That
Council approve the demolition of a single detached house that has taken place
at 1809 Riverside Drive subject to the following:
a. That Minto
representatives work with staff to provide some fencing and recreation
amenities, worth not less than $5000, for residents of the area; and
b. That the
City assume liability insurance for use of this amenity space by the public.

Environment Committee recommend Council approve the demolition of a single detached house that has taken place at 1809
Riverside Drive.

démolition d’une maison unifamiliale qui a eu lieu au 1809, promenade
Riverside.
The subject property, located at 1809 Riverside Drive, is on the east side of Riverside Drive, north of Smyth Road. The subject property currently has a 12-storey apartment building (The Faircrest) located on it. Prior to being demolished, there was also a single detached rental house at the northeast corner of the property. Further to the north is another high-rise apartment building. The transitway runs parallel to Riverside Drive to the west.
The house was recently demolished without the benefit of a Demolition Control approval or a Demolition Permit. The house had been vacant since March of 2007. The building was in poor condition and considered unrentable and maintenance costs were considered too high. The property owner contracted the demolition work, which included a requirement for the demolition company to obtain a demolition permit and any/all City permits required to facilitate and conduct the demolition of this property. The demolition company had thought that the property owner already obtained the permits and demolished the building without obtaining the necessary approvals.
Under the Demolition Control
By-law, City Council approval of a demolition permit is required within the
former City of Ottawa when a dwelling unit is removed from a property without a
proposed replacement building.
Extenuating circumstances, led to the building being demolished without
the appropriate Demolition Control approval or a Demolition Permit. To ensure compliance with the Demolition
Control By-law, the owner has submitted this application to formally obtain
Council approval for the demolition that has taken place, as the owner does not
intend to replace the former building. The site is developed with a 12-storey apartment building and it
is intended that, where the single family detached dwelling was located, that
the lands be landscaped and left as open space as part of the apartment
property. The site currently is being used
temporarily as a parking lot for residents at 1833 Riverside Drive, while the
existing parking area for the apartment building is being refurbished. Work in the parking lot of this building
will be completed this Fall. At that time temporary parking will be
discontinued and the lands will be landscaped.
DISCUSSION
Staff is recommending approval of this application. The Planning Act and the Demolition Control By-law enable Council to impose conditions on demolition control approvals. However it is not appropriate to replace this dwelling unit (and impose conditions to assure it’s replacement). The site is located within an area developed with high-rise apartments and currently accommodates a 12-storey apartment. It is therefore considered more appropriate to have the lands, where the single family detached dwelling was located, be landscaped and left as open space, as part of the apartment property.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.

Councillor Peter Hume is aware of the application.
RESPONSE
The City’s objective where property owners have undertaken works that are not in compliance with City requirements / by-laws is to have the property owners take the necessary measures to attain compliance prior to initiating legal actions. The property owner, upon becoming aware of the failure of their contractor to obtain the required municipal approvals (as was stipulated in their contract), submitted the applications to obtain necessary approvals.

Chair Hume corrected that the
property in question was situated in Capital Ward.
John Dickie, representing Minto
Apartments Ltd. and accompanied by Mr. Trottier, Property Manager, recalled that the demolished
building was a single-family home that had reached the end of its useful life,
had been in bad condition and that restoration had not been feasible. Minto contracted a company to obtain a
demolition permit and tear down the building; however, in error, the contractor
tore down the building without obtaining the permit. He added that staff, Minto and the Ward Councillor agreed that it
would not make sense to replace the building.
Minto has no plans to develop the property in the foreseeable future and
the area is lacking in amenities. He
stated that Councillor Doucet had suggested that in the long term the City
should look at buying the land for amenity use. In the short term, Minto will landscape the site and agree to
contribute $5000 to an improved amenity.
Mr. Dickie emphasized that Minto is seeking the demolition permit to
regularize the situation.
Chair Hume stated the proposed
compromise is a reasonable solution, which will benefit the community.
Moved by C. Doucet:
WHEREAS Old Riverside Drive is a
heavily populated high rise area; and
WHEREAS there is no public outdoor
amenity space;
THEREFORE BE IT RESOLVED THAT
Minto representatives work with staff to provide some fencing and recreation
amenities, worth not less than $5000, for residents of the area; and that the
City assume liability insurance for use of this amenity space by the public.
