That the Corporate Services and Economic Development Committee recommend Council approve the granting of a non-exclusive Municipal Access Agreement to the  University of Ottawa in the general form as described in this report.

BACKGROUND

 

The City has received a request from the University of Ottawa (the University) to install  infrastructure within the Municipal public rights-of-way to service the University campus.  This infrastructure includes telecommunication duct structures as well as utility tunnels for steam lines and other services.


DISCUSSION

 

It is proposed that the City enter into a Municipal Access Agreement to establish the terms and conditions under which the University may use the Municipal rights-of-way.  The use of the City's rights-of-way will only be permitted where such use will not interfere with the City's servicing requirements, nor will the use of the University interfere with the public use and enjoyment of the rights-of-way.  The proposed Agreement will be a non-exclusive Municipal Access Agreement which will set out the terms and conditions by which the University shall enter on to, work, maintain, repair and reinstate the City's rights-of-way. The Agreement provides, in part, as follows:

 

1.  All costs and liabilities for the design, construction, operation and maintenance of the Equipment in the Municipal rights-of-way shall be the sole responsibility of the University.    The University shall obtain all required approvals for the construction, installation or alteration of the Service Corridor.

 

2.  The University shall maintain and operate the Equipment in the Service Corridor in accordance with good engineering standards and practices and the University shall be solely responsible for any and all discharges or releases from the Equipment in the Service Corridor.

 

3.  The University shall be liable for and shall indemnify the City for any costs, expenses, damages or loss by the City, and maintain liability insurance to meet City requirements.

 

4.  The term of this Agreement is for a period of ten years, and shall be automatically and continuosly renewed for consecutive periods of one year, unless terminated.  The City has the option to terminate this Agreement at any time with sixty days written notice.

 

 

CONSULTATION

 

There has been consultation with the University on the preparation of this agreement.  The Ward Councillor supports this agreement.

 

 

FINANCIAL IMPLICATIONS

 

The University of Ottawa is responsible for all costs associated with their plant or equipment within the Municipal Right-of-way including the payment of all permits and charges required under Municipal By-laws with the exclusion of the payment of any encroachment fees. 

 

 

DISPOSITION

 

Legal Services Branch to finalize the Municipal Access Agreement and arrange for the execution of of the Agreement.
