That the Agriculture and Rural Affairs Committee recommend Council approve an:

BACKGROUND

 

Purpose of Zoning Amendment

 

The parcel to be rezoned is approximately 38 hectares in area, located on the east side of Shea Road, on the north side of Flewellyn, known as 5879 Flewellyn Road.  The applicants applied for, and received, conditional consent from the Committee of Adjustment to sever the dwelling and accessory detached outbuildings known as 5891 Flewellyn Road made surplus through farm consolidation on a 0.89-hectare parcel.  In accordance with the requirements of the Provincial Policy Statement, parcels remnant of surplus dwelling applications are required to be zoned to prohibit the construction of future dwellings on the vacant farmland.  Consent to sever the dwelling is conditional on this rezoning.

 

DISCUSSION

 

Official Plan

 

The parcel is designated Agricultural Resource in the Official Plan.  The policies permit severance of a dwelling made surplus through farm consolidation provided the vacant agricultural parcel is rezoned to prohibit any residential use.

 

The Committee of Adjustment in granting the severance of the dwelling has required, in accordance with the Official Plan, the retained lands to be rezoned, prior to finalization of the consent.  The proposed zoning therefore implements the intent of the Official Plan.

 

Zoning By-law 2008-250

 

City Council adopted Zoning By-law 2008-250 on June 25, 2008.  By-law 2008-250 zones the parcel AG (Agricultural Zone). The proposed Zoning By-law amendment will place the parcel in an AG5 (Agricultural exception 5 zone) to prohibit residential uses. The AG5 Zone will also establish a minimum lot area of 30 hectares and a minimum lot frontage of 60 metres.

 

Former Township of Goulbourn Zoning By-law

 

The Goulbourn Zoning By-law identifies the land in an A1 (Agricultural Zone).  This zoning recognizes the agriculture land use for these lands.  The proposed Zoning By-law amendment will place the lands in an Agricultural-exception zone (A1-XX) Zone to prohibit residential dwellings on the vacant farm parcel.

 

Concurrent Application

 

Consent application: D08-01-08/B-00174 approved conditional on this rezoning. The rezoning will fulfill one of the conditions of consent to permit the severance to be finalized.

 

RURAL IMPLICATIONS

 

The rezoning supports the agricultural community, permitting the farmer to dispose of a dwelling surplus to his operation, while protecting and preserving the agricultural use of the retained lands by prohibiting future dwellings to be constructed thereon.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
