Committee Recommendations
That Council approve:

as required under Sections 9 and Section 10
and service of Notice of Possession pursuant to Section 25 and 30 of the
Expropriations Act R.S.O. 1990.

In the 2002 Capital Budget, City Council approved funding for property acquisition required for the construction of the Page Road Stormwater Management Ponds. The Purpose of this report is to obtain the approval of the Approving Authority (City Council) to Expropriate the outstanding properties, register the required Plan of Expropriation, service of Notices of Expropriation and Election as required under Sections 9 and 10 and of Notice of Possession pursuant to Sections 25 and 30 of the Expropriations Act R.S.O. 1990, required for the construction of the Page Road Stormwater Management Ponds.
In the 1980’s, the former City of Gloucester and the former Regional Municipality of Ottawa Carlton (RMOC) began studies for the Master Drainage Plan required to accommodate growth in the East Urban Community. The studies provided that holding ponds were required to treat stormwater runoff and that the preferred location of the ponds was at the confluence of 2 arms of Mud Creek just to the east of Page Road at the Hydro corridor. The subject property includes the confluence location together with upstream lands that will make up one of the required bays and downstream lands required for erosion protection measures at the outlet. Construction of the ponds must proceed to provide a stormwater outlet for subdivisions that are draft approved and failure to acquire the lands in a timely manner will result in costs and penalties related to construction delays.
Pursuant to the direction of Public Works and Services (PWS), Real Estate Services contacted affected property owners to advise them of the project requirements and to seek permission to allow independent appraisers to inspect the properties for evaluation of the requirements. Upon delivery of the appraisals, Real Estate Services began negotiation with property owners for the acquisition of the requirements.
Negotiated agreements for purchase of the requirements were obtained from many property owners, however the City has been unable to conclude agreements with all owners. Expropriation proceedings commenced with an Application for Approval to Expropriate Land approved by Council 4 September 2007 (ACS2007-BTS-RPM 0026). Subsequently as per the requirements of the Expropriations Act, Notices of Application for Approval to Expropriate Land were sent to the property owners by registered mail on 3 October 2007. The notices were published in the Ottawa Citizen and Le Droit on 5th, 12th and 19th of October 2007. Two owners requested an Inquiry but one withdrew the request upon delivery of the City’s “Notice of Grounds” and supporting documentation as required by Section 7(4). The Inquiry was held 25 February 2008 and it was concluded that the City had met the test in the Act in that “the proposed taking was fair, sound and reasonably necessary in the achievement of the objectives of the expropriations authority”

hatched on Annex “A” and Annex “B”. On
both drawings, Parcel 1 is the temporary construction easement and Parcel 2 is
the fee simple interest required permanently for the pond infrastructure.
It is now in order to proceed with the expropriation of the lands in question, which will be followed immediately by the finalization of compensation to be paid either by way of further negotiation or by order of the Ontario Municipal Board.
Public consultation was part of the Master Drainage Study and the Community Design Plan process and included open houses and notices. The Ward Councillor is aware of the proposed expropriations and has voiced no objections with staff’s recommendation.
FINANCIAL IMPLICATIONS
Failure to acquire the needed property in a timely manner will result in costs and penalties related to delays in construction.

DISPOSITION
Following Council’s approval, Real Property Asset Management and Legal Services Branches, through outside Council will finalize the expropriation.
Surveys and Mapping will prepare and register plans of expropriation.
