BACKGROUND
The subject land is located on the south side of Giroux Road, between Heuvelmans Road (unopened road allowance) and Frank Kenny Road. The site has a total of 648 metres of broken frontage along Giroux Road, a depth of 593 metres and a lot area of approximately 42 hectares. This Zoning By-law amendment application has been made to fulfill a severance condition relating to a remnant farm lot. The Committee of Adjustment granted conditional approval on December 12, 2007 to create a 0.51-hectare lot containing a single detached dwelling known municipally as 2182 Giroux Road.
The site is surrounded by agricultural uses to the north and east. A licensed quarry is located to the south and west. Concentrations of trees are located to the southwest and east portions of the site. The site currently contains a single detached dwelling, equipment shed, silo, and two barns. The two barns are to be removed. The lot to be severed (2182 Giroux Road) contains an existing residential use. No new development is proposed as a result of this application.
DISCUSSION
Provincial Policy Statement (PPS) 2.3.4.1(c) requires that new residential dwellings be prohibited on any remnant parcel of farmland created by the severance.
The site is designated “Agricultural Resource Area” in the Official Plan (OP). This designation recognizes farmland as an important land use in the city. The intent of this designation is to protect major areas of agricultural and other lands suitable for agriculture from loss to other uses. As a result, the primary use of land will be agriculture, with additional permitted uses of forestry and activities related to the conservation or management of the natural environment. Residential uses are also permitted, including farm housing or a detached dwelling on a lot fronting on a public road. Policy 14 of Section 3.7.3 requires that where a surplus dwelling is severed, the agricultural parcel be rezoned to prohibit any residential use. This is intended to limit lot creation solely for residential purposes on vacant farm properties.
The site is zoned Agriculture (“AGR”). This zone permits agricultural uses, and uses which are compatible with the rural economy such as forestry uses, kennels, stables and veterinary establishments. Permitted residential uses include a single detached dwelling, bed and breakfast establishment and home occupations. The rezoning is to amend the AGR zone to specifically recognize the existing single detached dwelling on the remnant lot and prohibit further development of residential uses, including an additional single detached dwelling for farm assistants. The Zoning By-law amendment proposes to increase the minimum lot size to 42 hectares in order to prevent the creation of a new lot that would permit a single detached dwelling without the review of a further application for a Zoning By-law amendment.
All technical issues related to environmental, noise, traffic and servicing concerns do not apply in this rezoning application, as the intent of the landowners of 2226 Giroux Road is to keep the lands in the existing agricultural use.
The rezoning of lands to prohibit further residential development is consistent with the relevant PPS and OP policies and fulfills a condition of consent.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.

DETAILS OF RECOMMENDED ZONING
1. Schedule F of the Cumberland Zoning By-law 64-82 will be amended by changing the zoning for 2226 Giroux Road from Agriculture (“AGR”) to Agriculture-Exception x (“AGR-Xx)”) as shown on Document 1.
2. A new exception, number x, will be added to Section 12-Agricultural Zones to include the following special provisions:
a) Despite clauses 12.1 (a) and (c), the only permitted residential use is one (1) single detached dwelling.
b) Lot Area (minimum): 42 hectares
