BACKGROUND

 

On 6 March 1985, the Council of the former City of Ottawa approved a series of road closings to enable the redevelopment of Alvin Heights, part of which development is now known as London Terrace. 

The purpose of the application was to increase the permitted unit density and to allow for the ultimate demolition of the existing 488 deteriorated residential units and the construction of new rental and condominium residential units.

 

In 1986, when the Provincial Government enacted the Rental Housing Protection Act, City Council confirmed its commitment to this project by requesting the Province on 5 November 1986 to exempt the development from the provisions of the Act.

 

In the subsequent 22 years, the owners have proceeded with the redevelopment project.  To date, as the redevelopment has proceeded, the owner has been able to abide by the requirement in the former City of Ottawa Demolition Control By-law for residential units that before a demolition permit will be issued, building permits must have been obtained for new units.

 

However, at this time to implement the approved servicing plan for this final phase of the redevelopment, inclusive of sanitary sewers, storm sewers, watermains and the other utilities (gas, hydro, telephone, etc), it is necessary to demolish the units listed on Document 1 in order to do the work.  Thus, while the units would be demolished at this point, building permits will be not be obtained.  New residential construction will commence immediately upon completion of the servicing and would be timed in response to market demand.  Site Plan approval for the final phases of the redevelopment was given on 12 October 2007.

 

DISCUSSION

 

The Alvin Heights/London Terrace project has proceeded in accordance with the 1985 approval of Council and the agreement that the parties entered into at that time, including the requirement that 425 units continue to be utilized for rental tenure for a minimum of five years.

 

While as noted above, Council did, subsequent to its original approval of the project in 1985, concur in 1986 for an exemption from the provisions of the Rental Housing Protection Act, no exemption from the provisions of the Planning Act, section 33 was provided.  In the absence of this exemption, unless building permits are obtained for the new buildings, it will not be possible to demolish the existing buildings and complete the servicing for the development.  The City could insist on building permits being obtained but this would add to the cost of and time for the development as the owner is in a position now to move forward with the demolition and servicing.

 

A theme in the various reports concerning Development Review is for the development approvals to be granted in a timely fashion where there are no outstanding policy concerns.  It would be consistent with this theme to permit the London Terrace project to proceed at this time by granting an exemption from the provisions of the Demolition Control By-law.

 

CONSULTATION

 

No consultation is required on demolition control applications.  The Ward Councillor has been advised that this report is being brought forward.

 

FINANCIAL IMPLICATIONS

 

The approval of this report will not have any financial impact for the City as the units that will ultimately be constructed after the servicing work is complete were foreseen with the original Council approval.  The servicing work is being done at the cost of the owner.
