That the  recommend Council approve an amendment to the former City of Nepean Zoning By-law to amend the site specific MM, Block 5, Industrial Manufacturing Zone zone designation of 265 West Hunt Club Road as shown in Document 1 and as detailed in Document 2.

BACKGROUND

 

This is an irregular, rectangular shaped lot having lot area of approximately 4.83 hectares and street frontage of approximately 240 metres.  This site is currently vacant land with frontage on West Hunt Club Road, however, vehicular access will be via a private road.

 

Purpose of Zoning Amendment

 

The applicant is proposing to subdivide what is a large remaining parcel of land to the east of the private road into three properties through a severance application with the Committee of Adjustment.  As a result, two of the properties will no longer have frontage on a public street.

 

The requested Zoning By-law amendment is to reduce the requirement to have a minimum street frontage of 30 metres to zero metres and delete the requirement that development may only occur when a lot has frontage on a public street.

 

Existing Zoning

 

The applicable zoning is MM Block 5, Industrial Manufacturing Zone.  This is a site-specific zone designation conditionally permitting an automobile sales dealership for previously owned vehicles and a retail warehouse.

 

Proposed Zoning

 

The applicant is requesting that this site specific zone be amended to accommodate the development of lots that front onto a private road as detailed in Document 3.

 

DISCUSSION

 

The Official Plan designation is General Urban Area designation which permits a full range of residential development as well as permitting employment, service, cultural, leisure, entertainment and institutional uses with the goal to attain complete and sustainable communities.  This would include a wide range of retail commercial and industrial development that was contemplated in the previous site plan approval that established a private road as access for commercial and industrial development to occur on lands that would be severed in the future. 

 

Upon review of the application, it is the Department’s position that the proposed Zoning By-law amendment proposal to reduce the minimum street frontage of a lot to zero and the permitting development to occur on a lot not having frontage on a public street conforms with applicable criteria set out in the Official Plan in that this property forms part of a small grouping of similar size lots with similar uses consistent with the Official Plan direction.  The properties will be adequately serviced by a shared access road to an arterial roadway that is accessible to the general public via a signalized intersection.  The proposal will include the extension of the existing private access road to service a larger holding, which is consistent with existing neighbouring development and is therefore considered appropriate.  Through either a site plan control application or Committee of Adjustment application, there will be a requirement for an amendment to an existing development agreement for the extension of private access road and for an amended maintenance and liability agreement.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. 

The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

The lands known municipally as 239 and 265 West Hunt Club Road shown on Document 1 will be rezoned from I Block 10 to MM Block 5, and those lands together with 265 West Hunt Club Road, will be the subject of a text change to the zone designation MM Block 5, with the addition of the following provisions:

 

-     That the minimum street frontage requirement for a lot is not appliciable, and

-     That development may occur on a lot not having frontage on a public street.

Moved by G. Hunter:

 

WHEREAS the applicant has recently acquired additional lands known municipally as 239 West Hunt Club to be included as part of this zoning application;

 

AND WHEREAS the current report recommendation in report reference no. ACS2008-PTE-PLA-0022 does not reflect the inclusion of the aforementioned lands;

 

THEREFORE BE IT RESOLVED THAT the current recommendation be replaced with the following:

 

That the Planning and Environment Committee recommend Council approve an amendment to the former City of Nepean Zoning By-law to rezone the property at 239 West Hunt Club Road from I Block 10 to MM Block 5, and to amend the site specific MM, Block 5, Industrial Manufacturing zone applicable to the properties at 239 and 265 West Hunt Club, as shown in Document 1 and detailed in Document 2.

 

And that Documents 1 and 2 of the said report are hereby replaced with the attached Documents.

 

That no further notice be provided pursuant to Section 34(17) of the Planning Act.
