Committee Recommendations

 

That Council:

 

1.         Waive the application of the Signs on City Streets By-law and of the Tourism and Public Signs Policy and authorize the Deputy City Manager, Infrastructure and Community Sustainability Department, to:

a.       Upon request of the applicant, approve the design for an ethno-cultural sign relating to the community of Little Italy for placement on provincial Highway 417, provided such design meets the requirements of the provincial Ethno-Cultural Signs policy and conforms with applicable City policies and by-laws; and

b.      Upon request of the applicant, enter into a 10 year agreement with the applicant for the installation of ethno-cultural trailblazing signs on Raymond Street, Rochester Street and Carling Avenue in relation to the community of Little Italy, provided that:

i)            the applicant pay a processing and technical review fee of one hundred dollars ($100) and a permit fee of one thousand ($1000.00);

ii)           the applicant pay one thousand, six hundred and fifty dollars ($1650.00) to cover costs stemming from the installation and any needed replacement of any signs, with the signs to be provided by the applicant; and,

iii)          the agreement stipulates that the production of the sign is the responsibility of the applicant, that the sign be built to applicable City standards and be satisfactory to the Deputy City Manager in all respects. 

 

2.         Approve an amendment to the Delegation of Authority By-law to authorize the Deputy City Manager, Infrastructure Services and Community Sustainability Department, to approve the design of ethno-cultural signs to be placed on provincial highways, provided that the proposed signs meet the requirements of the provincial Ethno-Cultural Signs Policy and of all applicable City policies and by-laws.

 

3.         Direct staff to report back to Committee and Council with appropriate by-law amendments for the creation of an ethno-cultural trailblazing signs program on City streets, including applicable fees and charges, in order to reflect the intent of the provincial policy.

a.         sur demande du requérant, à approuver la conception d'une enseigne ethnoculturelle désignant la communauté de la Petite-Italie, à installer le long de l'autoroute provinciale 417, pourvu que la conception réponde aux exigences de la politique provinciale sur les enseignes ethnoculturelles et soit conforme aux politiques et règlements applicables de la Ville;

b.         sur demande du requérant, à conclure une entente de 10 ans avec le requérant pour l'installation, sur la rue Raymond, la rue Rochester et l'avenue Carling, d'enseignes ethnoculturelles pionnières désignant la communauté de la Petite-Italie, pourvu :

(i)         que le requérant paie des frais de traitement et d'examen technique de cent dollars (100 $) et des droits de permis de mille dollars (1 000 $);

(ii)        que le requérant verse la somme de mille six cent cinquante dollars (1 650 $) pour couvrir les coûts d'installation et de remplacement éventuel des enseignes, celles-ci devant être fournies par le requérant;

(iii)       que l'entente précise que la production de l'enseigne incombe au requérant, que l'enseigne doit être construite conformément aux normes municipales applicables et qu'elle doit être, à tous égards, à la satisfaction de la directrice municipale adjointe;

 

2.         d'adopter une modification du Règlement sur la délégation de pouvoirs afin d'autoriser la directrice municipale adjointe, Services d’infrastructure et Viabilité des collectivités, à approuver la conception d'enseignes ethnoculturelles à installer le long de routes provinciales, pourvu que les enseignes proposées répondent aux exigences de la politique provinciale sur les enseignes ethnoculturelles et des politiques et règlements applicables de la Ville;

 

3.         de prescrire au personnel de présenter un rapport au Comité et au Conseil contenant le texte des modifications réglementaires voulues pour la mise sur pied d'un programme d'enseignes ethnoculturelles pionnières dans les rues de la ville et comprenant les droits et redevances applicables, de manière à refléter l'objet de la politique provinciale.

BACKGROUND

 

On 7 October 2009, the Transportation Committee suspended the rules in order to consider a Motion with regards to the provincial Ethno-Cultural Sign Policy.  A full copy of the resolution is attached as Document 1 to this report.

 

 

DISCUSSION

 

The Ministry of Transportation of Ontario (MTO) has developed and approved an Ethno-Cultural Sign Policy which permits the installation of ethno-cultural way-finding signs on provincial highways directing motorists to ethno-cultural communities that have a distinct cultural identity.

 

The Ethno-Cultural Sign Policy requires that the municipality:

 

The City of Ottawa’s Signs on City Streets By-law and its Tourism and Public Signs Policy do not presently address ethno-cultural trailblazing signs.  The community of Little Italy has applied for permission to install ethno-cultural signs on both provincial Highway 417 and on Raymond Street, Rochester Street and Carling Avenue.

 

 

CONSULTATION

 

The Preston Street BIA and the Dalhousie Community Association are aware of and supportive of this initiative.

 

Infrastructure Services and Community Sustainability

 

Staff have reviewed this and are not aware of any issues with implementing the recommendations if approved by Council.  Staff suggest that the General Manager, Planning and Growth Management be delegated the authority to approve the design of the signs.

 

 

LEGAL/RISK MANAGEMENT IMPLICATIONS:

 

There are no legal or risk management impediments to the implementation of the recommendations in this report.

 

 

FINANCIAL IMPLICATIONS

 

As summarized in Recommendation 1, the applicant will be required to pay a processing and technical review fee of one hundred dollars ($100) and a permit fee of one thousand dollars ($1000).  The applicant will also pay one thousand, six hundred and fifty dollars ($1,650) to cover costs stemming from the installation and any needed replacement of signs, with the signs to be provided by the applicant.  An appropriate by-law amendment is proposed which would include applicable fees and charges.

DISPOSITION

 

Following Council approval, staff to undertake to work with the applicant with respect to the installation of the ethno-cultural signs and to report back to the Committee and Council with appropriate by-law amendments for the creation of an ethno-cultural trailblazing signs program on City streets, in order to reflect the intent of the provincial policy.

AND WHEREAS the Provincial Policy requires that the municipality support the applicant’s request for these ethno-cultural signs;

 

AND WHEREAS the Provincial Policy further requires that the municipality approve the design of the ethno-cultural signs to be placed on provincial highways;

 

AND WHEREAS, in addition to the signs on provincial highways, there is a requirement for the municipality to allow the installation of supplemental ethno-cultural “trailblazing” signs on City streets;

 

AND WHEREAS the City of Ottawa’s Signs on City Streets By-law and its Tourism and Public Signs Policy do not presently address ethno-cultural trailblazing signs;

 

AND WHEREAS the community of Little Italy has applied for permission to install ethno-cultural signs on provincial Highway 417 and on Raymond Street, Rochester Street and Carling Avenue.
