport zoning regulations” after the words “of Carp Airport and” in subsection (1)

§                     add a new subsection 2 as follows: “(2) Development in the vicinity of the Macdonald-Caritier International Airport, the Carp Airport, and Rockliffe Air Base, shall take into consideration guidelines found in Transport Canada Document TP312E - Aerodrome Standards and Recommended Practices as amended.   With respect to development in the vicinity of the Carp Airport, runway 10-28 shall be protected as a "4C CAT 1"  Runway, and runway 4-22 shall be protected as a "1C NON-INSTR" Runway.”

§                     change subsection (2) to (3).

 

i.          That there be no further notice pursuant to Section 34 (17) of the Planning Act.

 

5.         The zoning for 1599 River Road be amended to include an exception to permit the following additional uses:

·        animal care establishment

·        animal hospital

·        animal cemetery

 

6.         That the draft comprehensive zoning by-law be revised to apply a site-specific exception at 1751 8th Line Road to recognize the existing catering establishment; and

 

That pursuant to the Planning Act, subsection 34(17) no further notice be given.

 

7.         That the draft comprehensive zoning by-law be revised to apply a site-specific exception at 6971 Bank Street to add the existing funeral home as an additional use; and

 

That pursuant to the Planning Act, subsection 34(17) no further notice be given.

 

8.         That the subject lands will be exempt from the provisions of Section 58 (1) & (2) pertaining to the Flood Plain Overlay; and

 

That pursuant to the Planning Act, subsection 34(17) no further notice be given.

 


9.         That the Draft Comprehensive Zoning By-law be amended with respect to the zoning of Property Lot 3 Conc.1 at 5600/5994 First Line Road, Kars, ON (ward 21, City of Ottawa) as follows:

Section 2.D – Dealership:

·                    to include the following in

§                     category 1 – dirt bikes

§                     category 4 – landscape

·                                            to add a category 7 – Power Products.

 

That all categories include the following wording - sales, service, parts, rentals – as permissible uses; and

 

That an auxiliary storage building (5000 sq. feet) be considered as a permitted use.

 

 

 

8.             AGRICULTURAL RESOURCE AREA AND RURAL HOUSEKEEPING OFFICIAL PLAN AMENDMENT

 

 

COMMITTEE recommendation

 

That Council approve City of Ottawa Official Plan Amendment to bring the Agricultural Resource Area policies into conformity with the Provincial Policy Statement and to make some housekeeping changes in the rural area, as described in Document 1.

 

 

PLANNING AND ENVIRONMENT COMMITTEE REPORT 17

 

 

1.             REVISED DRAFT COMPREHENSIVE ZONING BY-LAW – URBAN AREA – PUBLIC MEETING AND APPROVAL

 

 

Committee recommendationS as amended

 

That Council :

 

1.         Approve the Draft Comprehensive Zoning By-law, Volumes 1 (text and schedules) and Volume 2 (zoning maps) – May 2007 (Urban Area) as noted in Document 1, as amended by the following:

 

a)      The height limit in the R4S zone be retained at 11 meters.

b)      The use of the Floor Space Index (FSI) provisions, as they had existed within the boundaries of the Heritage District of Rockcliffe Park, be continued.

c)      Schedule 2A be revised to reflect the location of existing transitway stations in Kanata and the most recent plans for additional transitway stations.

d)      The property at the southwest corner of Eleanor and Burris be corrected to show it in the R1F zone, which reflects its current use.

e)      The current maximum densities as prescribed in the existing Goulbourn R4 and R5 zones be retained for the corresponding zoning in the new by-law.

 

and as modified by:

 

f)       The staff recommendations noted in the Staff Recommendation Column IV of Document 2 – Draft Comprehensive Zoning By-law - Urban Area -Summary of Comments on the May 2006 and 2007 versions and Modifications;

and where there is conflict between the above documents, priority to resolving such conflict shall be given to the adopted motions introduced by Councillors followed in priority by the most recent document.

 

2.         Adopt the Comprehensive Zoning By-law, and in the event of appeals to the Ontario Municipal Board (OMB), the most restrictive provisions of either:

 

a)                  the existing Zoning By-laws of former municipalities, or

b)                  the Comprehensive Zoning By-law,

12.          APPLICATION TO DEMOLISH 456 LANSDOWNE AVENUE, APPLICATION FOR NEW CONSTRUCTION IN THE ROCKCLIFFE PARK HERITAGE CONSERVATION DISTRICT

That Council :

 

1.         Reject the application to demolish 456 Lansdowne Road, Rockcliffe Park Heritage Conservation District;

 

2.         Reject the application for new construction in the Rockcliffe Park Heritage Conservation District according to final plans received on July 6, 2007.

 

 

 

13.          SIGN MINOR VARIANCE - 1110 ST LAURENT BOULEVARD

That Council approve the application to permit a roof sign and animation of a roof sign as detailed in Documents 2 and 3 at 1110 St. Laurent Boulevard. 

 

 

 

14.          DEMOLITION CONTROL - 999 MERIVALE ROAD

 

 

Committee recommendations

 

That Council approve the demolition of a two-storey, six unit, rental apartment building that has taken place at 999 Merivale Road and impose the following conditions:

 

1.         The Owner shall be required to submit to the Director of Planning and the Director of Building Services, a Record of Site Condition (RSC) completed in accordance with the O.Reg. 153/04 and acknowledged by the Ministry of the Environment, confirming that all or part of the site will be suitable for the proposed use in accordance with O.Reg. 153/04, as detailed in Document 1.

2.         That a replacement building for 999 Merivale Road be substantially completed within five years from the date of this approval and in default thereof, the City Clerk shall enter on the collectors roll the sum of $10 000.00 for each dwelling unit contained in the residential property demolished.

3.         That until the time of construction of the replacement building, the Owner shall seed/sod and maintain the property as open space, not use the property for other interim uses, and maintain the property in accordance with the Property Standards By-law.

4.         That the Owner enter into an agreement with the City including the forgoing conditions and pay all the costs associated with the registration of the said agreement.  At such time as a building permit is issued to redevelop the site and the replacement building is in place, the agreement will become null and void and will be released upon request by the Owner.  The Owner shall pay all costs associated with the registration of the release from this agreement.

5.         That the approval be considered null and void if the provisions of Condition 4 above have not been fulfilled within six months of the date of approval.

 

 

 

 

15.          WATER WELLS IN PUBLIC WATER SERVICE AREAS

 

 

AGRICULTURE AND RURAL AFFAIRS COMMITTEE AND PLANNING AND ENVIRONMENT COMMITTEE RECOMMENDATIONS

 

That Council :

 

1.         Receive this report for information; and

 

2.         Direct staff to consult with stakeholders to explore the benefits of a Management Plan for Wells in Public Water Service Areas and to report back to Committee on the recommendations.

17.        ORLÉANS COMMUNITY GARDEN – GREEN PARTNERSHIP PROGRAM EXCEPTION

 

 

COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.                  Approve, due to the unique circumstances and location of the site, a one-time only exception to the Green Partnership Pilot Program to allow funding to build a well, providing that all Terms and Conditions of the Green Partnership Program are satisfied;

 

2.                  In advance of receiving further GPPP grant monies, require the JCOCG committee to collect funds for the purpose of paying to decommission the well should the garden ever be closed;

 

3.                  Require the well be properly tested for water quality and that access to the water supply be controlled.

 

 

TRANSPORTATION COMMITTEE REPORT 12

 

 

1.          INNES-WALKLEY-HUNT CLUB CONNECTION ENVIRONMENTAL ASSESSMENT – STUDY RECOMMENDATIONS

 

 

COMMITTEE RECOMMENDATIONS AS AMENDED

 

That Council:

 

1.                  Receive the findings of the joint City/Ontario Ministry of Transportation (MTO) Innes-Walkley-Hunt Club Connection Environmental Assessment Study as detailed herein;

 

2.                  Approve the Study Recommended Plan as illustrated in Documents 2(a) through 2(g) inclusive, and;

 

3.                  Direct staff to prepare the Environmental Study Report for the Innes-Walkley-Hunt Club Environmental Assessment and post it for the 30-day public review period, in accordance with the Ontario Environmental Assessment Act.

 

4.         Approve that as a condition of Phase I approval, sound attenuation features will be added along the section of roadway between Hawthorne Road and the Hunt Club Bridge (Riverside Drive) where they currently do not exist.  Further, where sound attenuation features are in existence, they will be retrofitted to mitigate the noise that will be produced by the increased volume of traffic projected from the extension of this roadway.

 

Further, that the need for sound attenuation be evaluated during the design phase along sections of the Blackburn Bypass where measures are not currently in place.

 

5.         Direct staff to engage the National Capital Commission in discussions regarding their mandate for ‘parkway’ style roadways in the National Capital Region.

 

 

TRANSIT COMMITTEE REPORT 13

 

 

1.             SMARTCARD FARE SYSTEM

 

 

COMMITTEE RECOMMENDATION

 

That Council approve:

 

1.         That Transit Services join the Greater Toronto Area Fare System (GTAFS) project with a view to full implementation of the Presto smartcard system in Ottawa by 2010 subject to the following conditions having been met by April 1, 2008:

 

·                      Provincial Cabinet approval of the proposal presented to OC Transpo by Ministry of Transportation staff as described in this report;

·                      Successful negotiation of central system fees to enable OC Transpo to reduce overall commission to approximately one percent;

·                      The STO Commission reaching a funding agreement to proceed with a technology upgrade; and

·                      Signing of the GTAFS Procurement Governance Agreement, the GTAFS Operating Agreement and the GTA Funding Agreement.

 

2.                  The delegation of authority to the Director of Transit Services to act on behalf of the City to approve and execute the GTAFS partnership agreements.

 

3.                  That approval of these recommendations be contingent on approval in the 2008 Capital Budget of an increase in project authority from $15 million to $21.200 million, recognizing that the actual cost to the City will be $15 million (or less) as a result of Provincial funding and the potential for Federal funding, as a result of the ability to integrate STO operations.

WHEREAS this increased economic activity does not generate much in the way of new income to the city because the PST, GST and corporate taxes which result from tourism and hotel activity are not available to the city; the only tax that is available to the city is the property tax,

 

BE IT RESOLVED the council petition the provincial government for the authority to create a hotel room tax such that some of the municipal costs created by the tourism and hotel industries can be recouped;

 

BE IT FURTHER RESOLVED this petition be forwarded to the FCM and the AMO for distribution to their members.
