applicant be given the choice of a stand for 2008 from the list of Available
Stands, with the following order of choice:
a. those approved applicants falling under the provisions of
subsection 12 (4) of the Markets By-law, choosing first, by attending the
Market Office by 1:00 p.m. on Wednesday, April 23, 2008; and
b. those approved applicants falling under the provisions of
subsection 12 (5) of the Markets By-law choosing second by attending the Market
Office by 4:00 p.m. on Wednesday, April 23, 2008, based on the order of the
pick from the 2007 Multi-Month Lottery;
3. That the remaining Available Stands be allocated by the
standard lottery process;
4. That staff provide notice to affected parties of the changes in
process described in Recommendations 1 and 2; and
5. That
staff continue to work on the new policies, regulations and business plans for
the ByWard and Parkdale Markets in consultation with Market stakeholders and
report to the Corporate Services and Economic Development Committee no later
than December 2008.

At its meeting of 18 March 2008, pursuant
to Section 84(3) of the Procedure By-law, the Corporate Services and Economic
Development Committee agreed to consider the above-noted motion, moved by
Councillor R. Jellett on behalf of Councillor G. Bédard. The full text of the motion follows:
WHEREAS the City of Ottawa is dedicated
to the preservation and continued enhancement of its historic ByWard and
Parkdale Markets;
AND
WHEREAS the City of Ottawa, the ByWard and Parkdale Market vendors, and the
ByWard and Parkdale Market Standholders Association (BMSA) are committed to
ensuring that the Markets offer a wide variety of fresh farm products and
quality art and craft from vendors residing primarily in Ottawa/Gatineau;
AND
WHEREAS the former City of Ottawa enacted an interim Markets By-law, being
By-law No. 191-95, as amended (Markets By-law), for the regulation of the
Parkdale and ByWard Markets pending the development and enactment of a
comprehensive Markets-related by-law at a later date;
AND
WHEREAS it is staff’s intention to present a new comprehensive Markets by-law
to Committee and Council, together with new policies and regulations in time
for the 2009 Market season, and in doing so, staff will work with the BMSA, the
Parkdale Market vendors and all Market stakeholders in order to ensure the
long-term success of the ByWard and Parkdale Markets as venues for fresh local
fruits and vegetables, local art and craft and other local products;
AND
WHEREAS since 1995, the interim Markets By-law provides that all new vendors
who have applied to sell at the Markets are allocated a stand for the season by
a lottery process that is administratively difficult due to the number of
interested parties needing to participate in the lottery and the process also
causes uncertainty and anxiety for vendors;
AND
WHEREAS the BMSA, which represents some of the standholders, has requested
that, for 2008 only, the lottery be replaced with a less complicated and
cumbersome process, and the BMSA has subsequently approved the option being
proposed;
AND
WHEREAS the Parkdale Market standholders have been consulted on this proposal
and no concerns have been raised;
THEREFORE
BE IT RESOLVED that the Corporate Services and Economic Development Committee
recommend Council approve the following processes to reduce the extent of the
lottery:

2008 only,

Motion - ByWard and Parkdale Markets
- Allocation of Stands for 2008
MOTION - allocation D’ÉTALS
DES MARCHÉS BYWARD ET PARKDALE POUR 2008
Councillor Jellett introduced a motion, which he had been asked by Councillor Bédard to introduce on his behalf with respect to the allocation of stands in the ByWard and Parkdale Markets.
Councillor Deans noted that the allocation of market stands was an issue that normally drew public interest and a number of public delegations at Committee. For these reasons, she was reluctant to consider a matter of this nature without public notification and she asked for clarification on the issue and its urgency.
Councillor Jellett re-iterated that he had been asked to introduce this item on Councillor Bédard’s behalf and that staff were present to answer members’ questions. He noted the ByWard Market Standholders’ Association (BMSA) had asked that this item be brought forward and that the motion had the full support of both the BMSA and staff. He explained that the motion would essentially allow the status quo for this year, while the new by-law was being drafted for Committee’s and Council’s consideration in the fall. At this juncture, he asked staff to speak to the issue.
Mr. P. Powell, Program Manager with the Real Property Asset Management Branch, noted that the ByWard Market Standholders’ Association’s president and secretary were in attendance and that they supported the motion, which was being brought forward at the Association’s behest. He indicated the motion dealt with a subset of standholders created in 1995 when the main Market By-law was quashed and the City was left with the interim Markets By-law. He remarked that since 1995, each and every new applicant had only one opportunity to get a stand and that this was through a lottery process, which had become cumbersome, with approximately 300 to 400 people showing up. As a result, and working with the Association, staff undertook to come forward with this motion. He advised that in last year’s lottery process, approximately 328 people showed up and 48 stands were allocated. He explained the intent of this motion was to take those 48 people and put them on the same stands as last year, but only for this year as a sign of good faith that the City was moving towards a new by-law, which would have the kinds of systems in place that an institution like the ByWard Market deserved. He re-iterated that this would only affect the aforementioned group of vendors and that many of the Market’s standholders had been around for a number of years and were not affected by the motion.
At this juncture, Committee voted on the motion to add the item for consideration at the present meeting.

Development Committee approve the addition of this item for consideration by
the Committee at today’s meeting, pursuant to Section 84(3) of the Procedure
By-law.

Councillor Deans drew a parallel between the allocation of market stands and the issuing of taxi licenses, noting these were never easy. She referenced some suggestions about working towards a process where staff would be transferable between owners and would start to accrue value. She hoped the City would not go down that road and she asked staff to comment on it. Mr. Powell indicated all such possibilities would be explored as part of the report coming forward in the fall with respect to the new Markets By-law. However, he maintained the purpose of this motion was simply to assign stands for 2008 under the same terms and conditions as in 2007.
Councillor Jellett referenced Mr. Powell’s earlier comments about more than 300 people showing up for last year’s lottery process and 48 stands being allocated. He wondered if, as a result of approving this motion, members of Council would then receive complaints from those who were not successful in getting a stand through last year’s lottery process. Mr. Powell explained that the lottery process was essentially stacked in that vendors got their friends and family members to attend in order to improve their chances. He indicated there were always more stands available than the demand for them. Furthermore, he indicated there would still be a lottery process but that, by assigning those 48 stands based on last year’s process, this motion would take some of the demand out of it.
Following these exchanges, Committee voted on the following motion.
