REPORT RECOMMENDATIONS

 

That the Agriculture and Rural Affairs Committee recommend Council:

BACKGROUND

 

The parcel to be rezoned is approximately 28 hectares in area, located on the west side of McCordick Road, south of Pierce Road and north of Mackey Road.  The applicants applied for, and received, conditional consent from the Committee of Adjustment to sever the dwelling and accessory detached outbuildings known as 6948 McCordick Road made surplus through farm consolidation on a 2.6-hectare parcel.  In accordance with the requirements of the Provincial Policy Statement, parcels remnant of such applications are required to prohibit the construction of future dwellings on the vacant farmland.  Consent to sever the dwelling is conditional on this rezoning.

 

Rideau Zoning By-law

 

The existing zoning is A2 (General Rural). The A2 zone requires a minimum interior side yard width of nine metres.

 

Proposed Zoning

The lands will be placed in an A2-XX ( General Rural - exception zone) to prohibit residential dwellings on the vacant farm parcel and recognize the existing interior side yard width as the minimum internal side yard width for the existing storage building.

 

 

DISCUSSION

 

Official Plan

 

The parcel is designated Agricultural Resource in the Official Plan.  The policies permit severance of a dwelling made surplus through farm consolidation provided the vacant agricultural parcel is rezoned to prohibit any residential use.

 

In addition to the requirements of the Provincial Policy Statement and the Official Plan to rezone the lands to prohibit future dwellings to be constructed thereon, the applicant has requested that the zone recognize the location of an existing storage shed located approximately three metres from the new lot line.

 

New Comprehensive Zoning By-law

 

The Comprehensive Zoning By-law was passed by City Council on June 25, 2008.  The new Zoning By-law indicates the land is zoned AG2. An amendment to AG6 will be required to prohibit residential uses. The AG Zone will also establish a minimum lot area of 18 hectares and a minimum lot frontage of 60 metres.

 

A rural exception zone [XXr] will also be created to recognized the existing internal side yard width as the minimum internal side yard width for the existing storage shed.

 

 

RURAL IMPLICATIONS

 

The rezoning supports the agricultural community, permitting the farmer to dispose of a dwelling surplus to his operation, while protecting and preserving the agricultural use of the retained lands, by prohibiting future dwellings to be constructed thereon.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
