1.                  The waiver of Provision 6 of the Use and Care of Roads By-law 2003-498 and Provision 3(2) of the Encroachment By-law 2003-446, to permit the construction of retaining walls and guardrails as surface encroachments in the Lorne Avenue road allowance at 62 Lorne Avenue.

 

2.         That public access to the City of Ottawa’s stairs linking upper and lower Primrose Avenue be maintained throughout the course of the 62 Lorne Avenue construction project.

REPORT RECOMMENDATION

 

That Transportation Committee recommend Council approve the waiver of Provision 6 of the Use and Care of Roads By-law 2003-498 and Provision 3(2) of the Encroachment By-law 2003-446, to permit the construction of retaining walls and guardrails as surface encroachments in the Lorne Avenue road allowance at 62 Lorne Avenue.

 

RECOMMANDATION DU RAPPORT

 

Que le Comité des transports recommande au Conseil d’approuver la dispense à la clause 6 du Règlement municipal 2003-498 sur l’utilisation et l’entretien des voies routières et à la clause 3(2) du Règlement municipal 2003-446 sur les empiètements afin de permettre la construction de murs de rétention et de glissières de sécurité en tant qu’empiètements de surface sur l’emprise routière de l’avenue Lorne à la hauteur du 62, avenue Lorne.

 

BACKGROUND

 

The subject property is located at on the southwest corner of the intersection of Lorne Avenue and Primrose Avenue (Document 1).  The City has received a Building Permit application for the construction of a four storey single family dwelling on land that is presently a vacant parcel (Document 2).

 

Significant work on the road allowance would be required for the proposed design, due to steep elevations on two sides of the property.  Three retaining walls on the road allowance are proposed to create a stable slope along the Lorne Avenue frontage (Document 3).  Two subsurface retaining walls with connecting dowels on the Lorne Avenue frontage are proposed to be constructed under the private approach, two retaining walls will be constructed as headwalls along the private approach, and a guard rail will be installed along the private approach.

 

The applicant is seeking waiver of Provision 6 of the City of Ottawa Use and Care of Roads By-law 2003-498, which prohibits the construction of a wall on the road allowance, and Provision 3(2) of the City of Ottawa Encroachment By-law 2003-446, which prohibits surface encroachments on the road allowance.

 

DISCUSSION

 

Both Lorne Avenue and Primrose Avenue are bisected by a 10m rock escarpment at the location of the subject property.  A pedestrian staircase connects the two elevations.  The Building Permit application proposes a four-storey dwelling, with a private approach to the third floor garage from the cul-de-sac at the higher elevation of Lorne Avenue.

 

Compacted fill and two subsurface retaining walls of heights five metres and one metre are proposed in the road allowance, parallel to Lorne Avenue, in order to support the private approach from Lorne Avenue.  The headwalls along the private approach will be six metres in height.  Guard rails are proposed to be constructed as surface encroachments along both sides of the private approach, from the edge of the sidewalk on Lorne Avenue to the garage.  Three retaining walls of one metre height are proposed between the private approach and the lower elevation of Primrose Avenue, parallel to Primrose, in order to provide slope stability.

 

Waiver of Provision 6 of the Use and Care of Roads By-law 2003-498 and Provision 3(2) of the Encroachment By-law 2003-446 is required to permit these encroachments on the road allowance. 

 

Should the waiver be granted and the encroachments constructed, the owner will be required to enter into a Permanent Encroachment Agreement, in which the owner agrees to assume all responsibility for maintenance and liability related to the encroachments, and consents to removal of any encroachment from the road allowance upon request by the City of Ottawa.

 

CONSULTATION

 

Staff of Planning and Infrastructure Approvals Branch and Infrastructure Services Branch have reviewed the proposed design, and site details have been circulated in accordance with the procedure for Municipal Consent.  The Ward Councillor has reviewed the proposal and concurs with the waiver.

 

 

FINANCIAL IMPLICATIONS

 

There are no financial implications for the City associated with approval of this waiver.

Councillor Legendre expressed concerns with respect to the diagrams that still did not clearly show the property line and the encroachment in question despite his request for such information at the last meeting.

 

Richard Hewitt, the Deputy City Manager of Public Works and Services, appreciating the Councillor’s concern, agreed to ensure that more detailed and clear diagrams are provided in future reports being brought forward to Committee.

 

At the request of Councillor Holmes, the Ward Councillor, the Committee considered the following motion:
