BACKGROUND

 

This application affects a portion of a lot located at 6633 Dalmeny Road within the former Township of Osgoode. The subject land is located north of Dalmeny Road and west of 4th Line Road. The parcel is situated in an agricultural setting and is being used for this purpose at present.  The site has frontages of 671.79 metres on Dalmeny Road and 559.11 metres on 4th Line Road and contains an area of 61.02 hectares.  There are no buildings on the subject lands.

 

The purpose of the subject application is to amend the Comprehensive Zoning By-law and the former Township of Osgoode Zoning By-law to change the zoning of a part of the property to prohibit residential uses in fulfillment of one of the conditions of consent to sever a surplus dwelling imposed by the Committee of Adjustment (Committee of Adjustment application No. D08-01-08/B-00225).

 

 

DISCUSSION

 

Official Plan 

 

According to the Official Plan, the subject land is designated “Agricultural Resource Area”. This designation protects prime agricultural areas from loss of lands to other uses. The policies ensure that a severance for the creation of a new lot on which is located a dwelling made surplus through farm consolidation does not permit the construction of a new dwelling on the lot rendered vacant through the severance. The policies require that the vacant agricultural parcel so created be rezoned to prohibit any residential use. The housing restriction is intended to limit a pattern of lot creation in Agricultural Resource Areas that would see a new residence being constructed on a vacant farm property, the house being declared surplus and severed for a lot and the pattern so repeated.

 

Zoning

 

According to the Comprehensive Zoning By-law, the site is presently zoned Agricultural Zone “AG”. This zoning permits a detached dwelling, agricultural use and several other uses.


In order to ensure that the intent of the above Official Plan policies is implemented in the Comprehensive Zoning By-law, it is recommended that the zoning of the site be changed from Agricultural Zone “AG” to Agricultural Subzone 4 “AG4”, as shown on Document 1, in order to prohibit residential uses on a lot having a minimum area of 45 hectares and a minimum width of 90 metres. This rezoning is considered appropriate since it will protect agricultural land from loss to other uses and will continue to respect the minimum lot area and width requirements.

 

According to the former Township of Osgoode Zoning By-law, the site is zoned Rural Zone “RU” and Hazard Zone “HAZ”. The “RU” zone permits a single detached dwelling, agricultural use and many other uses. The “HAZ” zone permits agricultural and forestry use, game preserve, sanctuary and parks. The applicant’s request to change the zoning of the site from Rural Zone “RU” to Rural Zone – Exception 349 “RU[349]”, as shown on Document 1, is necessary in order to prohibit residential uses in respect of the applicable Official Plan policy. The “RU[349]” zone currently exists within the former Township of Osgoode Zoning By-Law and is used for this purpose. 

 

 

RURAL IMPLICATIONS

 

The subject land will be limited to agricultural uses.  By restricting residential uses, major agricultural areas will be protected from fragmentation and competing uses.  In effect, it will enhance the rural heritage and fortify the rural landscape.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
