That Council amend licensing by-laws to delegate to the Chief License Inspector the authority to rectify the status of a license or license application review when such status are compromised due to minor administrative oversights.

That the Community & Protective Services Committee recommend that Council amend licensing by-laws to delegate to the Chief License Inspector the authority to rectify the status of a license or license application review when such status are compromised due to minor administrative oversights.

Que le Comité des services communautaires et de protection recommande que le Conseil modifie les règlements sur les permis afin de déléguer à l’inspecteur en chef des permis le pouvoir de corriger le statut d’un permis ou l’examen d’une demande de permis lorsqu’un tel statut est compromis en raison de certaines omissions administratives mineures.

 

 

BACKGROUND

 

At its meeting of June 16, 2008, the License Committee dealt with two minor items created by an administrative oversight.  The related licensing by-law does not provide for a staff initiated administrative resolution and required that the License Committee be convened to resolve the matter. Committee members are of the opinion that License Committee involvement was unnecessary and that the items could have been dealt with more expeditiously by the Chief License Inspector. 

 


Councillor Qadri moved the following motion at that meeting:

 

That the authority for an administrative oversight or issues be provided back to the Chief License Inspector in order to avoid waste of resources and expenses.

The Committee Coordinator was directed to bring the motion before the Community and Protective Services Committee for its recommendation to Council.

 

On June 19, 2008, the Community and Protective Services Committee suspended the rules to consider this additional item.

WHEREAS the City of Ottawa’s Licensing By-laws authorize the Chief License Inspector to approve the issuance and renewal of a license for certain business activities;

 

AND WHEREAS in the event that a minor administrative adjustment is made to the status of a license in error, it cannot be corrected without a formal appeal to the License Committee;

 

AND WHEREAS at its meeting of June 16th, 2008, the License Committee considered two such appeals and subsequently recommended “that the authority for an administrative oversight or issues be provided back to the Chief License Inspector in order to avoid waste of resources and expenses”;

 

THEREFORE BE IT RESOLVED THAT the Community & Protective Services Committee recommend that Council amend the Licensing By-laws to delegate to the Chief License Inspector the authority to make minor administrative adjustments to the status of a license.

The Motion met with the Committee’s approval with a direction that it rise at the July 9, 2008, City Council meeting for consideration.

The Department has reviewed the recommendation and is in support of delegating minor administrative adjustments to the status of a license to the Chief License Inspector

Legal Services Branch has reviewed the recommendation and advises that there are no legal impediments to its implementation.

That in accordance with Section 84(3) of By-law No. 2006 - 462, the rules of procedure be suspended to allow the addition of the following item to the agenda for consideration: Delegation of Authority to Chief License Inspector.
