BACKGROUND
Councillor Feltmate, on behalf of Councillor Leadman presented the following motion at the February 12, 2008 meeting of the Planning and Environment Committee. Pursuant to Section 84 (3) of the Procedure By-law, the Committee added the item and carried the motion.
THAT
Planning and Environment Committee recommend to Council:
That Legal Services be directed to appear on the hearing regarding 300 Richmond Road with Planning and Environment Committee being delegated to provide such further direction as is necessary.
This item was not advertised as part of the Public Meeting Advertisement in the daily newspapers on the Friday preceding the Planning and Environment Committee meeting, as it was added at the meeting.
FINANCIAL IMPLICATIONS
Financial implications will be addressed in a memorandum to be provided by Legal Services.
DISPOSITION
Legal Services
will provide a confidential memorandum outlining this matter prior to
consideration by Council and a report for consideration by Planning and
Environment Committee on April 9, 2008 should further direction be required.

That the Planning and Environment Committee approve the addition of this item for consideration by the Committee at today’s meeting, pursuant to Section 84(3) of the Procedure By-law.
CARRIED
Tim Marc, Senior Legal Counsel,
advised that an application before the Committee of Adjustment was refused and the
proponent has appealed to the Ontario Municipal Board (OMB). The application sought to permit an increase
in FSI from 2.0 to 3.7, to permit a reduction in the number of loading spaces
to 0, and to permit a reduced driveway width of 3.6 metres to allow a
five-storey building to be constructed with mixed use on the ground floor and
20 residential units above. He
explained that Legal Services advises the Ward Councillor when a matter from
the Committee of Adjustment is coming before the OMB. He noted that the Planning branch did not object to the
application. After consultation with
Councillor Leadman, it was determined that Legal Services could attend the
hearing, but direction is required from Council to do so. As the hearing is scheduled for April 10,
2008, the Planning and Environment Committee could give additional direction on
April 9, 2008.
Councillor Leadman spoke of the
application and its possible implication for the Richmond Road Community Design
Plan and other City policies.
In response to questions, Mr. Marc confirmed that no Zoning or Official Plan applications were submitted and the Site Plan has not yet been filed.
Mr. Marc indicated he would be providing a confidential memorandum to Council prior to its meeting. He indicated in-house resources could possibly be utilized for the hearing.
