COMMITTEE RECOMMENDATION

 

That Council approve that the provisions of subsection 18(1), 19(2) and (3) of the City of Ottawa Noise By-law (2004-253) shall not apply so as to preclude the use of sound reproduction devices during the Relay For Life event, which may exceed 55 dBA, but will not exceed 65 dBA, when measured at the property line of a business person or person whose peace and comfort is disturbed before 11 p.m. or disturbs the peace and comfort of a resident whose peace and comfort is disturbed after 11:00 p.m. on the dates of June 13th and June 20th, 2008.

Que le Conseil d’approuver le fait que les dispositions des paragraphes 18(1), 19(2) et (3) du Règlement sur le bruit de la Ville d’Ottawa (2004-253) ne doivent pas s’appliquer de manière à empêcher l’utilisation d’appareils de reproduction sonore lors du Relais pour la vie, dont la puissance pourrait excéder 55 dBA, sans dépasser les 65 dBA, lorsqu’elle est mesurée à la limite de propriété d’un commerçant ou d’une personne dont la tranquillité et le confort sont perturbés avant 23 h, ou qu’elle perturbe la tranquillité et le confort d’un résident après 23 h les 13 et 20 juin 2008.

BACKGROUND

 

On 6 March 2008, the Community and Protective Service Committee received the following Notice of Motion from Councillor Qadri:

 

WHEREAS the Relay For Life, which is a major fund raising event for the Canadian Cancer Society, is hosting an event starting Friday, June 13th at 7:00 p.m. until Saturday, June 14th, at 7:00 a.m., 2008 at the Nepean Sportsplex and on June 20th at 7 p.m. until June 21st at 7 a.m. at Sacred Heart Catholic High School in Stittsville and at the Millenium Park in Orléans.

 

AND WHEREAS exemption from subsections 18(1), 19(2) and (3) of the City of Ottawa Noise By-law (2004-253) is required to allow the use of sound reproduction devices which may surpass the allowed 55 decibel level, but will not exceed 65 decibels, in effect until 11:00 p.m. or which may disturb the peace and comfort of a resident after 11:00 p.m.;

 

THEREFORE BE IT RESOLVED that the provisions of subsection 18(1), 19(2)and 3) of the City of Ottawa Noise By-law (2004-253) shall not apply so as to preclude the use of sound reproduction devices during the Relay For Life event, which may exceed 55 dBA, but will not exceed 65 dBA, when measured at the property line of a business person or person whose peace and comfort is disturbed before 11 p.m. or disturbs the peace and comfort of a resident whose peace and comfort is disturbed after 11:00 p.m. on the dates of June 13th and June 20th, 2008.

 

The Committee agreed to suspend the rules of procedure to consider the Motion at that time.

 

 

DISCUSSION

 

The Relay For Life is a major fund-raising event for the Canadian Cancer Society (CCS).  It is an opportunity to get together with family and friends and celebrate cancer survivors, remember loved ones lost to cancer, and fight back in the hope of finding a cure for this terrible disease. This year, it is hosting events at the following venues:

 

Barrhaven (Nepean Sportsplex) Friday, 13 June until Saturday, 14 June

Stittsville (Sacred Heart Catholic High School) Friday, 20 June until Saturday, 21 June

Orléans (Millennium Park) Friday, 20 June until Saturday, 21 June

 

Considering the importance of this event for the CCS, the Committee agreed to recommend that Council consider lifting the provisions of Subsection 18(1), 19(2) and (3) of the Noise By-law (2004-253), to preclude the use of sound reproduction devices* during these events which may exceed the legal level of 55 dBA.

Community and Protective Services Comments - By-law Services

 

The By-law and Regulatory Services Branch is in support of the proposed motion and will work with the event organizers to ensure potential noise concerns are monitored and addressed.
