That Council
approve an amendment to Zoning By-law 2008-250 to:
1. Change the zoning of
5073 Rushmore Road from AG2 (Agricultural - subzone 2) to AG[319r]
(Agricultural zone - rural exception 319) as shown in Document 1 and as
detailed in Document 2.
2. Change the zoning of
5089 Rushmore Road from AG2 (Agricultural - subzone 2) to AG6 (Agricultural
subzone 6) to prohibit dwellings from being constructed on the lands as shown
in Document 1 and as detailed in Document 2.

BACKGROUND
The
subject land is located on the south side of Rushmore Road, west of Richmond
Road. The applicants applied for, and received,
conditional consent from the Committee of Adjustment to sever the dwelling and
accessory detached outbuildings known as 5073 Rushmore Road made surplus
through farm consolidation on a 1.13-hectare parcel. In accordance with the requirements of the Provincial Policy
Statement, parcels remnant of surplus dwelling applications are required to be
zoned to prohibit the construction of future dwellings on the vacant
farmland. Consent to sever the dwelling
is conditional on this rezoning.
DISCUSSION
Official Plan
The parcel is designated Agricultural Resource in the Official Plan. The policies permit severance of a dwelling made surplus through farm consolidation provided the vacant agricultural parcel is rezoned to prohibit any residential use.
The Committee of Adjustment in granting the severance of the dwelling has required, in accordance with the Official Plan, the retained lands to be rezoned, prior to finalization of the consent. The proposed zoning therefore implements the intent of the Official Plan.
Zoning By-law 2008-250
The proposed rezoning will place 5073 Rushmore Road in an AG[xxr] (Agricultural Zone [rural exception]) to recognize a minimum lot width of 24 metres. The AG zone also permits a residential use on parcels with a minimum lot area of 0.2 hectares.
The proposed rezoning will also place the vacant farmland in an AG6 (Agricultural subzone 6) to prohibit residential uses. The AG6 Zone will also establish a minimum lot area of 18 hectares and a minimum lot frontage of 60 metres.
The
rezoning supports the agricultural community, permitting the farmer to dispose
of a dwelling surplus to his operation, while protecting and preserving the
agricultural use of the retained lands by prohibiting future dwellings to be
constructed thereon.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
