That Council approve the application to vary Sign By-law 2005-439, to permit an illuminated video screen information sign within 28 metres of a residential use, instead of the required 30-metre setback, for 2200 Carling Avenue.

BACKGROUND

 

The Tim Horton's location at 2200 Carling Avenue has applied for a sign permit to legalize an existing pre-menu video screen sign.  This location does not satisfy the 30‑metre setback requirement between a sign and adjacent residential uses in a residential zone. 

The Tim Horton's use has a video screen information sign as part of the drive-thru located near the south east side of the lot.  The by-law allows pre-menu board signs at drive-thru restaurants to promote products and services related to the use.

 

DISCUSSION

 

Provisions for drive-thru information signs limit the scale and location of video screen signs (see Document 1).  Drive-thru information signs that are illuminated must be located a minimum distance of 30 metres from residential uses.  This sign has a setback of 28 metres to the nearest residential use in a residential zone.  The intensity of illumination for a video screen sign is typically lower than identification signs that advertise a use.

 

This site provides limited screening between the sign and the nearby residents (see Document 2).  The video sign faces directly towards adjacent residential uses.  The applicant has agreed to realign this sign to be situated parallel to the drive-thru so that it faces in an easterly direction away from the adjacent residents and towards commercial uses (see Document 3).  This measure will provide an effective limit on the impact to nearby adjacent residential uses.

 

The Department is satisfied the application is in keeping with the intent of the Sign By-law and approval is recommended.

 

CONSULTATION

 

Standard early notification was provided to community and business groups and adjacent owners.  One adjacent resident was opposed to the application as follows:

 

2200 Carling Avenue;

 

 

Response to Comments

 

The change in direction of sign will address the above concerns.  In addition, this area of Carling is mainly commercial and the impact of this sign will not significantly add to existing lighting levels.

Attention: Alyson Mann, 40 Michael Cowpland Drive, Suite 200, Kanata, ON, K2M 1P6 and the Ward Councillors of Council's decision.  Building Code Services will process the sign permits resulting from the Council direction in accordance with Sign By-law 2005-439
