That Council approve the application to vary Section 105 of Sign By-law 2005-439 to permit an internally illuminated ground sign with a height of 10.7 metres, instead of the maximum allowed height of 8.0 metres, for the property situated at 1540 Star Top Road.

Que le Comité de l’urbanisme et de l’environnement recommande au Conseil d’approuver une demande de dérogation mineure à l’article 105 du Règlement sur les enseignes 2005-439 afin de permettre l’installation d’une enseigne au sol éclairée de l’intérieur d’une hauteur de 10,7 mètres, au lieu de la hauteur maximale permise de 8,0 mètres, pour la propriété située au 1540, chemin Star Top.

 

BACKGROUND

 

The applicant, a building structure company, has applied for a minor variance to allow a proposed ground sign to be installed higher than permitted in the By-law (see Document 1).  This request represents a 33 per cent increase to the by-law maximum for the height of a ground sign.

 

The subject property is located in an industrial zone, being District 4 in the Sign By-law, near Innes Road and HWY 417 (see Document 2) in the Star Top/Cyrville area.  Nearby adjacent uses are auto sales, retail, manufacturing and industrial service uses.

 

DISCUSSION

 

The proposed sign would provide identification for the recently renovated ATCO Structures business at 1540 Star Top Road.  For this request, the applicant has stated that it is their intention to locate the proposed pylon ground sign further back on the lot so it would not block any of the adjacent neighbouring business ground signs on Star Top Road.  Since a conforming sign would be blocked by other buildings, the extra height of the sign would be justified so that the sign could be seen from both directions of the roadway.  If approved, the sign would be installed at a height of 10.7 metres instead of the maximum height of 8.0 metres.

 

Since adjacent uses are commercial and industrial, the proposed sign would have limited impact.  The sign face area and setback of the new sign complies with the provisions of the by-law.  Finally, the height of the sign is consistent with the building form in this area.

 

In this case, the Department is satisfied the application is in keeping with the intent of the Sign By-law and approval is recommended.

 

CONSULTATION

 

In response to the standard circulation to property owners, occupants, business and community groups, and the Ward Councillor, no comments in opposition to the application were received.  The Ministry of Transportation was consulted and has no objection to the variance request.

City Clerk's Branch to notify the applicant, Lundon Calling Inc., Attention: Rodger Lundon, on behalf of ATCO Structures, 3100 Armada Avenue, Ottawa, ON, K1T 1T4 and Ward Councillors Bellemare and Hume of Council's decision.

 

Building Code Services will process the sign permit resulting from the Council direction in accordance with Sign By-law 2005-439.
