That
Council direct Planning and Growth Management staff to amend the Encroachment
By-law in order to permit the placement of small tables and chairs on
municipal highways, and to report back to Committee and Council before the end
of 2009.

REPORT RECOMMENDATION
That the Transportation
Committee recommend that Council direct Planning and Growth Management staff to
amend the Encroachment By-law in order to permit the placement of small
tables and chairs on municipal highways, and to report back to Committee and
Council before the end of 2009.

Que le Comité des transports recommande au Conseil
d’ordonner au personnel de la Direction de l’urbanisme et de la gestion de la
croissance de modifier le Règlement municipal sur les droits d’empiètement de
façon à permettre l’installation de petites tables et de chaises le long des
routes municipales, et de faire rapport au Comité et au Conseil avant la fin de
2009.
BACKGROUND
On 26 August 2009, the aforementioned Notice of Motion was submitted
for consideration at a subsequent meeting of the Transportation Committee.
Sections 63 to 91 of the City of Ottawa Encroachment
By-law 2003-446, as amended, provide for the operation of outdoor patios as temporary
surface encroachments on municipal highways.
Section 82 of that By-law, as
amended, requires that an outdoor patio permit holder shall ensure that the
perimeter of the outdoor patio is delineated by a fence or other vertical
barrier. However, small businesses such
as coffee shops and bakeries may benefit from the placement of small tables and
chairs without a perimeter railing and it is requested that the By-law be
amended to permit the placement of such encroachments on municipal highways.
Staff will bring forward any
necessary amendments to the Encroachment By-law subject to a Best Practice
Review and the recommendations of a Technical Advisory Committee by the end of
2009.
Provided the By-law amendment requires the assumption by the Owner of all liabilities, and provided the By-law requires the continued safe and practical use of the sidewalk as a sidewalk for pedestrians, and allows for proper sidewalk maintenance, there are no legal impediments to the implementation of this Report's recommendation.

There are no financial implications.
