BACKGROUND

 

The subject land is located on the west side of 9th Line Road, between Marvelville and Castor Roads. The site has a total of 642 metres broken frontage along 9th Line Road, an irregular depth of 1067 metres and a lot area of approximately 62 hectares. This Zoning By-law amendment application has been made to fulfill a severance condition relating to a remnant farm lot. Conditional approval was granted by the Committee of Adjustment on June 20, 2007 to create a 1.64‑hectare lot containing a single detached dwelling known as 4034 9th Line Road.

 

The site is surrounded in all directions by agricultural uses. A wooded area is located in the northwest portion of the site and trees are located along the perimeter of the property. A portion of South Castor Creek runs along 9th Line Road toward the south portion of the property.  Three existing grain bins and a metal shed are located on the remnant lot.

 

 

DISCUSSION

 

The Provincial Policy Statement (PPS) requires that new residential dwellings be prohibited on any vacant remnant parcel of farmland created by the severance.

 

The site is designated “Agricultural Resource Area” in the Official Plan (OP).  This designation recognizes farmland as an important land use in the city. The intent of this designation is to protect major areas of agricultural and other lands suitable for agriculture from loss to other uses. As a result, the primary use of land will be agriculture, with additional permitted uses of forestry and activities related to the conservation or management of the natural environment. Residential uses are permitted as farm housing or a detached dwelling on a lot fronting on a public road. Policy 14 of Section 3.7.3 requires that where a surplus dwelling is severed, the agricultural parcel be rezoned to prohibit any residential use. This is intended to limit lot creation solely for residential purposes on vacant farm properties.

 

According to the Osgoode Zoning By-law 2003-230, the site is zoned Rural (“RU”) and Hazard (“HAZ”). The portions of the site currently zoned Hazard (“HAZ”) will remain as such and do not permit residential uses. The Rural (“RU”) zoning permits a single detached dwelling, agricultural and forestry use together with residential accommodation for the owner or resident staff, or both.  The zone also permits an animal kennel, and other uses. The rezoning is to amend the RU zone to specifically prohibit a single detached dwelling.

 

All technical issues related to environmental, noise, traffic and servicing concerns do not apply in this rezoning application as the intent of the landowner of 4048 9th Line Road is to keep the lands to the existing agricultural use.  The rezoning of lands to prohibit residential development is consistent with the relevant PPS and OP policies and fulfills a condition of consent.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
