That Council:
1.
Replace the recommendation contained in ACS2008-PTE-PLA-0216
(Disposition 41) for 222 Beechwood Avenue with the proposed changes to the
Zoning By-law 2008-250 as detailed in Documents 2 and 3.
2.
Change the designation in Zoning By-law 2008-250 of 5-11 Marquette
Avenue and 8-12 Jolliet Avenue, as detailed in Document 2, from TM8 H(10) to
TM8 H(15).
3.
Amend Document 2 to add the
following provision:
“1. c) Section
64 does not apply to Area A in Schedule XXX”

That Planning
and Environment Committee recommend that Council:
1.
Replace the recommendation contained in ACS2008-PTE-PLA-0216

BACKGROUND
On October 28, 2008, Planning and Environment Committee considered the recommendations of report ACS2008-PTE-PLA-0216. All of the recommendations were approved except for those dealing with the land at 222 Beechwood Avenue, where the recommendations were deferred to this meeting. The recommendation in Disposition 41 was worded as follows:
“That Recommendation 1 be amended by deferring Items 5 and 12 of Document 2 to November 14, 2008 and that Recommendation 3 be deferred to November 14, 2008.”
The
reference to Item 5 is the only part of the above items that still needs to be
acted upon. It is no longer necessary to act on Item 12 of Recommendation 1 and
on Recommendations 2, 3 and 4 in report ACS2008-PTE-PLA-0216 because they are
amending provisions of former Zoning By‑laws (Vanier, Ottawa and
Rockcliffe Park), which are no longer in place, due to approval of the
unappealed sections of the Comprehensive Zoning By-law 2008-250, on October 23,
2008.
In
reviewing the regulations for this property and for surrounding properties with
the new owner, staff were made aware of two zoning anomalies, one in the Zoning
By-law 2380 for the former City of Vanier and another in By-law 2008-250.
· In By-law 2380, the maximum building height for the property at 222 Beechwood Avenue was shown as 20 metres when it should have been 10 metres. The owners were aware of this 20-metre height limit two weeks ago when they purchased the property. They were also aware that there was a 10-metre height for this property in the Comprehensive Zoning By‑law. They have requested that the City honour the 20-metre height limit so that they can build a new six-storey mixed-use building.
· In By-law 2008-250, the maximum building height for the properties at 5-11 Marquette Avenue and 8-12 Jolliet Avenue (immediately behind 222 Beechwood Avenue) is shown as 10 metres when it should have been 15 metres. The building height for these properties was increased to 15 metres as part of the implementing by-law for the Beechwood Community Design Plan however that height was not brought forward into the Comprehensive By-law when it should have been. It is recommended that this anomaly be corrected.
DISCUSSION
The Beechwood Cemetery viewshed affects about half
of 222 Beechwood Avenue and limits building height to no more than 77 metres
above sea level (about 19 metres above grade). For the remainder of the
property, a building height of 20 metres will not affect the viewshed and the
added height beyond the recommended 15 metres would permit an additional one or
two storeys.
Staff has no significant concerns with this
increased height as it is an incremental increase, not a major increase in the
level of intensification that was envisioned in the Beechwood Community Design
Plan and it does not affect the viewshed.
One modification is proposed:

that a transition
setback of two metres be established above 16 metres along the rear lot line.
Initially, staff were suggesting 15 metres however the architect advised that
they require an additional metre to make the project work.
CONSULTATION
Since the previous Planning and Environment Committee meeting, staff has consulted the owners of the property at 222 Beechwood Avenue.

provision affecting the land known municipally as 222 Beechwood Avenue;
THEREFORE BE IT RESOLVED THAT Committee approve the following:
1. Amend
Document 2 of the said Report to add the following provision:
