BACKGROUND
The subject property, 175 and 425 March Valley Road, is located on both the east and west sides of an extension of March Valley Road, north of Terry Fox Drive and the Ottawa Central Railroad, and south of March Valley and Fourth Line Roads.
On February 23, 2005, a temporary zoning for the site was adopted. The purpose of this rezoning was to permit a ‘golf course’ as an interim use until such time as the Kanata North Business Park requires the lands for industrial-related uses. The nine-hole executive course was approved through Site Plan Control and has been constructed.
The intent of the Owner is to renew the temporary zoning for the existing golf course. It is their opinion that the current use is the best use for the site at this time.
The subject site is zoned Business Park Industrial, Subzone
8, special exception 172 (IP8[172]H(15)) in By-law 2008-250. Although the zone
allows for a golf course, the special exception recognizes that the golf course
on these lands is intended to be a temporary use. The original temporary use Zoning By-law expired on February 23,
2008.
The
former City of Kanata By-law:
These lands are zoned Rural Industrial–d (RI(d)) under By-law No. 74-79. This By-law was amended by By-law No. 2005-99 to temporarily rezone the subject property to allow for the golf course for a period of three years. Although the Rural Industrial zone does not permit a golf course on this property, it was determined to be an appropriate land use on a temporary basis. This is because it is adjacent to an existing golf course, there is sufficient vacant land within the business park for development in the near future, and because it offers open or green space for the surrounding built environment.
It is proposed to rezone the subject lands to extend the temporary use of a golf course for another three years.
DISCUSSION
The Official Plan designates the subject property as an “Enterprise Area”. This designation identifies areas of employment and may accommodate medium to high density housing provided that the employment targets are maintained and that the two opposing types of land uses are not in conflict. The policies governing Enterprise Areas also encourage a variety of complementary uses such as recreational uses to serve the employees of the Enterprise Areas, the general public and passing traffic. As such, the plan supports a golf course use on these lands.
Under the
Comprehensive Zoning By-law, the applicant is proposing to rezone the lands
zoned Business Park Industrial, Subzone 8, special exception 172
(IP8[172]H(15)) to extend the temporary zone for the existing golf course for
three more years.
Staff is
also recommending that the Rural Industrial – exception (d) (RI(d)) zoning for
these lands be changed under the former City of Kanata Zoning By-law to include
the extension of the temporary use zoning.
Conclusion
The proposed Zoning By-law amendment is consistent with the policies of the Official Plan and the intent of both Zoning By-laws.
The temporary land use is suitable since it provides a compatible interim use that will not compromise future employment targets for the Enterprise Area. The temporary zone will also allow the lands to be easily returned to the Business Park Industrial - IP8 zone when market conditions allow for the development of additional employment uses in this area.
Natural features have been retained throughout the golf course.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
The Department of National Defence (DND) owns a majority of the surrounding lands across March Valley Road to the north and east and uses the area for field practice. The DND comments were provided in support of the original application for a temporary use by-law. They have not responded to the circulation of the extension of this use.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time Decision Date" established for the processing of Zoning By-law amendment applications.
