Committee recommendation as amended

 

That Council approve that if residents of Third Avenue and Percy Street can prove the front yard parking or access has been in place prior to January 1985, and provided there is no community or neighbour objection, curb ramps will be provided for these residents.

That the Planning and Environment Committee recommend to Council that if residents can prove the front yard parking or access has been in place prior to January 1985, and provided there is no community or neighbour objection, curb ramps will be provided for these residents.

Que le Comité de l’urbanisme et de l’environnement recommande au Conseil l’aménagement de bateaux de trottoir pour les résidents qui le demandent pourvu que ceux-ci puissent prouver que leur stationnement dans la cour avant ou l’accès à cette dernière existe depuis avant janvier 1985, et que la communauté ou des voisins n’y opposent aucune objection.

 

 

BACKGROUND

 

On 10 June 2008, the Planning and Environment Committee received the following Notice of Motion from Councillor Doucet:

 

WHEREAS the City is rebuilding parts of Third Avenue and Percy Street over the next two summers;

 

AND WHEREAS the City's front yard parking by-law is enforced on a complaint-driven basis;

 

AND WHEREAS it is not reasonable to deprive people of front-yard parking that has been in existence for a generation without complaint;

 

AND WHEREAS it is not reasonable to require current residents to secure an affidavit stating that their front yard parking spot was in use prior to 1960;

 

AND WHEREAS the community association and area residents have supported a similar motion in the summer of 2005 and of 2007 regarding a similar circumstance on Fifth, Percy, Craig, Holmwood, Sunnyside, Patterson Avenue, Strathcona, Allan and Cobalt;

 

BE IT RESOLVED that if the resident can prove the front yard parking or access has been in place prior to, January 1985, and provided there is no community or neighbour objection, curb ramps will be provided for these residents.

 

DISCUSSION

 

During the City’s rebuilding of parts of Third Avenue and Percy Street over the next two summers, front-yard parking for residents, which has been in existence for a generation without complaint, will be removed.

 

The community association and area residents have supported similar motions regarding similar circumstances on several other community streets.

 

CONSULTATION

 

Public Consultation has not been held, but community association support has been on record with the City for this and similar requests in the past years.  The overwhelming majority of residents support this manner of resolving the issue.

John Moser, Chief Planner and Director of Planning, indicated that the specific streets should be specified in the motion for consistency.
