1.   Approve an amendment to the former Rideau Township Zoning By-law to change the zoning of 6327 Fourth Line Road from A2 (General Rural) to A2-55 to prohibit residential dwellings on the vacant farm parcel as detailed in Document 2 and shown in Document 1.

 

2.   Approve an amendment to the new Comprehensive Zoning By-law to change the zoning of 6327 Fourth Line Road zoned AG1 to AG5 to prohibit residential dwellings on the vacant farm parcel as detailed in Document 2 and shown in Document 1.

BACKGROUND

 

Purpose of Zoning Amendment

 

The parcel to be rezoned is approximately 35 hectares in area, located on the north side of Fourth Line Road, south of Phelan Road and north of the Village of North Gower.  The applicants applied for, and received, conditional consent from the Committee of Adjustment to sever the dwelling and accessory detached outbuildings known as 6361 Fourth Line Road made surplus through farm consolidation on a 5.147-hectare parcel.  In accordance with the requirements of the Provincial Policy Statement, parcels remnant of such applications are required to prohibit the construction of future dwellings on the vacant farmland.  Consent to sever the dwelling is conditional on this rezoning.

 

 

DISCUSSION

 

Official Plan 

 

The parcel is designated Agricultural Resource in the City of Ottawa Official Plan.  The policies permit severance of a dwelling made surplus through farm consolidation provided the vacant agricultural parcel is rezoned to prohibit any residential use.

 

The Committee of Adjustment in granting the severance of the dwelling has required, in accordance with the Official Plan, the retained lands to be rezoned, prior to finalization of the consent.  The proposed zoning therefore implements the intent of the Official Plan.

 

By-law 428 – 2004 former Township of Rideau

 

Existing Zoning

 

The existing zoning is A2 (General Rural).

 

Proposed Zoning

The lands will be placed in a General Rural-exception (A2-55 Zone to prohibit residential dwellings on the vacant farm parcel.

 


New Comprehensive Zoning By-law

 

It is intended that the draft New Comprehensive Zoning by-law will be passed by City Council on June 25, 2008.  The Draft Zoning By-law indicates the lands will be zoned AG1. An amendment to AG5 will be required to prohibit residential uses. The AG5 Zone will also establish a minimum lot area of 30 hectares and a minimum lot frontage of 60 metres.

 

Concurrent Application 

 

Consent application: D08-01-07/B-00496 approved conditional on this rezoning. The rezoning will fulfill one of the conditions of consent to permit the severance to finalize.

 

 

RURAL IMPLICATIONS

 

The rezoning supports the agricultural community, permitting the farmer to dispose of a dwelling surplus to his operation, while protecting and preserving the agricultural use of the retained lands, by prohibiting future dwellings to be constructed thereon.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
